Lewis, Rt. 1, Box 209, LaSalle, Colorado, requesting a change of zone from "E" Estates District, to 'TB" Business District, and WHEREAS, the petitioner was not present, and WHEREAS, there was no one present in opposition to the change of zone, and WHEREAS, the Board of County Commissioners has studied the re- quest of the petitioner and studied the recommendation of the Weld County Planning Commission as submitted on July 31, 1968, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS, that the petition of David M. Lewis, Rt. 1, Box 209, La Salle, Colorado, for change of zone from "E" Estates District to "B" Business District, said area being more particularly described as follows: The south 170 feet of the north 470 feet of the west 1320 feet of Section Twenty-three (23), Township Five (5) North, Range Sixty-six (66) West of the 6th P. M. , Weld County, Colorado, containing 5.16 acres, more or less, is hereby granted under the conditions following: 1. Any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. All applicable subdivision regulations and zoning regulations shall be followed and complied with to the satisfaction of the Board of County Com- missioners of Weld County, Colorado. Mr. Telep: Thank you Mr. Chairman, This is a hearing for a change of zone at the request of the petitioner David M. Lewis, Route 1 Box 209, La Salle, Colorado, The request for change of zone is from "E" Estate to "B" Business District on the following described property; the South 170 feet of of the North 470 feet of the west 1320 feet of Section 23, Township 5 North, Range 66 West of the 6th P. M., Weld County, Colorado, containing 5.16 acres more or less. This meeting was called to order, on Monday, September 16th at the hour of 10:30 A. M. The notice of hearing was duly published as required by law and the property to be rezoned has been recited by the County Attorney and we would like the record to further show that the petitioner, David M. Lewis, who is not present at the hearing nor was he represented by anyone at this hearing. Let the record further show that no one was present in opposition to the petition to the change of zone. Let the record further show that there is on file with the Board of County Commissioners a recommendation from the Weld County Planning Commission dated July 31, 1968, whereby the Planning Commission recommended this area David Lewis Change of Zone 2 - the change of zone in this area for the reason that this area be zoned "B" and it should be changed to its orginal condition before Highway 34 was constructed. Taking the 130 feet and leaving the balance of 170 feet, and this is the area that is involved at the present time, the 5.16 acres more or less contiguous to U. S. 34 By-pass right of way. Mr. Harold Andersen: You have heard the reqest for the change of zone on this area - what is the Board's pleasure? Mr. Dunbar: I move that we take this hearing under advisement.
