WHEREAS, a public hearing was held on Monday, April 5, 1965,
at 2:00 P.M. in the District Court Room, Greeley, Colorado for the
purpose of hearing the petition of KENNETH W. PRATER of 750 Peoria,
Aurora, Colorado, requesting a change of zone in the West Greeley
Area to "B" business zone, and,
WHEREAS, the Planning Commission Board heard from Mr. Kenneth
W. Prater that the reason for the change of zone was to construct a
shopping center on the property west of the Gibson Discount Center
on property being purchased from C. 0. Plumb, and,
WHEREAS, at the hearing, Mr. Glen Paul, representing the Weld
County Health Department, inquired about water and sewer facilities
for the area, and,
WHEREAS, the Commission took the request for change of zoning
under advisement until April 23, 1965, and,
WHEREAS, the Commission has now had time to fully examine and
consider the petition of Kenneth W. Prater.
NOW, THEREFORE, be it resolved by The Weld County Planning
Commission that the petition of Kenneth W. Prater for change of
zone be denied for the following reasons:
(1) That the request for change of zone is premature
at this time and does not make the best use of the property.
(2) That the area must be served by an adequate water
supply and proper sewage disposal as a health factor, and that said
facilities are not now available to said property owner.
(3) That the area in question is presently over zoned,
and there are adequate business areas within the area not yet
utilized for business.
(4) That no assurance has been given the Planning Commission

that the sale of liquor will not be permitted in the center, and
that if the sale of liquor is permitted, it will retard the growth
of the City of Greeley to the west.
(5) That it is not good planning to have shopping centers
closer than two miles within a given general area of population
growth.
(6) That the continuation of string zoning along
Highway 34 is detrimental to the planned growth of the community
with the knowledge of the No. 34 By-pass to be constructed in the
near future.
FURTHER, be it resolved that the action of The Planning
Commission Board is a recommendation that the petition of Kenneth
W. Prater be denied.

APRIL 23, 1965
A special meeting of the Weld County Planning Commission was held on Friday, Ap-
ril 23, 1965, at the Ebony Room of the American Legion, Greeley, Colorado. The
meeting was called to order by the Chairman, George Mosier, with John Watson,
Price Hopkins, Elmer Shultz, Ed Dunbar, Tom Richardson and Roland Palmquist pre-
sent. Absent: A. A. Tinn. Mr. Leonard Bartels was a guest at the meeting.
George Mosier stated that in the Minutes of February 1st in the Resolution for
Recommendation for Change of Zone from "E" Estate District to "R". Residential.
District to the Board of County Commissioners, it was given as Highiand Park and
should have been Highland Hills.
George Mosier stated the reason for the special meeting was so discuss 'the re-
quest of Kenneth Prater for a change of zone in the West Greeley Area, from an
q" Estate District to a "B" Business District.
The area being consider for change of zone is that part of the West Half (W 1/2)
of the Southeast Quarter (SE 1/4) of Section 2, Township 5 North, Range &A West
of the 6th P. M., Weld County, Colorado, more particularly described as follows:
Beginning at the Southeast Corner of Section 2, Township 5 North, Range 66 West;
Thence West following Highway 34 to the Southeast Corner of the West Half (W,1/2)
of the Southeast Quarter (SE 1/4) of said Section 2, a distance of 1435.21 feet
more or less to the true point of beginning; Thence North 01°18'00" .East along
the East line of the West Half (W 1/2) of the Southeast Quarter (SE 1/4) of said
section 2 a distance of 485 feet more or less to the center of West 9th Street;
) Thence West along the center line of the proposed West 9th Street extended, 640
y feet more or less to a point; Thence South O1°18'00"West to the South line of the
IWest Half (W 1/2) of the Southeast Quarter (SE 1/4); Thence North 83°52'30" East
along the South line of the West Half (W 1/2) of the Southeast Quarter (SE 1/4)
of said Section 2, Township 5 North, Range 66 West to the point of beginning.
S Said parcel of ground consists of 7 1/2 acres more or less.
Mr. Mosier said that last week he and John Watson had a meeting with Mr. Prater,
Mr. Clarkson and Mr. Sol Dichter. He said Mr. Prater was a real estate man and
had been associated with Temple Buell. George Mosier told about the letter from
the City that water and sewer was available.
Mr. Bartels said at the City Planning Commission meeting there had been a recom-
mendation to the County Planning Commission that the Request for Change of Zone
by Mr. Prater be not recommended, but the minutes stated just opposite and the
minutes would be corrected at their next meeting.
George Mosier said the letter from Mr. Ben Cruce said Water and Sewer would rot be
available until they had annexed.
It was understood that in the Contract for Purchase between Mr. Plumband Mr. Pra-
ter, Mr. Prater had agreed he would not annex this property into the Citytof Gree
ley.
