HomeMy WebLinkAbout20241412.tiffRESOLUTION RE: CALL FOR AN ELECTION TO REFER TO CERTAIN REGISTERED ELECTORS RESIDING IN THE TOWN OF ERIE THE QUESTION OF WHETHER PORTIONS OF THE TOWN OF ERIE IN WHICH THEY RESIDE SHOULD BE ANNEXED INTO THE REGIONAL TRANSPORTATION DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the portions of the Town of Erie (the "Town") located in Boulder County are already included within the boundaries of the Regional Transportation District (RTD), but a large portion of the Town, including downtown Erie, is not included within the boundaries of RTD, and WHEREAS, pursuant to C.R.S. §32-9-106.7, in order to refer the question on annexing all portions of the Town into RTD, the Board of County Commissioners needs to approve a Resolution authorizing an election to be held to refer to certain registered electors residing in the Town of Erie the question of whether the portions of the Town of Erie in which they reside should be annexed into RTD, and WHEREAS, pursuant to Town of Erie Resolution #24-068, a copy of which is attached hereto and incorporated herein as Exhibit "A," the Town has requested that the Board call for such an election, with the subject portion of the Town being more particularly described in the legal description which is attached hereto and incorporated herein as Exhibit "B," and WHEREAS, pursuant to C.R.S. §32-9-106.7(3)(d), RTD is responsible for the cost associated with holding the election on the annexation question. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that pursuant to C.R.S. §32-9-106.7(1.5)(b), the Board hereby calls for an election to be held to refer to certain registered electors residing in the portions of the Town of Erie shown in Exhibit "B" the question of whether those portions should be annexed into RTD.
