The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, October 2, 2024, at the hour of 9:00 a.m.
Ei ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

• MINUTES: There being no corrections to the Minutes of the Board of County Commissioners
meeting of September 18, 2024, as printed, Commissioner Buck moved to approve. Commissioner
James seconded the motion and it carried unanimously.
ti CERTIFICATION OF HEARINGS: Commissioner Buck moved to approve the Certification of
Hearings conducted on September 18, 2024, as follows: 1) USR21-0024 - St. Scholastica Catholic
Parish in Erie, 2) COZ24-0005 — Cataract Capital, LLC, and Talons Capital 2, LLC, and 3) COZ24-0002
— WW, LLC. Commissioner James seconded the motion, which carried unanimously.
• A• MENDMENTS TO AGENDA: There were no amendments to the Agenda.
C• ONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed.
Commissioner James seconded the motion and it carried unanimously.
PROCLAMATIONS:
1) WELD COUNTY LONG-TERM CARE RESIDENTS' RIGHTS MONTH - OCTOBER 2024: Chair Ross
read the proclamation for the record. Tami Grant, Deputy Director of the Department of Human Services,
thanked the Board for the proclamation recognizing the value of the Ombudsman program. She stated
the purpose of this month is to highlight and recognize the importance of honoring the rights of residents
in long-term care and assisted living facilities. Ms. Grant stated Weld County has eight (8) nursing homes
and 23 assisted living facilities, which support over 750 individuals, and they anticipate two (2) new
facilities opening in 2025. She introduced the Ombudsman staff who provide consultation to families,

faculty staff and community partners. The Commissioners, in turn, expressed their appreciation to the
staff who value and advocate for the rights of the citizens who receive assisted care. (Clerk's Note: The
group gathered for a photo opportunity.)
• WARRANTS:
1) GENERAL WARRANTS - OCTOBER 1, 2024: Commissioner Buck moved to approve the General
Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. (Clerk's
Note: subsequent to the meeting, it was discovered that the warrants for September 30, 2024, were
inadvertently omitted from the approval packet, thus they were added to the agenda and approved on
October 9, 2024.)
2) COMMISSIONER WARRANTS (PERRY L. BUCK) - OCTOBER 1, 2024: Commissioner James
moved to approve the Commissioner Warrants, as printed. Commissioner Freeman seconded the
motion, and upon a roll call vote of three (3) to zero (0), the motion carried with Commissioner Buck
recused.
3) COMMISSIONER WARRANTS (MIKE FREEMAN) - OCTOBER 1, 2024: Commissioner James
moved to approve the Commissioner Warrants, as printed. Commissioner Buck seconded the motion,
and upon a roll call vote of three (3) to zero (0), the motion carried with Commissioner Freeman recused.
El BIDS:
1) WITHDRAW BID #B2400089, GENERAL INVESTMENT CONSULTANT SERVICES FOR WELD
DEFINED BENEFIT RETIREMENT PLAN - DEPARTMENT OF FINANCE AND ADMINISTRATION AND
BOARD OF RETIREMENT: Toby Taylor, Purchasing Department, explained this request was advertised;
however, upon review, it was discovered the bid should not have been presented to the Board of County
Commissioners, since the Retirement Board is an independent representative of the employees.
Commissioner James moved to withdraw said bid, per staff's recommendation. The motion was
seconded by Commissioner Buck and it carried unanimously.
• 2) APPROVE BID #62400121, HOUSING NEEDS ASSESSMENT FOR UNINCORPORATED
WELD COUNTY - DEPARTMENT OF PLANNING SERVICES: Mr. Taylor stated staff recommends
selecting the sole bidder who met specifications, Kimley-Horn, for a total amount of $90,820.00 to be
paid with administrative funds from the Community Development Block Grant (CDBG) program.
Commissioner Freeman moved to approve said bid. The motion was seconded by Commissioner James
and it carried unanimously.
• 3) REJECT BID #B2400125 BOND AND COPIER PAPER - DEPARTMENT OF FINANCE
(PRINTING AND SUPPLY): Mr. Taylor explained this item was issued as an all -or -nothing bid; however,
upon review, it was discovered that bidding the white paper separately from the colored paper would
result in a substantial savings for the County. Therefore, staff recommends rejecting and rebidding the
paper types separately at a later date. Commissioner James moved to reject said bid, per staff's
recommendation. The motion was seconded by Commissioner Buck and it carried unanimously.
• 4) PRESENT BID #62400119, SH 392 AND CR 37 INTERSECTION IMPROVEMENTS -
DEPARTMENT OF PUBLIC WORKS: Mr. Taylor stated four (4) bids were received and staff will make a
recommendation on a date in the future that is yet to be determined.

• 5) PRESENT BID #62400132, DELL CYBERSENSE SUBSCRIPTION — DEPARTMENT OF
INFORMATION TECHNOLOGY: Mr. Taylor stated four (4) bids were received and staff will make a
recommendation on October 16, 2024.
• NEW BUSINESS:
1) CONSIDER CONTRACT ID #8739 AMENDMENT #4 TO CONTRACT FOR JAIL BASED
BEHAVIORAL HEALTH SERVICES AND AUTHORIZE CHAIR TO SIGN: Sonja Kohlgraf, Sheriff's
Office, stated the amendment reflects a $14,000.00 reduction in funds, for a total of $286,000.00 for state
fiscal years 2024/2025, which will support assessment and treatment of jail inmates for substance abuse
and mental health. Commissioner Buck moved to approve said amendment and authorize the Chair to
sign. The motion was seconded by Commissioner Freeman and it carried unanimously.
• 2) CONTRACT ID #8726 AMENDMENT #1 TO AGREEMENT FOR WORKFORCE INNOVATION
AND OPPORTUNITY ACT (WIOA) CHIEF ELECTED OFFICIAL AND ONE -STOP OPERATOR, AND
AUTHORIZE CHAIR, DEPARTMENT OF HUMAN SERVICES, AND WORKFORCE DEVELOPMENT
BOARD TO SIGN: Jamie Ulrich, Director of the Department of Human Services, stated the amendment
outlines the roles and responsibilities to demonstrate compliance with WIOA. Commissioner Freeman
moved to approve said amendment and authorize the Chair to sign. The motion was seconded by
Commissioner James and it carried unanimously.
El 3) CONSIDER CONTRACT ID #8728 CASE MANAGEMENT AGENCY (CMA) SERVICE
AGREEMENT TERMS AND CONDITIONS, AND AUTHORIZE CHAIR TO SIGN - DEVELOPMENTAL
DISABILITIES CENTER, DBA IMAGINE!: Ms. Ulrich stated Imagine! provides an extensive list of client
services reflected in the memo. Commissioner James moved to approve said agreement and authorize
the Chair to sign. The motion was seconded by Commissioner Buck and it carried unanimously.
EJ 4) CONSIDER CONTRACT ID #8729 PROMOTING SAFE AND STABLE FAMILIES (PSSF)
PARTNERSHIP PROJECT AGREEMENT, AND AUTHORIZE CHAIR TO SIGN - CATHOLIC
CHARITIES AND COMMUNITY SERVICES OF THE ARCHDIOCESE DENVER, WELD REGIONAL
OFFICE: Ms. Ulrich stated the PSSF grant award funds will be used to partner with Catholic Charities to
provide case management and family advocacy services. Commissioner James moved to approve said
agreement and authorize the Chair to sign. The motion was seconded by Commissioner Buck and it
carried unanimously.
• 5) CONSIDER CONTRACT ID #8730 PROMOTING SAFE AND STABLE FAMILIES (PSSF)
PARTNERSHIP PROJECT AGREEMENT, AND AUTHORIZE CHAIR TO SIGN - KIDS AT HEART:
Ms. Ulrich stated the PSSF grant award funds will be used for respite services for adoptive and kinship
foster care families. Commissioner Freeman moved to approve said agreement and authorize the Chair
to sign. The motion was seconded by Commissioner James and it carried unanimously.
• 6) CONSIDER CONTRACT ID #8735 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF
FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - MASON
MONTI AND RONNI GRAY: Ms. Ulrich stated this is for a new certified foster care home located in
Lochbuie, Colorado. Commissioner Buck moved to approve said contract and authorize the Chair to sign.
The motion was seconded by Commissioner James and it carried unanimously.
El 7) CONSIDER CONTRACT ID #8653 CHANGE ORDER TO AGREEMENT FOR CONSTRUCTION
SERVICES FOR 2024 SLURRY SEAL CONTRACT AND AUTHORIZE CHAIR TO SIGN -
VANCE BROTHERS, INC.: Curtis Hall, Director of the Department of Public Works, stated this change

order is for additional funding to increase the number of crack -fill locations, since the original contracted
work has already been completed. He stated the additional projects will cost $145,075.00, and the
Finance Department has confirmed there are funds available for the work. Commissioner James moved
to approve said change order and authorize the Chair to sign. The motion, which was seconded by
Commissioner Buck, carried unanimously.
• 8) CONSIDER CONTRACT ID #8741 MULTIMODAL TRANSPORTATION AND MITIGATION
OPTIONS FUND (MMOF) CALL FOR PROJECTS APPLICATION FOR 2027-2028 ON -DEMAND
TRANSIT SERVICES, AND AUTHORIZE DEPARTMENT OF PUBLIC WORKS TO SUBMIT
ELECTRONICALLY: Evan Pinkham, Department of Planning Services, stated the application is for
on -demand transit services, as an extension of the Upper Front Range Transportation Planning Region
(UFRTPR) working with Via Mobility to operate one bus. He stated the program will benefit residents in
unincorporated areas of Weld County, as well as the Towns of Ault, Fort Lupton, Gilcrest, Hudson,
Keenesburg, Kersey, Nunn, and Platteville. He further stated current funding will support the program
through the end of 2026, and this application will extend funding into 2027 and 2028, with a local match
in the amount of $43,000.00 for two years. Commissioner James moved to approve said application and
authorize the Department of Public Works to submit electronically. The motion was seconded by
Commissioner Freeman and it carried unanimously.
Fj 9) CONSIDER CONTRACT ID #8742 APPLICATION FOR CONGESTION MITIGATION AND AIR
QUALITY (CMAQ) PROJECT GRANT FUNDS FOR SH 52 AND CR 59 INTERSECTION
IMPROVEMENTS PROJECT, AND AUTHORIZE DEPARTMENT OF PUBLIC WORKS TO SUBMIT
ELECTRONICALLY: Mr. Pinkham stated the grant application is for CMAQ grant funding to be used in
the UFRTPR. He explained Weld and Larimer Counties alternate years, and staff met with several
communities in the Weld portion of the UFR to select projects. He stated the request is for $1.3 Million in
this cycle, with a local match of $287,000.00, or 17% of the requested amount. Commissioner Freeman
moved to approve said application and authorize the Department of Public Works to submit electronically.
The motion was seconded by Commissioner Buck and it carried unanimously.
', 10) CONSIDER DIRECTING CLERK TO THE BOARD TO HAVE PUBLISHED EMERGENCY
ORDINANCE NO. 260-B SUPPLEMENTAL APPROPRIATION FOR 2024: Jennifer Oftelie, Budget
Manager, explained the 2024 budget was approved as an emergency ordinance; therefore, a
supplemental appropriation must be published at least once prior to consideration on October 16, 2024.
Commissioner James moved to approve said Resolution. The motion was seconded by Commissioner
Buck, and it carried unanimously.
11) CONSIDER APPOINTMENT OF LEAH FLESNER AS DEPUTY CLERK TO THE BOARD:
Esther Gesick, Clerk to the Board, explained the staffing transitions within the office and recommended
Leah Flesner be appointed as a Deputy Clerk to the Board. Ms. Flesner shared she previously worked
for two years in the Weld County Planning and Building Department and is excited for the new career
opportunity within the Clerk to the Board. Commissioner James moved to approve said appointment. The
motion was seconded by Commissioner Buck, and it carried unanimously.
• 12) CONSIDER UPDATED ITEMIZED LIST OF LEGAL HOLIDAYS DURING CALENDAR YEAR
2025: Commissioner Freeman moved to approve said Resolution. The motion was seconded by
Commissioner Buck, and it carried unanimously.

PLANNING:
1) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - JESUS VEGA: Adria Schiel, Assistant County Attorney,
provided a brief summary of the court -order process, explained this and each of the following properties
are in violation of the Weld County Code for various zoning and/or building violations, and she introduced
Nicole Brick, Cynthia Villanueva, and Jordan Cook, Compliance Officers with the Department of Planning
Services. She stated Jesus Vega, property owner, has a court -ordered penalty in the amount of $50.00,
per day, which began on September 2, 2022, for zoning violations which include commercial trucking and
storage operations without the appropriate land use permit on property zoned I-1 (Industrial). Images of
the site conditions were displayed, and Ms. Schiel stated staff recommends certification as a special
assessment in the amount of $16,500.00, for the period of October 9, 2023, up to and including
September 2, 2024. Yaricxa Vega, daughter of Jesus Vega, explained the work involved with hiring an
engineer to draft a blueprint for the detention pond to address drainage issues, and noted they are also
facing challenges with gaining approval of the access from the local fire district. In response to
Commissioner James, Maxwell Nader, Department of Planning Services, explained there are several
steps and processes that need to be accomplished, including completion of the conditionally approved
Site Plan Review (SPR), which was previously revoked by the Planning Director, the owners appealed
the director's decision, but it was upheld by the Board of Commissioners. He stated Mr. Vega now has
the options of: 1) applying for a new SPR on the southern parcel, which still has access issues to be
addressed, or 2) apply for a Resubdivision to combine the two lots which needs a wider access potentially
accomplished through the Chapter 8 variance process, or 3) complete a Change of Zone to allow the
outdoor storage, in which the access is still an issue. Ms. Vega stated they are willing to work through
the processes with staff, although the requirements of the fire district remain restrictive for access and
drainage issues. Responding to Commissioner Freeman, Mr. Nader reiterated it is a three -step process:
Resubdivision with the access situation that would require Commissioner approval of the access appeal,
then complete a Change of Zone to reaffirm the access granted through the Resubdivision, and then
finally complete a SPR to establish the use, and despite all of these processes, the MS4 scenario has to
be addressed and it does encompass a large portion of the property. Chair Ross commented the owners
are not using the property in accordance with the current zoning of I-1 (Industrial). Ms. Vega stated her
understanding that the zone change is not possible without the access. Dawn Anderson, Planning
Services — Development Review, explained staff will follow Code and must ensure criteria is met, and if
denied, there is a variance process outlined in Chapter 8 for staff to evaluate the hardship.
Commissioner James stated he is willing to grant an additional six (6) months for the property owner to
work through a very challenging process with staff. Following discussion, Commissioner James moved
to continue consideration of said certification of zoning violation as a special assessment to April 2, 2025,
at 9:00 a.m. The motion was seconded by Commissioner Freeman and it carried unanimously.
2) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - JOHN KRENZELOK: Ms. Schiel provided a brief description
of the location of the site, which has a court -ordered penalty in the amount of $50.00, per day, which
began on March 21, 2022, for zoning violations which include a noncommercial junkyard and structures
without a principal use, a manufactured structure without permits, and an occupied camper/RV. Staff
displayed images of the site and Ms. Schiel stated staff recommends certification as a special
assessment in the amount of $16,350.00, for the period of October 12, 2023, up to and including
September 2, 2024. She noted there have been multiple complaints concerning the property, and staff
has received no response from the owner. Chair Ross confirmed the property owner was not present.
Commissioner James moved to approve said certification as a special assessment. The motion was
seconded by Commissioner Buck and it carried unanimously.

• 3) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT — FRANK AND YRENE MARTINEZ: Ms. Schiel provided a
brief description of the location of the vacant parcel, which has a court -ordered penalty in the amount of
$50.00, per day, which began on August 14, 2023, for zoning violations which include accessory uses
without a principal use, a noncommercial junkyard, structures without a permit, and an occupied
camper/RV. Staff displayed images of the site and Ms. Schiel stated staff recommends certification as a
special assessment in the amount of $16,500.00. Kathy Martinez, daughter of the property owners, stated
she lives out of state and has traveled in to help them resolve this situation; however, they are waiting on
her mother's social security to qualify for a loan to get a Clayton Homes modular placed on the property.
Following discussion, and in response to Commissioner James, Ms. Martinez stated six (6) months would
be sufficient to complete the necessary work. Commissioner James moved to continue said certification
as a special assessment to April 2, 2025, at 9:00 a.m. The motion was seconded by Chair Ross, and
upon a roll call vote, the motion passed three (3) to one (1), with Commissioner Freeman opposed.
• 4) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - STEVEN WOOD: Ms. Schiel provided a brief description of
the location of the site, which has a court -ordered penalty in the amount of $15.00, per day, which began
on February 6, 2023, for zoning violations which include fire damage repairs without the proper building
permits. She stated multiple complaints have been received concerning people living in tents, recreational
vehicles, trash, and traffic; therefore, staff recommends certification as a special assessment in the
amount of $4,950.00. Cynthia Villanueva stated the property still has people living in tents and campers,
and staff asked the property owner to request a Life/Safety Inspection due to the flash fire that took place,
but that task has not been accomplished. Chair Ross confirmed the property owner was not present.
Commissioner James expressed his concern with the ongoing hazardous condition on the site and
moved to approve said certification as a special assessment. The motion was seconded by
Commissioner Freeman, and it carried unanimously.
• 5) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - ROGER AND SHERYL HILL: Ms. Schiel provided a brief
description of the location of the property, which has a court -ordered penalty in the amount of $100.00,
per day, which began on May 13, 2023, for zoning violations which include a commercial storage
operation with a land use permit and a noncommercial junkyard. Images of the site conditions were
displayed, and Ms. Schiel stated staff recommends certification as a special assessment in the amount
of $33,100.00. Roger Hill, property owner, commented he understands the concerns with the property,
and stated he is willing to try and correct the situation of his family using the property without the
necessary permits. Diana Aungst, Planning Services, explained the property was granted a Use by
Special Review Permit, in 2016, which allowed for a trucking operation; however, they never completed
the Conditions of Approval, and the permit was subsequently revoked through the Probable Cause /
Show Cause hearing process. She stated the property owners subsequently applied for a Zoning Permit
for Agricultural Use (ZPAG), which was conditionally approved in July, 2023, but again the conditions of
approval were not addressed, and they need a building permit, or the permit may potentially be revoked.
Ms. Villanueva stated there have been no recent complaints. Commissioners Buck and Freeman
commented concerning the need for compliance with building regulations and ongoing non-compliance
since 2016, which is a blatant disregard of the Code. Mr. Hill stated he contacted a consultant to process
the permit, but they have not responded. In response to Commissioner James, Ms. Aungst stated the
end of October should be sufficient to complete the ZPAG process, which would bring the site into
compliance. Commissioner James moved to continue said certification as a special assessment to
November 6, 2024, at 9:00 a.m. The motion was seconded by Commissioner Buck.
Commissioner Freeman commented the violation has been ongoing, since 2016 and Chair Ross
concurred. Commissioners James and Buck rescinded their motion. Commissioner Freeman moved to

certify penalties, based on the span of 8.5 years without compliance. Commissioner James seconded
the motion, and upon a roll call vote, the motion passed three (3) to one (1) with Commissioner Buck
opposed.
Ei 6) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT — JERRY DILL: Ms. Schiel provided a brief description of the
location of the site, which has a court -ordered penalty in the amount of $10.00, per day, which began on
August 20, 2021, for zoning violations which include a noncommercial junkyard, unpermitted mobile
home, and commercial vehicles. Images of the site conditions were displayed, and Ms. Schiel stated staff
recommends certification as a special assessment in the amount of $3,200.00. Chair Ross confirmed the
property owner was not present. Commissioner Buck moved to approve said certification as a special
assessment. The motion was seconded by Commissioner James, and it carried unanimously.
IEJ 7) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - JOSE MENDOZA: Ms. Schiel provided a brief description
of the location of the site, which has a court -ordered penalty in the amount of $25.00, per day, which
began on September 19, 2022, for zoning violations which include a noncommercial junkyard, including
derelict vehicles and other debris. Images of the site conditions were displayed, and Ms. Schiel stated
the property owner has not responded to staff, therefore, they recommend certification as a special
assessment in the amount of $8,250.00. Chair Ross confirmed the property owner was not present.
Commissioner James moved to approve said certification as a special assessment. The motion was
seconded by Commissioner Freeman, and it carried unanimously.
8) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - MAURO AND LOUISA RODRIGUEZ: Ms. Schiel provided
a brief description of the location of the site, which has a court -ordered penalty in the amount of $20.00,
per day, which began on December 5, 2022, for zoning violations which include a noncommercial
junkyard, unpermitted building, and unpermitted electrical work. Images of the site conditions were
displayed, and Ms. Schiel stated staff recommends certification as a special assessment in the amount
of $6,620.00. Chair Ross confirmed the property owners were not present. Commissioner Freeman
moved to approve said certification as a special assessment. The motion was seconded by
Commissioner James, and it carried unanimously.
rg 9) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - JUAN AND SILVIA GALLARDO: Ms. Schiel provided a brief
description of the location of the site, which has a court -ordered penalty in the amount of $25.00, per day,
which began on August 8, 2022, for zoning violations which include commercial vehicle parking without
the property zoning permit. Images of the site conditions were displayed, and Ms. Schiel stated staff
recommends certification as a special assessment in the amount of $8,250.00. Chair Ross confirmed the
property owners were not present. Commissioner Buck moved to approve said certification as a special
assessment. The motion was seconded by Commissioner James, and it carried unanimously.
El 10) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - MELINA SABANOVIC: Ms. Schiel provided a brief
description of the location of the site, which has a court -ordered penalty in the amount of $25.00, per day,
which began on August 5, 2019, for zoning violations which include a noncommercial junkyard without a

Commissioner James, Mr. Mahic explained the financial limitations to construct a fence suitable to
withstand weather conditions; however, he does have the ability to clear the property.
Commissioner James moved to approve said certification as a special assessment. The motion was
seconded by Commissioner Freeman, and it carried unanimously.
El PUBLIC COMMENT: There was no public comment.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
