HomeMy WebLinkAbout20240759.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, APRIL 3, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 3, 2024, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of March 20, 2024, as printed, Commissioner Buck moved to approve. Commissioner James seconded the motion and it carried unanimously. ▪ AMENDMENTS TO AGENDA: Commissioner Freeman moved to remove Item #3 under 'New Business': Reconsider Contract ID #7960 American Rescue Plan Act (ARPA) Grant Agreement for Case Management Agencies (CMA) Care and Case Management (CCM) Stabilization Support Grant Project, and authorize Department of Human Services to sign electronically [2024-0747], and renumber subsequent items of business accordingly. Commissioner James seconded the motion. Chair Ross clarified the cause for the amendment. There being no further discussion, the motion carried unanimously. Commissioner Saine moved to remove the15-minute time limit and majority vote provisions under 'Public Comment'. There being no second, the motion failed. There were no additional amendments to the Agenda. Commissioner Freeman moved to approve the Agenda, as amended. The motion was seconded by Commissioner James and it carried unanimously. CONSENT AGENDA: Commissioner James moved to approve the Consent Agenda, as printed. Commissioner Buck seconded the motion and it carried unanimously. • WARRANTS: 1) GENERAL WARRANTS — APRIL 1, AND 2, 2024: Commissioner James moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously. Minutes, Wednesday, April 3, 2024 Page 1 2024-0759 BC0016 18 NEW BUSINESS: 1) CONSIDER STANDARD FORM OF AGREEMENT FOR MUNICIPAL JAIL SERVICES, PROVIDER LIST, AND RATES BETWEEN WELD COUNTY SHERIFF'S OFFICE AND VARIOUS MUNICIPALITIES, AND AUTHORIZE CHAIR TO SIGN AGREEMENTS CONSISTENT WITH SAID FORM: Sonja Kohlgraf, Sheriff's Office, requested the Board's approval of the agreement for municipal jail services template as a standard form. She elaborated the standard language addresses services provided, communications, and costs associated with upholding municipal -only offenders in the Weld County Jail. To provide additional context, Captain Matthew Turner indicated just over 20 of 33 municipalities within Weld County have a police department and each of those departments would need their own jail to detain municipal offenders if this agreement were not in effect, which would not serve the citizens of Weld County properly and would be a financial burden. He stated there are 17 police departments who have agreed to execute this agreement and he reviewed the terms. Commissioner James moved to approve said standard form and authorize the Chair to sign agreements consistent with said form. The motion was seconded by Commissioner Buck and it carried unanimously. • 2) CONSIDER CONTRACT ID #7986 2024 PAUL COVERDELL FORENSIC SCIENCE IMPROVEMENT GRANT APPLICATION AND AUTHORIZE NORTHERN COLORADO REGIONAL FORENSIC LABORATORY TO SIGN AND SUBMIT ELECTRONICALLY: Ms. Kohlgraf presented the Forensic Science Improvement Grant application, for funds in the amount of $26,446.00, which will cover staff training costs. Commissioner Freeman moved to approve said application and authorize Daren Ford, Director of the Northern Colorado Regional Forensic Laboratory, to sign and submit electronically. The motion was seconded by Commissioner Buck and it carried unanimously. fa 3) CONSIDER CONTRACT ID #7944 MEMORANDUM OF UNDERSTANDING FOR SERVICES PURSUANT TO WORKFORCE INNOVATION AND OPPORTUNITY ACT (WIOA) PROGRAM, AND AUTHORIZE CHAIR TO SIGN - GBX CONSULTANTS, INC., CONTRACTOR TO U.S. FOREST SERVICE JOB CORPS: Tami Grant, Deputy Director of the Department of Human Services, stated this is a non -financial Memorandum of Understanding (MOU) with GBX Consultants, Inc., contractor to the U.S. Forest Service Job Corps, to fulfill mandated partnerships pursuant to the Workforce Innovation and Opportunity Act (WIOA) Program as the One -Stop Operator for Weld County. Commissioner Saine moved to approve said memorandum of understanding and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. • 4) CONSIDER RENEWAL APPLICATION FOR BREW PUB (COUNTY) LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - TAPPIST MUNKS, LLC, DBA OUTWORLD BREWING: Matthew Conroy, Assistant County Attorney, reviewed the history and location of the establishment, indicated there are no concerns from referral agencies, and stated staff recommends approval. Commissioner Freeman moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously. • 5) CONSIDER RULES OF THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY: Commissioner Saine moved to postpone this item of business indefinitely. Bruce Barker, County Attorney, requested clarification and Commissioner Saine explained she had less than 24 hours to review the Resolution and she needs time to consult her attorney. There being no second, the motion failed. Commissioner James moved to approve said Resolution. The motion was seconded by Commissioner Freeman, and upon a roll call vote, the motion carried four (4) to one (1), with Commissioner Saine opposed. Weld County Clerk to the Board Deputy Clerk to the Board Freeman El PUBLIC COMMENT: 1) Natalee Tennant, Town of Severance resident, offered her comments to the Board and provided proposed draft ballot initiative titled, "Weld County Non -Sanctuary and Illegal Alien Funding Restriction Act", which is marked as Exhibit 'A'. 2) Bob Leisy, City of Greeley resident, offered his comments to the Board. 3) Marian Thompson, City of Dacono resident, offered her comments to the Board. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board. Initiative Text: Section 1: Declaration of Weld County as Non -Sanctuary County Weld County shall cooperate with federal immigration authorities to enforce immigration laws and not provide sanctuary to illegal aliens. S ection 2: Restriction on Housing Funding for Undocumented Immigrants Taxpayer dollars will not be used to provide housing assistance or funding for illegal aliens in Weld County. Section 3: Compliance with Existing Laws and Constitution This initiative will follow all federal, state, and local laws, including immigration laws and the United States Constitution. Section 4: Implementation and Enforcement The Weld County Board of County Commissioners will be responsible for implementing and enforcing this initiative, ensuring compliance, and monitoring the use of taxpayer dollars related to housing funding for illegal aliens. Section 5: Severability If any part of this initiative is found to be invalid, the remaining pads will still be in effect. Section 6: Effective Date This initiative will take effect upon majority approval in a general or special election held in Weld County. N ote: This is a simplified draft of the ballot initiative. It is advised to seek legal counsel before submitting it for consideration. Presented to the Weld County Board of Commissioners on this day April 3, 2024, by Bob Leisy and N atalee Tennant.
