Water from this well shall not be used for lawn or landscape irrigation or for any other purpose outside the business building structure. 5) Production from this well is restricted to the Lower Arapahoe aquifer, which corresponds to the interval between 60 feet and 350 feet below the ground surface. Plain casing shall be installed and grouted to prevent production from other zones. 6) The pumping rate of this well shall not exceed 15 GPM. 7) The annual amount of ground water to be withdrawn shall not exceed 0.33 acre-feet (108,600 gallons), as applied for. 8) Approved as the only well on a tract of land of 6.97 acre(s) described as a portion of the NW 1/4, Section 29, Twp. 1 North, Rng. 66 West, 6th P.M., Weld County, reference attached exhibit "A". 9) The return flow from the use of this well must be through an individual waste water disposal system of the type so that not less than 4% of the total amount of water withdrawn is returned to the same stream system in which the well is located. 10) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 11) This well shall be constructed not more than 200 feet from the location specified on this permit. Our goal with this property was to build a commercial building just like the one located at 1760 WCR 27 which was also built by Mr. Shannon several years ago. We have successfully applied for and received ISDS permits and subsequently constructed two approved ISDS's for the property that Mr. Shannon owns next door to this subject property. The subject property has adequate space to comply with all required setbacks and the percolation rates as stated in the attached percolation test, coupled with the design as noted are completely compliant with the requirements of the Weld County Department of Public Health and Environment ISDS Standards. Four and one half years ago around October, 2008 we submitted a Petition for Annexation to the City of Brighton so that we might be able to connect to their water and sewer system. After an extremely thorough investigation, countless meetings with City Planners and in depth reviews of their IDS requirements we have come to realization that Annexing into the City of Brighton would yield the property worthless. This subject property is so narrow that being forced to dedicate huge setbacks, beyond what we have already dedicated to Weld County when we obtained the original USR would make the property so narrow that Mr. Shannon wouldn't be able to utilize the property at all for the approved use under the existing said USR. Permit fees are non-refundable; permit applications are non -transferable. If both a building permit and an ISDS are issued for the same property and construction is not commenced prior to the expiration date of the building permit, the ISDS permit shall expire at the same time as the building permit. On Friday, 10/4/13, we received the email below (in italics) from the property owner's representative, Larry Carroll requesting an appeal to the Board of County Commissioners of the Board of Health's decision to deny the variance to install the septic system. We are requesting your input and comments on Mr. Carroll's email regarding negotiating annexation with Brighton. Thank you, Mary Good Afternoon, I am representing a client, KS Enterprises II - Ken Shannon, that has property in the Brighton expansion area and has been attempting to meet Brighton's annexation requirements that are not static. He has approved property in Weld County and a well permit approved by the State of Colorado and is requesting a 1SDS for his parcel. Because of Brighton's proximity, he has been told that he must annex into Brighton for City Services. After 4+ years he has not been able to create an agreement and is now looking for a solution to stay in Weld County. After the Health Department Hearing, my client did return to negotiate with Brighton and thought that progress was being made. At the last minute, Brighton required a non-contiguous site that my client has interest in to be included in the annexation and stopped the negotiations - losing another 80 days! 2 r My client is asking to be heard by the Weld County Commissioners and request a reversal of the Health Department's Denial for the request for an ISDS system. Our goal with this property was to build a commercial building just like the one located at 1760 WCR 27 which was also built by Mr. Shannon several years ago. We have successfully applied for and received ISDS permits and subsequently constructed two approved ISDS's for the property that Mr. Shannon owns next door to this subject property. Today we are asking for a variance from Section 30-2-20-G-3 of the Weld County Septic Regulations for the following reasons. The subject property has adequate space to comply with all required setbacks and the percolation rates as stated in the attached percolation test, coupled with the design as noted are completely compliant with the requirements of the Weld County Department of Public Health and Environment ISDS Standards along with all of the provisions of Section 25-10-107 of the Individual Sewage Disposal Systems Act. Four and one half years ago around October, 2008 we submitted a Petition for Annexation to the City of Brighton so that we might be able to connect to their water and sewer system. After an extremely thorough investigation, countless meetings with City Planners and in depth reviews of their IDS requirements we have come to realization that Annexing into the City of Brighton would yield the property worthless. The hardship comes from the fact that this subject property is so narrow that being forced to dedicate additional setbacks, beyond what we have already dedicated to Weld County when we obtained the original USR would make the property so narrow that Mr. Shannon wouldn't be able to utilize the property at all for the approved use under the existing said USR. Therefore after exhausting all options to become Annexed into the City of Brighton, we simply asked them if we could keep our unincorporated Weld County status and still connect to the City water and sewer. The answer was a very clear, "No". Please refer to the attached email from the City of Brighton. After that firm answer from the City of Brighton, we had applied for and obtained a well permit from the State of Colorado. Please refer to the attached well permit #290695. Please also note that the State is requiring for us to use an individual waste water disposal system, (item #9). In order for this property to be used to its fullest and best potential, septic system permits from Department of Public Health and Environment would be required. Four and one half years ago around October, 2008 we submitted a Petition for Annexation to the City of Brighton so that we might be able to connect to their water and sewer system. After an extremely thorough investigation, countless meetings with City Planners and in depth reviews of their IDS requirements we have come to realization that Annexing into the City of Brighton would yield the property worthless. No limiting layer was discovered to a depth of 8 feet. The system will be designed for 8 full time office employees and up to 10 visitors per day. The absorption bed components are required per County Code to be within 36" of final grade.
