Dear Ms. Nelson:
We have reviewed the above referenced application for a Site Specific Development Plan and
Use by Special Review for two Solar Energy Facilities. Our office previously provided comments
regarding this case number when it included only the Antelope Hill 2 Solar Project in a letter dated
July 12, 2023. The submitted material does not qualify as a "subdivision" as defined in section
30-28-101(10)(a) of the Colorado Revised Statutes ("C.R.S."). Therefore, pursuant to the State
Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office
will only perform a cursory review of the referral information and provide informal comments
regarding the proposed water supply. The comments do not state an opinion on the adequacy of the
water supply plan for this project or the ability of the water supply plan to satisfy any County
regulations or requirements, and cannot be used to guarantee the physical availability of water.
The application seeks to construct community solar gardens on two parcels located northwest
of Greeley, Colorado. The Antelope Hill 1 solar garden will be located on a 61.0 -parcel and the
Antelope Hill 2 solar garden will be located on an adjacent 29.3 -acre parcel. The Antelope Hill 1
solar garden will cover approximately 46.3 acres and the Antelope Hill 2 solar garden will cover
approximately 10.2 acres. The sites have historically been used for irrigated agriculture . The
Antelope Hill 1 site also contains a single family dwelling and agricultural support buildings and also
contain oil and gas facilities. The community solar gardens will replace portions of the irrigated
fields. Construction is anticipated to last for up to half a year, during which time up to 50 workers
may be on -site at a time. Maintenance crews of two to four employees will visit the site
approximately twice a year once construction has been completed. In addition, a maximum of 500
sheep will be used at the sites for vegetation management, tended by a small group of shepherds.
This site will be one of many fields the flock of sheep will rotate between.
Bottled water and portable toilets will be available to workers during construction. The
application states that water for dust mitigation will be brought in from an external source. Any
water used for dust control purposes must be obtained from a source permitted or decreed for such
uses, such as a water hauling company or bulk municipal tap.

The application states that the property owner's existing water rights will be utilized for the
owner's remaining agricultural land, to provide irrigation for the native seed mixture, and to water
the sheep grazing underneath the proposed solar array. According to records available to this office,
the properties have historically been irrigated with water from the Greeley No. 2 Canal and water
from a well registered under permit no. 15059-R. The Greeley No. 2 Canal is an acceptable source of
irrigation water provided that the property owner has shares or rights that entitle them to the use of
water from the ditch. Well permit no. 15059-R was decreed in Division 1 Water Court Case no. W-984
as the Fritzler Well 15059 for irrigation and domestic purposes on land in Section 17, Township 6
North, Range 66 West, 6th P.M., which includes the subject properties. The Fritzler Well 15059 is
located on the Antelope Hill 1 parcel. The Fritzler Well 15059 is included in the Cache La Poudre
Water Users Association's augmentation plan decreed in case no. W-7921(75). The well may continue
to be used for irrigation and domestic purposes in accordance with the terms and conditions of its
well permit and decree(s). Neither of these water sources are decreed for the watering of livestock,
and cannot legally be used to supply water for grazing animals at this site. Because the Antelope Hill
2 site is less than 35 acres in size, this office would be unable to issue an exempt permit to construct
a well on that parcel for livestock watering purposes. Subject to a statement of non -opposition from
the North Weld County Water District, it is anticipated that this office could issue an exempt permit
to construct a well at the Antelope Hill 1 site for livestock watering purposes, which could also be
piped or hauled to the Antelope Hill 2 site.
The existing storm water flow characteristics of the sites are expected to remain unchanged,
therefore no stormwater detention facilities are proposed as a part of this project.
