FINDINGS AND RESOLUTION
CONCERNING CHANGE OF ZONE
PETITION OF DAVID K NAUS, JR.
The petition of Dave Knaus, Jr. , Rt. 2, Box 166, Greeley,
Colorado, requesting a change of zone from "E" Estates District to
"M -H" Mobile Home District of a tract of land located in the North
Half of the Northeast Quarter (NINE -14) of Section Eight (8), Township
Five (5) North, Range Sixty-six (66) West of the 6th P. M. , Weld County,
Colorado, containing 11. 5 acres more or less, for a proposed trailer
court, came on for hearing on Wednesday, April 17, 1968, and the
Board of County Commissioners of the County of Weld having heard
the testimony and evidence adduced upon said hearing, and having con-
sidered the testimony, evidence, and the recommendations of the Weld
County Planning Commission filed with said Board, and having care-
fully weighed the same, now makes the following findings:
1. The evidence discloses that the applicants failed to sustain
the burden of proof as to the need for a change of zone or that the pre-
sent zone is erroneous or that circumstances warrant a change of zone
at this time.
2. The evidence shows that the inhabitants of the immediate
vicinity of the area sought to be rezoned are unanimously opposed to
the change of zone.
3. That each of the preceding findings in and of themselves
and independent of each other constitutes a separate and individual
ground for denial of the change of zone.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County
of Weld has heard the application of Dave Knaus, Jr. , Rt. 2, Box 166,
Greeley, Colorado, for a change of zone from "E" Estates District to
"M -H" Mobile Home District, of a tract of land for a proposed trailer
court, said area being more particularly described as follows:
A tract of land located in the North Half of the
Northeast Quarter (N -NE-) of Section Eight (8), Town-
ship Five (5) North, Range Sixty-six (66) West of the
Sixth Principal Meridian, Weld County, Colorado, con-
taining 11.5 acres, more or less; and
WHEREAS, said Board has made its findings on the evidence and
testimony submitted to it, which findings precede this resolution and by re-
ference are incorporated herein and made a part hereof, and
WHEREAS, the said Board has carefully considered the petition,
evidence and testimony and the recommendation of the Weld County Planning
Commission, and given the same such weight as it in its discretion deems
proper, and is now fully advised in the premises;
NOW, THEREFORE, BE IT RESOLVED, that the petition of Dave
Knaus, Jr. , Rt. 2, Box 166, Greeley, Colorado, requesting a change of
zone from "E" Estates District to "M -H" Mobile Home District to locate a
trailer court on the land indicated above be, and it hereby is denied
upon each of the grounds set forth in the Board's findings therein.

FINDINGS AND RESOLUTION
CONCERNING RETAIL PACKAGE LIQUOR STORE
LICENSE OF THE RURAL ENTERTAINMENT CENTER,
INCORPORATED, DBA R. E. C. LANES
OF HEREFORD, COLORADO
The application of the Rural Entertainment Center, Incorporated,
dba R. E. C. Lanes of Hereford, Colorado, for a retail package liquor store
license came on for hearing April 24, 1968, at 2:00 o'clock P. M. , and the
Board of County Commissioners of the County of Weld having heard the tes-
timony and evidence adduced upon said hearing and having considered the tes-
timony, evidence, petitions and remonstrances filed with said Board and having
carefully weighed the same, now makes the following findings:
1. The evidence discloses that the applicant is the owner and occupant
of said premises sought to be licensed within the meaning of the statutes.
2. The applicant has proven a prima facie case as to the reasonable
requirements of the neighborhood.
3. The evidence presented by the petitioner in its hearing before the
Board of County Commissioners established that there is no liquor outlet of the
classification sought by this application within a radius of several miles, and,
further, established that there is substantial local support for the granting of
the application which is the subject of this hearing.
4. The desires and needs of the inhabitants of the immediate neighbor-
hood, as well as the needs of the traveling public and transients, are not ful-
filled inasmuch as there presently is no liquor outlet in the area designated as
the neighborhood.
5. Under decisions by the Supreme Court of Colorado, notably,
Cloverleaf v. Commissioners, 136 Colo. 441, 319 P. 2d 487; KBT Corporation
v. Walker, 148 Colo. 274, 365 P. 2d 685; Commissioners v. Bickel, 395 P.2d
208; Farmer v. City Council of the City of Wray, 385 P. 2d 596, the applicant
established a prima facie case entitling it to the license applied for, and that
no evidence adequately rebutting the applicant's prima facie case was presented
by the protestants. In such a situation, the Board is compelled to follow the
legal principles set forth in the cases cited above and, pursuant thereto, finds
that the petitioner's application for a package liquor store license should be
granted.
RESOLUT ION
