HomeMy WebLinkAbout20242465.tiffHEARING CERTIFICATION DOCKET NO. 2024-62 RE: RESUBDIVISION, RES24-0004, OF LOTS 1 THROUGH 8 OF BLOCK 4, AND THAT PART OF VACATED 6TH STREET AND ALLEYS OF THE TOWN OF CARR, AND ASSOCIATED VACATION OF THE SOUTH 40 FEET OF LINCOLN AVENUE RIGHTS -OF -WAY, AND THE WEST 40 FEET OF 5TH STREET RESULTING IN ONE (1) LOT - PATRICK AND ARTA WILLIAMS A public hearing was conducted on September 25, 2024, at 9:00 a.m., with the following present: Commissioner Kevin D. Ross, Chair — EXCUSED Commissioner Perry L. Buck, Pro-Tem Commissioner Mike Freeman Commissioner Scott K. James Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Maxwell Nader The following business was transacted: El I hereby certify that pursuant to a notice dated September 11, 2024, and duly published September 13, 2024, in the Greeley Tribune, a public hearing was conducted to consider the request of Patrick and Arta Williams, for a Resubdivision, RES24-0004, of Lots 1 through 8 of Block 4, and that part of vacated 6th Street and alleys of the Town of Carr, and associated vacation of the south 40 feet of Lincoln Avenue rights -of -way, and the west 40 feet of 5th Street resulting in one (1) lot. Bruce Barker, County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, described the location of the site, and explained per Section 23-5-430, the County will not issue a building permit for any structure located within a historic townsite that enters the setback or offset established for the underlying zone district or extends over lot lines. He explained the size of the eight (8) current lots restrict a dwelling from currently being built, which explains the applicant's desire to combine the eight (8) lots into one, along with vacating the rights -of -way. He stated the new dwelling will be served by a properly permitted well and septic system. He described the sign posting, and relayed questions from one (1) surrounding property owner (SPO) were received. Mr. Nader confirmed the alleyways within Block 4 were vacated, reviewed the Department recommendation, and displayed images of the site and surrounding views. '' In response to Commissioner James, Mr. Nader confirmed the Town of Carr is not incorporated, and responding to Commissioner Freeman, he stated the alleys were vacated in 2015, as well as a couple of streets; however, 5th Street and Lincoln Avenue were not vacated. cc: PL(ER/MN/UA/KR/M$) ►0/2.5/9.H 2024-2465 PL2931 HEARING CERTIFICATION - PATRICK AND ARTA WILLIAMS (RES24-0004) PAGE 2 Brian Church, son-in-law of applicant, described the specifics of improvements made to the property, including building an ADA forever home for the applicants. No public testimony was offered concerning this matter. In response to Chair Pro-Tem Buck, Mr. Church, on behalf of the applicants, indicated they have reviewed, and agreed to abide by, the Conditions of Approval, as presented. fi The Board discussed the Conditions of Approval (COA) and no changes or corrections were made. In response to Commissioner Freeman, Mr. Nader confirmed the access is in the same location. Commissioner James moved to approve the request of Patrick and Arta Williams for Resubdivision, RES24-0004, of Lots 1 through 8 of Block 4, and that part of vacated 6th Street and alleys of the Town of Carr, and associated vacation of the south 40 feet of Lincoln Avenue rights -of -way, and the west 40 feet of 5th Street resulting in one (1) lot, based on the recommendations of Planning staff, with the Conditions of Approval, as presented. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 9:17 a.m. This Certification was approved on the 9th day of October, 2024.
