RE: WATER ACTIONS OUTSIDE OF FEDERAL GOVERNMENT ENUMERATED POWERS
(CLERK'S NOTE: Pursuant to the Weld County Home Rule Charter, Article 3, Section 3-13, the concurrence
of three of the members of the Board is required to approve a Resolution. The motion to approve the above
and foregoing, "Resolution Re: Expression of Support for Fully Funding Weld County Sheriffs Office and 19th
Judicial District Attorney's 2024 Request, Immediately per Sheriffs and District Attorney's Request," received
only one affirmative vote of the five Commissioners present, and therefore, failed. The failure to obtain a
majority vote to approve was a denial of the motion and of the Resolution.)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority to
administer the affairs of Weld County, Colorado; and,
WHEREAS, the Board has previously expressed its support for private property rights
which include water rights that are invaluable to our agricultural heritage, and
WHEREAS, Weld County suffers the loss of production when property owners are forced
to defend their property and assert their authority against Federal attempts of property takings by
lawfare, and
WHEREAS, as trustees of the people, the Weld County Commissioners have standing to
ensure that the County complies with the applicable federal, state, and local laws and that the
federal government complies within its enumerated powers, and
WHEREAS, the State of Colorado does not have navigable waters, as defined in
Article III.S2.C1.12 Admiralty and maritime jurisdiction, no federal agency has authority over water
in the state of Colorado, and
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the above and foregoing Resolution received only one (1) affirmative vote
and therefore failed, and the effect of the failure to obtain a majority vote is a denial of the motion.
