Kluver BE IT RESOLVED, that the Board of County Commissioners of Weld County, Colorado, sign a Quit Claim Deed reverting all of their right, title and interest in and to an easement removing all gravel, sand, road making and building material acquired by instrument dated December 15, 1955 and re orded in the records of the Weld County Clerk and Recorder on December 29, 1955 in Book 1438, Page 314 more particularly described as follows: • A plat of land 200 feet square .918 part of an acre located in the SW4 of Section 9, Township 7 North, Range 67 West of the 6th P. M. M. Weld County, Colorado, and WHEREAS, the said requested gravel pit operation is in an agri- cultural zone as set forth by the Planning Commission of Weld County, and WHEREAS, according to Section 3. 3 (8) and Section 6. 1 (3) of the Zoning Resolution of Weld County, said gravel pit operation may be authorized upon the approval of the Weld County Planning Commis Sion and the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission has recommended that this business operation be approved by a Resolution dated March 25, 1968. NOW, THEREFORE, BE IT RESOLVED, that the Colorado Department of Highways is hereby authorized to operate a gravel pit on the following described property, to -wit: A tract of land containing 20 acres more or less located in the Southwest Quarter (SW4) of Section Seven (7), Township Two (2) North, Range Sixty-eight (68) West of the 6th P. WARBERG BE IT RESOLVED, that the Board of County Commissioners of Weld County, Colorado, sign a Quit Claim Deed reverting all of their right, title and interest in and to an easement removing all gravel, sand, road making and building material acquired by instrument dated January 25, 1937 and recorded in the records of the Weld County Clerk and Recorder on February 20, 1937 in Book 1005, Page 619, on a parcel of land more particularly described as follows: A tract of about three acres of land (irregular in shape), lying west of the Union Pacific Railroad Company's right of way and the center of said tract being about 1500 feet south and 1200 feet east of the Northwest corner of Section 7, Township 2 North, Range 67 West of the 6th P. M. My commission axpires�,�� `�' / / 6 • N NARY PUBLIC RESOLUTION WHEREAS, the County Commissioners of the County of Weld, State of Colorado, has heretofore, by joint resolution with the City of Greeley, established the Weld County Municipal Airport, and WHEREAS, provision was made therein for the appointment of a seven -man airport board to operate said airport and providing for the appointment and term of office of each member thereof, and WHEREAS, it is now desirous and in the best interests of Weld County to have one of its county commissioners serve as a member of said airport board, and WHEREAS, the City of Greeley has agreed that both the county and the city shall have an additional member on said airport board. r 96 NOW, THEREFORE, BE IT RESOLVED, that from date hereof, and until further order of the board, the County of Weld shall have an additional member on said airport board and that such member shall be one of the county commissioners and that he shall be selected in a manner that may be determined by the Board of County Commissioners; and that term shall be from January 1 through December 31 of each year. The following resolutions were presented: 115 LEASE AGREEMENT THIS INDENTURE made this 8th day of May , 1968, by and between WELD COUNTY, A POLITICAL SUBDIVISION OF THE STATE OF COLORADO, BY THE BOARD OF COUNTY COMMISSIONERS FOR ITS RESPECTIVE INTERESTS, the Lessor, and the CITY OF GREELEY, A MUNICIPAL CORPORATION, the Lessee, WITNESSETH: WHEREAS, the Lessor owns that certain real estate hereinafter described, and, WHEREAS, there has been in existence on a part of said real estate, certain parking area forelected County officials, their deputies, certain judicial officials, and other employees of the County of Weld, and WHEREAS, the Lessor has no legal means of policing the parking area which heretofore had been established, and WHEREAS, the City is in need of additional municipal parking area, and WHEREAS, there is no other property available in the vicinity of the County Courthouse for parking spaces, and WHEREAS, this agreement will be mutually beneficial to both parties concerning parking in the area. NOW THEREFORE, in consideration of mutual promises, covenants, and agreements herein contained, the Lessor hereby leases unto the Lessee, the following premises, situate in the County of Weld, State of Colorado, to -wit: Parcel No. 1. Lots 19 and 20 and the West 44' of Lot 21, together with the East 6' of the North 62' of said Lot 21, and all in Block 65, in the City of Greeley; subject to right of way for alley purposes over and across the East 6' of the North 62' of said Lot 21, if any. Parcel No. 2. That strip of ground approximately 12' wide lying north of and adjacent to the north line of the east -west alley from the west line of the side walk, thence West to the West side of the Court House. Parcel No. 3. A strip of land located in Lots 1-10, in Block 65; specifically that area between the west wall of the Court House and up to within approximately six feet of the east side of the jail. Parcel No. 4. Lots 15 and 16 and approximately the west half of Lot 14 Block 65, all west of the County buildings on said Block 65. To have and to hold same from the 8th day of May , 1968, for a term of one year to be automatically renewed from year to year unless 1 either of the parties serves a written notice sixty (60) days before the termination of the year term notifying cancellation of this lease and agreement. It is mutually understood and agreed as follows: 1. That County and Judicial officials and their employees that are so designated by the Lessor shall be the only persons using parking spaces on Parcel No. 2 and Parcel No. 3. 2. That Parcel No. 1 and Parcel No. 4 shall be used for public park- ing under the rules and regulations and ordinances of the City of Greeley except that the City shall issue 74 parking stickers to the County and the County shall authorize County and Judicial officials and their employees to use said stickers for parking on Parcel No. 1 and Parcel No. 4. 3. That Lessee shall at its own expense police all the areas designated in this agreement and do all things necessary to prohibit unauthorized per- sons from parking in the areas designated herein. 4. That in addition to the areas designated herein the sticker holders under this agreement may park in the adjacent Municipal Parking Lot in Block 65, =City of Greeley. 5. That the Lessor shall perform and do any maintenance work that is needed on any of the areas leased under this agreement. 6. That Lessee agrees to operate and maintain the areas herein leased in the same or similar manner as it operates and maintains the other exist- ing municipal parking lots located within the City of Greeley. 7. That Lessor shall not participate in any of the fines assessed for over -parking in any of said areas nor in any of the expense for policeing or enforcing the regulations and ordinances governing the operation of said parking lots. S. That Lessee shall not assign this lease or any of its interests herein. LANES OF HEREFORD, COLORADO The application of the Rural Entertainment Center, Incorporated, dba R. E. C. Lanes of Hereford, Colorado, for a retail package liquor store license came on for hearing April 24, 1968, at 2:00 o'clock P. M. , and the Board of County Commissioners of the County of Weld having heard the tes- timony and evidence adduced upon said hearing and having considered the tes- timony, evidence, petitions and remonstrances filed with said Board and having carefully weighed the same, now makes the following findings: 1. The evidence discloses that the applicant is the owner and occupant of said premises sought to be licensed within the meaning of the statutes. 2. The applicant has proven a prima facie case as to the reasonable requirements of the neighborhood. 3. The evidence presented by the petitioner in its hearing before the Board of County Commissioners established that there is no liquor outlet of the classification sought by this application within a radius of several miles, and, further, established that there is substantial local support for the granting of the application which is the subject of this hearing. 4. The desires and needs of the inhabitants of the immediate neighbor- hood, as well as the needs of the traveling public and transients, are not ful- filled inasmuch as there presently is no liquor outlet in the area designated as the neighborhood. 5. Under decisions by the Supreme Court of Colorado, notably, Cloverleaf v. Commissioners, 136 Colo. 441, 319 P. 2d 487; KBT Corporation v. Walker, 148 Colo. 274, 365 P. 2d 685; Commissioners v. Bickel, 395 P.2d 208; Farmer v. City Council of the City of Wray, 385 P. 2d 596, the applicant established a prima facie case entitling it to the license applied for, and that no evidence adequately rebutting the applicant's prima facie case was presented by the protestants. In such a situation, the Board is compelled to follow the legal principles set forth in the cases cited above and, pursuant thereto, finds that the petitioner's application for a package liquor store license should be granted. WHEREAS, the Board of County Commissioners of Weld County, State of Colorado, has long been concerned with the danger- ous nature and use of fireworks in Weld County, and WHEREAS, the Board recognizes the need to license and regulate the sale and use of fireworks in Weld County, and WHEREAS, because of the dangerous nature of permitted fireworks and the legal uses thereof under the law. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners of Weld County hereby authorizes the issu- ance of licenses to sell fireworks in Weld County under the conditions following: 1.
