HomeMy WebLinkAbout20241208.tiffHEARING CERTIFICATION DOCKET NO. 2024-26 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR24-0005, FOR OIL AND GAS SUPPORT AND SERVICE (COMPRESSOR STATION) OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - PETERS 313 RANCH, INC., CIO ROCKIES EXPRESS PIPELINE, LLC A public hearing was conducted on May 22, 2024, at 10:00 a.m., with the following present: Commissioner Kevin D. Ross, Chair Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick Deputy County Attorney, Karin McDougal Department of Planning Services representative, Molly Wright Department of Public Health and Environment representative, Ryan Fernandez The following business was transacted: I hereby certify that pursuant to a notice dated April 17, 2024, and duly published April 19, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Peters 313 Ranch, Inc., do Rockies Express Pipeline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0005, for Oil and Gas Support and Service (compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services, presented a brief summary of the proposal and purpose thereof, stated there will be approximately 100 workers onsite, during construction, and once operational, the facility will be monitored remotely with occasional visits for maintenance and routine monitoring. She explained the site will be graveled, fenced, have downcast lighting, and the area outside the fence will be revegetated with native grasses. She shared, per the Development Review staff, the proposed access is at an existing, permitted access onto County Road (CR) 71, which is a local gravel road and requires 60 feet of right-of-way. Ms. Wright relayed the accepted traffic report indicated, during construction, there will be 15 passenger vehicle round trips per day, two (2) tandem truck round trips per day and three (3) semi -truck round trips per day, with construction anticipated to last five (5) months. She explained a Road Maintenance Agreement, during construction, is requested, to include dust control and damage to specified haul routes, sharing the site meets the stormwater detention exception. She described the sign posting, shared a notice was sent to five (5) surrounding property owners (SPOs), with no responses received back and reviewed the surrounding uses. Ms. Wright entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. cc: PLCER/MN /14.1/0A/KR /MW) 07/30/A4 2024-1208 PL2916 HEARING CERTIFICATION - PETERS 313 RANCH, INC., C/O ROCKIES EXPRESS PIPELINE, LLC (USR24-0005) PAGE 2 Ryan Fernandez, Department of Public Health and Environment, stated, since no permanent employees will be onsite, portable toilets are acceptable, the operator has obtained an Air Emissions Permit (APEN), the compressor equipment will be mounted on skids which have floor drains to capture wash water and pump it into storage tanks,- which are emptied as needed, with the wastewater disposed at a licensed facility. He relayed the Noise Study indicated the site will comply with the Light Industrial noise standard, each compressor unit will be contained in an acoustically insulated building, and Environmental Health has 15 Development Standards to be adhered to. El Shawn Bates, TallGrass Energy, introduced the staff who were present, provided a history of the company, explained TallGrass Energy is the operator and 75 percent interest owner of Rockies Express Pipeline, LLC, elaborated on the proposed project, and relayed this project is part of the Natural Gas Act, receiving a Federal Certificate of Public Convenience and Necessity (CPCN) in late 2023. He explained the route of the gas line and the benefit of this compressor station. Mr. Bates requested a change on Development Standard (DS) #29 to start civil work (grading) prior to receiving a building permit. Melissa King, Development Review, stated the Weld County Code does allow for early release on grading permits. No public testimony was offered concerning this matter. The Board reviewed the Conditions of Approval and Development Standards, and no changes or corrections were made. In response to Chair Ross, Mr. Bates indicated they have reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. Commissioner Freeman moved to approve the request of Peters 313 Ranch, Inc., do Rockies Express Pipeline, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR24-0005, for Oil and Gas Support and Service (compressor station) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Buck and it carried unanimously.
