RESOLUTION
WHEREAS, a public hearing was held on Monday, March 24, 1969
at 2:00 P. M. , in the Chambers of the Board of County Commissioners of
Weld County, Colorado, for the purpose of hearing the petition of Weldco
Land and Investment Company, 1212 - 8th Avenue, Greeley, Colorado, re-
questing a change of zone concerning three parcels of land and designated
on submitted plat as follows; to -wit:
No. 1: PARCEL A - from "E" Estates District to "C"
Commercial District;
No. 2: PARCEL B - from "E" Estates District to "T"
Transitional District;
No. 3: PARCEL C - from "E" Estates District to "B"
Business District, and
WHEREAS, the petitioners were present and represented by coun-
sel, John J. Dooley, and
WHEREAS, there was no opposition to the changes of zone, and
WHEREAS, the Board of County Commissioners has studied the re-
quest of the petitioner and studied the recommendations of the Weld County
Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, that the petition of Weldco Land and Investment Company
for changes of zone concerning the following three parcels of land, to -wit:
No. 1: PARCEL A - from "E" Estates District to
Commercial District;
No. 2: PARCEL B - from "E" Estates District to
Transitional District;
No. 3: PARCEL C - from "E" Estates District to

1. That any water and sanitation facilities to be installed shall be ap-
proved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations ads
shall be followed and complied with to the satisfaction of the Board of County
Commissioners, Weld County, Colorado.
3. Subject to the Greeley Code of Ordinances, providing that the de-
veloper shall comply with all the rules and regulations of the City of Greeley
relating to drainage outside the city limits, including the payment of drainage
fees; and that contractual agreement shall be made with the City of Greeleyto
provide water and sewer services which are necessary for the type of develop-

ment proposed for said parcels.
4. That within the subject property, twenty feet of additional right-
of-way shall be provided for 23rd Avenue and for 17th Avenue and that fifty
foot radius turns shall be deeded at the intersection of 17th Avenue and U. S.
Highway 34 Bypass and at the intersection of 23rd Avenue and U.S. Highway
34 Bypass.
5. That said changes of zone here granted are conditional only for
-a period of twelve months from date hereof, on condition that _developer pro-
ceed with due diligence to begin development of the areas re -zoned and sub-
mit plans for such development for the approval of the Weld County Planning
Commission; and that major construction shall commence thereon within said
twelve month period; otherwise, the County may take action to re -zone the
property to its present classification.

Marshall Anderson: We will call this meeting to order , Docket Number 5
Weldco Land and Investment Company, 1212 Eighth Avenue, Greeley, Colorado.
the date being March 24, 1969 the hour being 2:00 P. M. At this time
I will turn the hearing over to Mr. Telep, the County Attorney for an
opening statement.
Mr. Telep: Thank you Mr. Chairman, I would like the record to
show that this cause came on for a hearing this day, March 24th, 1969,
at 2:00 P. M. pursuant to a notice as was published as required by
law in the Greeley Booster, February 21 and March 14, 1969. Let the
record further show that this request for a change of zone is made
by the Weldco Land and Investment Company, a Colorado corporation,
requesting a change of zone of three parcels of land. More particularly
described as Parcels "A", "B" and "C" on the plat as was submitted
and was published. We won't read the legal description in metes and
bounds as contained in the publication, however we will identify it as
parcel "A" it is a -request for a change of zone from "E" Estate District
to "C" Commercial District of a parcel described in metes and bounds
containing 48.544 acres more or less.
The next parcel identified as parcel "B", the request
for the change of zone on that parcel is from "E" Estate District to "T"
Transitional District.
The last parcel being parcel "C" also described in
metes and bounds, the request for that one is to be zoned "E" Estate
District to "B" Business District and just moving back a little bit

that parcel "B" is supposed to contain approximately 16.9 acres more
or less. Parcel "C".containing 2.6 acres more or less.
Let the record further show that the petitioner is
present in the room and that he is represented by counsel Mr. John Dooley.
Let the record further show, we have here on file, and for the record a

resolution of the Weld County Planning Commission dated January 31, 1969
recommending favorably on all three parcels to be rezoned subject to
certai-n conditions which hopefully we will go into during the course
of the meeting. Mr. Chairman I believe it is in order to procede
with; hearing and perhaps maybe the petitioner or the counsel for the
petitioner would have some prefacing remarks to make or an opening
statement otherwise we are ready to procede.
Mr. Dooley: My name is John Dooley, Mr. Chairman, we appreciate
the opportunity to appear here. I will be brief I think we have all
been involved with this more or less -all three of the members of the
Board at least. In review I think we are all familiar with the wish
of the Board of County Commissioners and am sure of the Weld County
Planning Commission. When matters for rezoning are so closely located
to the City of Greel-ey as this one is that we feel that the
the Planning people of the City of Greeley is desirable and
you understand the matter has been presented to the Greeley
Commission and the Counsel and discussed throughly - not of
officially but to the extent that we know their reaction.

You will recall also that we have had some meetings
to try to attempt to explain what was going on here. The Weld County
Planning Commission met and concluded that a public hearing was desirable
and that was held and as a result of that the February 3 resolution has
been presented to this Board. I think that it is plain from what Mr. Telep
has read concerning the desires of the petitioners the change from one zone
to the other that its plan to develop this area for business with a reasonable
buffer. We have three conditions which we have mentioned in the resolution
of the Weld County Planning Commission. That major construction would
commence within twelve months or the zoning would revert to the present
zoning. This is a condition which the petitioners offer and which the
Weld County Planning Commission felt was desirable and they asked that this
be included and we were pleased to do so.

Mr. Dooley: Then there was also a suggestion that a condition be
attached providing for adequate highway. Adequate roads to handle the
traffic. It has been described here as twenty feet of additional right -of
way for Twenty-third Avenue and Seventeenth Avenue. And fifty foot radius

turns/at the intersection of Seventeenth Avenue and U. S. Highway 34.
and Twenty-third Avenue and U. S. Highway 34. This presents no problems
we have accepted that condition. We not only have before the Planning
Commission but do here - we wish you to understand that we are pleased
to comply with these requirements. Then contractual agreements provide
adequate public utilities - this of course we will do. You might be
interested in this connection - that we have discussed the matter of
development and building with the administrative officials of the City
of Greeley and particulary those concerned with the building code and
we have agreed that we feel that with this kind of proximity to the City
and the ultimate hope that it would be annexed to the City of Greeley
that we would build accordingly to the Greeley Building Code and of
course meet any county requirements as well.
We also agreed as they wish the City of Greeley may
inspect just as though the property was being constructed within the
City of Greeley. This of course would mean that any inspection that the
County wanted - we are not precluding - we are welcoming both - is what
I am trying to say. I may have the cart before the horse though. I
think that we all understand that this property is located in the
southeast corner of ₹wenty-third Avenue and Highway 34, the old Armes
Farm. On the west is Twenty-third Avenue proceding south and the east
is the Booster Station then on over further is John Evans High. I think
you are familiar with it. We hope to develop this with a substantial
business area in order to do so it does require this rezoning.
I don't want to belabor the point but the Board has
been more or less exposed to this and we think we have a reasonable thing
we have exposed it and I don't want to burden you with any further exposure
if you would feel that any comments. If you would like any comments by me
directed to any particular issue then I would be pleased to discuss which
side of it but my feelings would be that any further comments would simply
bore you. You understand what we are up against - you might be interested

in ongfnore thing. In general we feel that if annexation occurs it could
occur in rectangles - they would be long north and south. The development
would be in other words would be to put a building on the property and
then the ansularly facilities would be north and south of it. So as
those are developed and opened and ready for business they could be
annexed to the City of Greeley in those strips - you see. So this in
general is the idea and you may be interested also to know that the
City of Greeley , if we understand each other in that connection. I
don't know really what you know has been said to the Planning Board.
These matters were taken up there and discussed at some detail and I
assume, that at least in general, you are aware of them. So I will
please to go ahead if you will refer or if you prefer to have me shut
up and if you would like to direct questions to me or to listen to
others comments I would be pleased to have it done that way.
Mr. Billings: Well I don't think - basically the three of us kind
of stayed away from the meeting and everything so there would not be
to great of an influence on us. It might be an idea at this time if
you would go into a little more detail.
Mr. Dooley:
Well we have the maps in our file of course which
would indicate in general what we have in mind. This picture - of
course you only understand it is only a representation - it doesn't really
help much - I think. I think you may have seen it. You see it shows the
development here along the highway. This is U. S. 34. but the highway here
is at the top and this is Twenty-third Avenue and down in here is the
southeast corner, that is the way the development is drawn. You understand
there isn't any - it hasn't gone this far. We, as you know, have one
major outlet designed for here and actually the plan is to kind of turn
it over and to put the parking somewhat near the highway and bring the
building out here farther, with the transitional area you see here and here.
But it does give you an idea of the shape of the area. About how it is
planned and developed. The highways we spoke of in the condition are
Mr, Dooley: of course these points down here on Twenty-third and
here on Seventeenth Avenue. This is easy in making the roadways available
because if you have people who have store in here - you want to be able
to get in to buy from them. So it is no burden to develop the roads
and to dedicate land for the development of roads. I believe that if
you have a facility that people are going to use you have to supply it
with public utilitiess
Mr. Telep: What is that road on the east, John, is that Seventeenth?
Mr. Dooley: That is Seventeenth
Mr. Telep: Extended south,
Mr. Dooley: Yes.
Mr. Telep: Okay.
Mr. Dooley: It actually goes down here and turns you know, but it
dead ends down here at this point
Mr. Telep: It is in existance now?
Mr. Dooley: It is in existence now yes.
Mr. Billings: Basically, John, you may not Even know yet the way you
are talking there - you are going to start on Twenty-third Avenue and
work east. You are talking about splitting these into sections or maybe
this is something you haven't ironed out yet. Your starting on Twenty-third
Avenue -or Seventeenth Avenue.
Mr. Dooley: I think maybe Twenty-third Avenue is the place where the
major development would occur first.
Marshall Anderson: But you are going to work -from west to east.
Mr. Dooley: Not necessarily, Marsh, I would say in my mind this is
corner
the plar/. The prime outlet that we have already contacted wants this corner
Now it could well be that someone knowing about this would develop here
At this point --there has bean a lot of contact by people who want in here
The one that you know about has already been mentioned in the news but this
would be the prime corner. -But actually at the time of development I dont know
but it is going. The fact is maybe some of you remember when this thtg
started we were anxious to procede as rapidly as we could. The thing has
gone less rapidly than we had anticip=ted in the beginning but this is
not a complaint. It points out we are not dragging our feet here we
want to get going.
Mr. Jelep: John is -that a picture of all three parcels. Could you
identify for the sake of the record which parole is which. Lan you do
that?
Mr. Dooley: I can't - maybe Doug can.
Mr. Sears: This green parcel along the walk here is excluded from
the application - and so is the -pink parr.el
over here. All the other land
within the streets is included. -This land to this green parcel and down
dash
to this/line here - up -to this point across and around the green parcel
is the - up -to this point across and around the pink parcel is the "C"
zone. Parcel "A" is it mot the commercial?
Mr. Telep: That is going from agriculture to commercial is that
correct?
Mr. Sears: Yes sir - from estate to commercial.
Mr. Telep: I will have to check.
Mr. Sears: This one little small -piece here, which is intended for
office building Ilse is the only piece that is being — that "B" zoning is
being requested. -for office tuilding development at this point. The balance
of the land is the transitional zoning "J" zoning along the southern perimeter
of the property.
Mr. Teleo: From "E" Estate to "T" Transitional
Mr. Sears: We filed with the Planning Commission and you should have
a copy of the legal descriptions of the actual plat with the legal descriptions.
Mr. Dooley: I know you have -had complaints about traffic - I think there
is going to te a lot of it there -anyway without -this kind -of planning existing.
The college is going down here and at -the moment Highway 34 when completed
will_be through there. But again we propose to handle it in the most modern
way we can to make it possible for people to get in and out of there comfortably.

Marshall Anderson: If I am looking at that right -it is more of a service road
on the inside -of the right iof—way of the 'property.

Mr. _Dooley: Well I don't think so this is Highway 34 - oh aver here
yes right here - I see what you mean. There will have to be some there
someplace.
Mr. Watson: May _I ask a question the building will na'end up so
the building will now -end up that the parking is in the back and the
parking in the front - did I get that impression?
Mr. Dooley: I think in the middle John.
Mr. Watson: Your service road will be on the front of your parking
lot.
Mr. Sears: Wards for instance wants about a fifty-fifty balance in
the front and the rear and there would still be a service road to the
north end of the parking. There would also be a connector service road
up close to the buildings. Jo carry passengers - packages
Marshall Anderson: Does anyone else have any more questions?
Roy Moser: I represent the Greeley _Christian Church. It is
represented by the pink property on the map. Now I understood that
additional space would be required on Seventeenth Avenue and Twenty-
third Avenue - now where is the beginning of this space - would it take
more of the parking.
Mr. Dooley: We can't take your land Mr. Moser.
Mr. Moser: In other words the additional space you are talking about
additional footage - would be parking so to speak — As I understand it what
has been done there - they have given us a curb and gutter identification
of all of Seventeenth Avenue - you say within a few feet of where the oil
and there would be about twenty feet
stops. It would be as I understand it - for the City or for parking or
whatever you might call it. Now a
Mr. IDooley: Now we have been asked and have agreed to give twenty
feet of additional right -of -way -for Twenty-third Avenue and here -on
Seventeenth Avenue. Now this would accord with - I think your understanding
is - you would have an additional twenty feet along here inside the road
actually
which/would belong to the city but not used for a road for a time. I think
that would be----

Yes.
I think that would be it
In other words when this has been annexed into the City of
Greeley - this pink parcel and where are property line is would probably be
where the desirability of this additional footage would stop.
Mr. Dooley: Well obviously we can not take any of your property away
and for the time being my feeling would be that if an additional twenty
feet were used it would be in to this area. And there would be little
ocassion to have it down here, but I am confident that as time passes
there will be further development down here and a need for more road
along -here at which time your problem would be worked out with the City.
I expect if they own that twenty feet of road they would simply develop
it at that time.
Mr. Moser: I will state it this way - up to what we understand is
our property line there is twenty or twenty-five feet I would say from our
property line to what is now presently oiled cr black -topped there.
Mr. Dooley: I think we are all talking about the same twenty feet
then. But that is a little - the point still is we can't give your property
comply
away and what we want to do is to reply to their request to give them
enough road here to handl-e the traffic as the City sees it necessary.
Mr. Moser:
Our interest was there in future building we -had laid
this cut with the present building there and we were going to come towards
Seventeenth Avenueandwith twenty feet taken off our property we would
have to change our plans.
Mr. Dooley: We are not -going to take it off I promise you that.
And I question if your plans would be changed. I think we are on the
right course sight now. I don't know now if you are worried about it
you had better investigate with the City. At this point I think it was
all wired.
Marshall Anderson: Are there any more questions?

Audience: Well who does the deciding on the dedicating - do the
County Commissioners say or the City Council - say now we want 20 feet
more space on the road for right-of-way.
Mr. Dooley: Well I think -that in connection with this particular
problem the Greeley Planning Commission and the Weld County -Planning
Commission felt that if there was a need for space here - down there
it does not presently exist - but if they felt that if this was to be
developed as we propos-e to develop it that we need additi-onal room for
traffic and they said would you give it? And we said we would. And
we attached it as a condition to the rezoning.
Audience: What happens if you say you don't give it?
Mr. Dooley: The Weld County Planning Commission would say well
fellows I don't know that we are going along with your zoning and I wouldn't
be surprised if the Board of County Commissioners didn't say the same thing.
But you see my point is - we want to give it because we have a use for
people on this area. It is the kind of thing it is real easy for us to
comply with. But I think it is good planning. Now as to if you dont give
it - no. I heard the other day - you may know that the City had not ever
condemned property for streets - I don't know they have the right to. If
they wanted to they could condemn it.
Audience: Well when you come up Twenty-third Avenue from say
the sub station in some places Twenty-third Avenue is real wide and from
there on it will narrow and then it will widen.
Mr. Dooley: Well I am sure they are like everyone else they will
count the cars down there and when it gets so they need more room they
make it.
Audience: Below the city limits, where we are, they are talking
about condeming it or taking twenty feet on each side.
Mr. Dooley: All of these municipal corporations, have pretty big
powers. A lot of times they say, as I am sure the Board of County Commissioners
have, and I believe they have the power to - that if you want something from
us then you better give us something. If you want this kind of zoning
you better make sure there is enough road to handle it. So if you give us
the road yothet your zoning this was the attitude of the Weld County Planning.
Mr. Telep: What is the width of the road?
Mr. Dooley: I think it is sixty feet. They felt it should go to
eighty if not one -hundred.
Mr. Sears: That is the right-of-way. The road is only about
twenty-four or twenty-five feet.
Marshall Anderson: Well Twenty-third Avenue is the section line isn't it?
It would automatically be sixty feet. We are talking eighty feet.
Mr. Dooley: That was my understanding
Mr. Telep: Well it depends - it becomes a real primary road; Of
course we like to think that all roads are primary roads, because if the
planners want it that way - if they want to go to the eighty feet - someday
we may have to go to the eighty feet but like you say Mr. Dooley we would
like to do it in an amicable way. They want something the public wants
something, as opposed to the city the public wants it. You dontt want to
condemn ever if you don't need to.
Mr. Dooley: Exactly, I think too that it doesn't follow, I think
Mr. Moser understand this, at this moment we don't use up the whole right-
of-way it might be years but at least the public owns it so they can develop
it any time they see fit. But we think that this thing is properly supplied
that it is a desirable type of development. We think the property is located
for this kind of development and as a matter of fact it is the kind of thing
we all hoped to have along the freeways. We get such junky stuff along
some of these freeways and we think what is coming in here is the kind of
thing that would be a real asset to that freeway and as the people drive
by they could at least say well we have that corner developed properly.
I think this is a desirable type of thing from everybody's point of view
the community and everyone elses and certainly in my judgement it is the
best use of the land. If anyone has any comments or questions I would be
happy to consider them.

Mr. Meyer: This is just a proposal for rezoning not annexation.
Mr. Dooley: That is right just rezoning. Any annexation to the
City of Greeley would be entirely different step.
Marshall Anderson: Is there any other question.
Mr. Watson: I am on the County Planning Commission and to answer
Mr. Meyers question in a little more detail. He has land to the west
there and he is concerned with what is going to happen to the dedication.
The Planning Commission would look the same to his land as to this land.
We would ask for twenty feet if he ever came in with a request for change
of zone, we would ask the same dedication from him as we ask for from
the Amos Farm. So that the same people on the same property give it
on both side of the road so that the road is the same width all the way
through, probably to the Evans High Street and the same way with
Seventeenth Avenue. That is the City's feeling and the County's feeling.
As the petitioner say it is one of our conditions.

petitioners. We have eight people in favor of the petition. Mr. Chairman
I would like the record to reflect, I am sure with your permission, that
no one present in the room is in opposition to the change of zone.

Mr. Dooley: Mr. Chairman, I would like to say this we appreciate
the citizens, the sometimes irritating care, which has been applied
to this thing. It is troublesome to present these matters to various
Boards. As citizens we appreciate the protection which these Boards
have given the public as to the development. We are certainly are
greatful to you for your permitting us to present this.

RESOLUTION
By The Weld County Planning Commission
February 3, 1969
Whereas, the Weld County Planning Commission has considered rezoning docket # 7 -ia/
concerning the reclassification of property located south of the U.S. Highway 34 by-pass
between 17th Avenue and 23rd Avenue to commercial, business and transitional districts;
Whereas, a letter of recommendation for such rezoning has been received from the Greeley
City Planning Commission;
Whereas, a public hearing was held to ascertain neighborhood and community reaction
with little objection voiced at such hearing;
Whereas, officials representing the Colorado State Highway Department, the Colorado
State College and the Greeley School District have been notified of this proposed
rezoning and apparently find that such reclassification would not be harmful to their
interests; and
Whereas, the applicants have publicly stated that willingness to take certain additional
measures to allow for increased traffic congestion and to prevent unnecessary damage to
abutting properties.
Be it therefore recommended to the board of county commissioners that such rezoning be
approved as requested in application # 1L/ with the additional understanding that the
applicants agree to the following actions:
1. Major construction shall commence on the site within 12mos. or otherwise the
county may take action to rezone the property to its present classification.
2. Within the subject property, 20 ft. of additional right-of-way shall be provided
for 23rd Avenue and for 17th Avenue and 50 ft. radius turns shall be deeded at
the intersections of 17th Avenue and U.S. Highway 34 and at 23rd Avenue and
at U.S. Highway 34.
3. Contractural agreements shall be made with the City of Greeley to provide water
and sewer services which are necessary for the type of development proposed for
this tract.
