HomeMy WebLinkAbout650204.tiff56' ) Office Form 29-A .July 29 1965 (County) of Page 1 PROJECT NUMBER CO 03-O004-00 STANDARD AGREEMENT FOR HIGHWAY FLOOD DISASTER RELIEF REPAIR WORK BY COUNTIES THIS AGREEMENT, made and entered into this day 1965, by and between THE STATE HIGHWAY COMMISSION OF COLORADO, a Public the "State", and the County of Colorado, acting by the Chairman hereinafter called the "County", Corporation, hereinafter called WELD , State of of its Board of County Commissioners, witnesseth that: WHEREAS, Public Highways of said County were destroyed or damaged by the flood disaster which occurred during the period of June 14 through July 13, inclusive, 1965, and WHEREAS, it is the desire of the State and the said County to enter into an Agreement concerning Highway flood disaster relief repair work, pursuant to and by virtue of the authority granted in Section 4, Subsection (3)(a) of House Bill No. 1002 of the First Extraordinary Session of the 45th General Assembly of the State of Colorado (1965); NOW, THEREFORE, in consideration of the mutual promises and agreements herein contained, the parties do hereby agree as follows: 1. That the said County, under and by virtue of this agreement and with the understanding that all rights -of -way required are to be acquired by the County, is hereby authorized to proceed upon the following terms, to repair and/or reconstruct portions of - or be reimbursed for expense incurred prior to date of this Agreement, for repairing and/or reconstructing portions of flood damaged streets and/or highways located in the County of WELD as more particularly described below, at such locations as shall be mutually agreed upon by the representatives of the Department of Highways and the Board of County Commissioners, and designated as Project Number CO 03-0004-00 Description of Proposed Work: (Detailed description is shown on attached sheets.) The County agrees to furnish all labor Foreman $420.00 which will show the at the following rates: Skilled Labor *x0.00 Semi -skilled Labor 33005,00 Unskilled Labor $1.70 or month II II XMXXXXXXXXX " Pk. It is expressly understood that the above rates include the use of all small tools, camp equipment, and such incidentals as are necessary for the reasonable, economical, and efficient prosecutijn of the work. Expenditure of funds under this agreement shall be made for the rental of County -owned equipment, including cost for gas - oil - grease, and necessary supplies. Daily depreciation rates for County -owned construction equipment will comply with rates published in the current issue of the "Colorado Department of Highways Cost Accounting Manual". Rental rates for construction equipment obtained from other sources shall not exceed rates established by the current issue of the "Construction Manual Equipment Rental Rates, Colorado Department of Highways". 5. The County may make purchases of necessary construction materials. Reimbursement for construction materials so purchased will be made by the State upon the receipt of paid invoices certified by authorized County representatives and approved by the State District Engineer or his authorized representative. 6. It is understood that the work is to be under the direction of a general road supervisor, on behalf of the County, whose salary is to be included in the reimbursement by the State, who is to give the work the same attention and direction that is ordinarily given by a contractor to any job he has contracted. The work may be dune by contract or by County forces, at the option of the County. 7. Executive Order by Governor John A. Love, dated July 16, 1063: Every State contract for public works or for goods or services in connection with the performance of work under this contract, the contractor agrees as follows: (a) The contractor will not discriminate against any employee or applicant for employment because of race, creed, color, or national origin. The contractor will take affirmative action to ensure that applicants are employed, and that employees are treated during employment, without regard to their race, creed, color, or national origin. Such action shall include, but not be limited to, the following: employment, upgrading, demotion or transfers; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. (b) The contractor will require a similar agreement with any subcontractor. 8. Labor time is to be kept by the hour, and it is further understood that the County time -books covering this work are subject to checking at any time by the Department of Highways. 9. It is understood that this work shall be vigorously prosecuted and every effort made to complete the same during the field season of 1966, or earlier. Office Form 29-P. Invoices on County Statement form must be submitted in triplicate to the District Engineer, who will forward two copies to Denver office showing the extent to which he approves the billing. The rates on invoices must conform to those on the original or supplemental agreement. Items must be detailed as to description, quantity, rate and amount. Purchased items not fully consumed on the project will be charged only in the percentage actually used on the project, which percentage must be shown. 11. The County shall be paid ninety percent on monthly statements approved by the District Engineer, until the total amount of payments by the State on this project, including such payments as it may make direct, shall equal ninety percent of the total amount of actual approved expenditure. Maximum payment will be limited to ninety percent of the amount shown in paragraph 12 of this agree- ment. Provided sufficient funds become available from the highway flood disaster relief fund as provided by House Bill No. 1002, additional payments for approved work completed will be made up to the total amount shown in paragraph 12 of this agreement. 12. It is further understood that the allotment for this work from State Funds is: SIX Tsswnss ONE HUNDRED AND TWENTY Dollars ($ 6,120.00 ). The total expenditure on this work, including engineering and inspection, is limited to the above amount. This Agreement shall not be deemed valid until it shall have been approved by the Controller of the State of Colorado, or such assistant as he may designate.
