HomeMy WebLinkAbout20242844.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, OCTOBER 28, 2024 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 28, 2024, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Kevin D. Ross, Chair — EXCUSED Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli El MINUTES: There being no corrections to the Minutes of the Board of County Commissioners meeting of October 14, 2024, as printed, Commissioner James moved to approve. Commissioner Freeman seconded the motion and it carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the Agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. ---� WARRANTS: 1) GENERAL WARRANTS - OCTOBER 25, 2024: Commissioner Freeman moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. El BIDS: 1) PRESENT BID #62400138, WELD COUNTY ASSESSOR'S AND TREASURER'S OFFICE BUILDING (1400 N. 17TH AVE, GREELEY) BULLET RESISTANT WALL AND WINDOW PANELS FOR LOBBIES - FACILITIES DEPARTMENT: Carolyn Geisert, Purchasing Department, stated five (5) bids were received and staff will make a recommendation on November 13, 2024. " 1I3 Minutes, Monday, October 28, 2024 Page 1 2024-2844 BC0016 IR NEW BUSINESS: 1) CONSIDER TEMPORARY CLOSURE OF CR 55 BETWEEN CRS 44 AND 46: Amy Mutchie, Department of Public Works, stated the closure will begin November 4, 2024, and go through November 7, 2024, for the replacement of a drainage culvert. She further stated the one (1) mile gravel portion of the detour route has already been treated for dust control, with the rest of the detour route paved. Commissioner James moved to approve said temporary closure. The motion was seconded by Commissioner Freeman and it carried unanimously. 2) CONSIDER TEMPORARY CLOSURE OF CR 5.5 BETWEEN CR 26 AND PEARL HOWLETT RD: Ms. Mutchie stated the closure will begin November 12, 2024, and go through November 22, 2024, for the replacement of an irrigation culvert. She further stated water will be used for dust control, as needed, for the one (1) mile gravel portion of the detour route and the length of the closure will also include asphalt patching. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner James and it carried unanimously. El 3) CONSIDER CONTRACT ID #8797 TAX INCENTIVE AGREEMENT PURSUANT TO C.R.S. §30-11-123, AND AUTHORIZE CHAIR PRO-TEM TO SIGN - TEXAS FARM PRODUCTS COMPANY, DBA TFP NUTRITION: Cheryl Pattelli, Chief Financial Officer, stated staff received a request to utilize the County's Personal Property Tax Rebate Program by Texas Farm Products, dba TFP Nutrition, which specializes in manufacturing and distribution of animal pet foods. She indicated the company, founded in Texas, is looking to establish their first Colorado operation locate in Platteville. Ms. Pattelli stated $90 million is the estimate cost of expansion, and approximately $59.5 million is new equipment. She reported the company will hire 100 full-time employees, of which an estimated 65% reside in Weld County, with an estimated wage of $63,453.00. Based on the company's equipment investment of $59.5 million, Ms. Pattelli indicated $572,629.00 is eligible for a partial personal property tax rebate over a period of ten (10) years. Commissioner James moved to approve said agreement and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. 4) CONSIDER CONTRACT ID #8822 TAX INCENTIVE AGREEMENT PURSUANT TO C.R.S. §30-11-123, AND AUTHORIZE CHAIR PRO-TEM TO SIGN - NORTH AMERICAN MACHINES OF COLORADO, DBA TRULOG SIDING: Ms. Pattelli stated staff received a request to utilize the County's Personal Property Tax Rebate Program by North American Machines of Colorado, dba Trulog Siding. She indicated the company specializes in manufacturing of metal siding that is designed to give structures the appearance of a log cabin. She indicated the company is an existing company located in LaSalle, Colorado, but is seeking to expand their operation and production capacity. Ms. Pattelli explained the company's consideration of constructing a new production and distribution facilities has estimated an investment of equipment at $5.1 million, of which $4.1 million will be new equipment, and stated the company anticipates hiring at least eight (8) new full-time employees with an estimated wage of $65,000.00 per year. She noted the company estimates 74% of their employees reside in Weld County and based on the company's equipment investment of $4.1 million, Ms. Pattelli indicated $39,458.00 is eligible for a personal property tax rebate over a period of ten (10) years. Commissioner Saine moved to approve said agreement and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. IE 5) CONSIDER SPECIAL EVENT PERMIT AND AUTHORIZE CHAIR PRO-TEM TO SIGN - NOCO SANTA SQUAD: Matthew Conroy, Assistant County Attorney, stated the application is for NoCo Santa Squad and their event being held on November 9, 2024, from 4:00p.m. to 9:00 p.m., at the Dreams and Dragonflies Event Center near Johnstown, Colorado. He noted the event center is permitted under Use by Special Review Permit, USR19-0033, and informed the Board staff's concern is the existing Minutes, Monday, October 28, 2024 Page 2 2024-2844 BC0016 septic system is permitted for twenty (20) people. Mr. Conroy indicated staff recommends the use of additional portable toilets to supplement during the event, but noted it is not a requirement. Martin Gerlach, applicant, provided background to the creation of NoCo Santa Squad and indicated it is a first responder based non-profit organization for the benefit of children and families in Northern Colorado during the holiday season. No public testimony was offered concerning this matter. Commissioner James moved to approve said special event permit and authorize the Chair Pro-Tem to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. PLANNING: 1) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION PENALTIES AS SPECIAL ASSESSMENT - MICHAEL LOPEZ (CONT'D FROM 9/30/2024): Adria Schiel, Assistant County Attorney, shared the property location and indicated the Weld County Court found the property was in violation of the Weld County Code and assessed daily penalties, in the amount of $25.00. She informed the Board, as of October 21, 2024, the property was deemed in substantial compliance with the Weld County Code and the case was dismissed from the Weld County Court. Ms. Schiel stated staff recommends not to certify the penalties as a special assessment with the Treasurer's Office. In response to Chair Pro-Tem Buck, Jordan Cook, Department of Planning Services, indicated there may have been a lapse in communication with the property owner and the previous compliance officer, but the property owner has made substantial progress in screening of his property. Commissioner James thanked the property owner who was not present, and further moved to dismiss said zoning violation and said penalties are no longer due or owing from the property owner. The motion was seconded by Commissioner Saine and it carried unanimously. PUBLIC COMMENT: There was no public comment offered. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
