HomeMy WebLinkAbout690267.tiffRESOLUTION WHEREAS, the Colorado Department of Highways has requested permission to locate a gravel pit operation on the following described property, to -wit: A tract of land located in the Southeast Quarter (SE+) of Section Four (4), Township Two (2) North, Range Sixty- eight (68) West of the 6th P.M., Weld County, Colorado, and WHEREAS, the said requested gravel pit operation is in an agricultural zone, as set forth by the Planning Commission of Weld County, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commission and the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission has recom- mended that this business operation be approved by a Resolution dated September 16, 1969. A building permit was issued in 1968 for this property. Survey showed 150' and 2 acres. Peterson owned this property to the south. Permit was issued showing 180' front— age and department was assured this would be taken care of. CAPRON DISTRICT ENGINEER The Colorado Division of Highways hereby requests approval of the Weld County Planning Commission to open a gravel pit with the material being used in the construction project, between Boulder - Weld County Line and 125 (Del Camino Restaurant) on S.H. 119. The Pit is located on property owned by, Richard Hamm of Longmont, Colo., lying in the S.F. 4, of Section 4., T. 2 N., R. 68 W., in Weld County, Colo. The proposed pit is in an agriculture zone at present, in which it may be used for a gravel pit. This would be the nearest to the proposed project that we are able to obtain. It is estimated that approximately 100,000 Cu. Yds. of material will be removed from this pit. It is anticipated that the material will be removed sometime this winter providing weather permits, if not, it will go into the Spring of 1970. This proposed pit is located in the river bottom, with weeds and grass growing presently. It is sometimes used for pastureland, with limited use. Any banks will be sloped to a 2:1 slope, and the stripping of top soil will be replaced over some slopes and the stockpile area to promote growth. Pit and Pit area will be left in a neat condition, a 4 strand barbed wire fence will be installed on the West and South sides, so as to completely enclose the pit area, for the protection of any livestock, for any possible future use. All Asphalt and Asphalt mix will be completely removed from owners property. There will be no stagnant water remaining in Pit, due to the porous sand and gravel, water will continually move through it. There are no existing houses, or ditches, roads on this property, to the North lies the St. Vrain River, to the East across the Gravel County road, there is a small commercial gravel pit operation. Other than that, this gravel operation should have no effect on adjacent properties. Danforth Jr. file r• • April 23, 1968 WATER AND AIR POLLUTION In accordance with the requirements pertaining to "Legal Relations and Responsibility to Public" set forth in Section 107 of the Standard Specifications, the Contractor's attention is directed to the "Water Pollution Control Act" and the "Air Pollution Control Act," Chapters 44 and 45 respectively of the Session Laws of Colorado, 1966, as amended. Throughout the life of this project he will be required to comply with these acts and to the following additional requirements in connection therewith: The Contractor shall exercise every reasonable precaution to prevent, abate and control pollution of public or private waters. He shall also conduct his operations in such manner as to prevent or to minimize silta- tion of public or private waters and to avoid interference with the habitat or movement of fish. Should preventive measures fail and an appreciable amount of material begins to erode into a river, stream or impoundment, the Contractor shall act immediately to bring the siltation under control. Where there is a high potential for erosion and subsequent water pollution, the area of erodable land that may be exposed by construction operations at any one time shall be held to a minimum as determined by the Engineer, and the duration of the exposure of the uncompleted construction to the elements shall be as short as practicable. Erosion control features shall be constructed concurrently with other work and at the earliest practicable time. Excavation from the roadway, channel changes, cofferdams, etc., shall not be deposited in or so near to rivers, streams or impoundments that it will be washed away by high water or runoff. Frequent fording of live streams with construction equipment will not be permitted. Temporary bridges or other structures shall be used wherever an appreciable number of stream crossings are necessary. Unless otherwise approved in writing by the Engineer, mechanized equipment shall not be operated in live streams except as may be required to construct channel changes and structures. Rivers, streams and impoundments shall be promptly cleared of all falsework, piling, debris, or other obstructions placed therein or caused by the construction operations. Disturbance of lands and of waters that are outside the limits of the construction as staked is prohibited, except as may be found necessary and ordered by the Engineer. The Contractor shall use all available practical methods to reduce, prevent and control the emission of air contaminants. The Contractor is required to apply to the appropriate authority enforcing air pollution control standards for a burning permit before burning any flammable materials. Said authority may grant or deny a burning permit based on conditions as outlined in Section 5, Paragraph (4)(a) of the "Air Pollution Control Act" referred to above. If burning is not permitted the Contractor will be required to dispose of such materials in a manner to be approved by the Engineer.
