DOOLEY LAW OFFICES HOUTCHENS, HOUTCHENS AND DOOLEY WELD COUNTY BANK BUILDING, 1007 NINTH AVENUE GREELEY, COLORADO 80631 November 3, 1964 Board of County Commissioners County of Weld, State of Colorado Greeley, Colorado Gentlemen: TELEPHONE 352-9050 AREA CODE 303 By deed dated March 13, 1944,recorded March 14, 1944; in Book 1129 at Page 160 Weld County Records, Alfred Garton, the then owner of the North Half of Section 9, Township 11 North, Range 62 West, conveyed to Weld County, Colorado, the right to remove all gravel, sand and road' making material from the following described property located in Weld County, Colorado, to -wit: A tract or parcel of land containing three acres located within the boundaries of the North Half (Nz) of Section Nine (9), Township Eleven (11) North, Range Sixty-two (62) West of the 6th P.M. The said deed provides that the said three acre tract should be excluded from assessment for taxes. We represent Mr. Harry B. Gracik and Josephine Gracik of Grover, Colorado, who have recently purchased the West Half of the Northeast Quarter of Section Nine and have applied to the Federal Land Bank for a loan. The Land Bank has made the requirement that Mr. Gracik acquire a release of the instrument recorded in Book 1129 at Page 160 Weld County Records. We are advised that the County of Weld has no immediate need for removal of further road building materials from the three acre tract. We respectively petition that the County release its right to go upon the land and remove gravel and other road building materials or that the County provide for Mr. Gracik a metes and bounds description of the three acres the County claims as being the area from which it is entitled to remove said materials.
