HomeMy WebLinkAbout750437.tiff RESOLUTION WHEREAS, a public hearing was held on February 7, 1975, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of School District RE-4, Box 609, Windsor, Colorado, by Jack Hale, Superintendent of Schools, seeking a conditional use permit to house school district administrative offices on the following described property, to-wit: All of Lots 1, 3, 5, 7 and 9, in Block 1, Ault's Addition to the Town of Windsor, Weld County, Colorado, and WHEREAS, the petitioner was present and represented by Jack Hale, Superintendent of Schools of School District RE-4, Windsor, Colorado, and WHEREAS, there was no opposition to the request of petitioner for the use of the said building as school district administrative offices, and WHEREAS, the said requested use of the said building for the school district administrative offices, Windsor, Colorado, is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (d) of the Zoning Resolution of Weld County, said location for said school district administrative offices may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners, that the application of School District RE-4, Box 609, Windsor, Colorado, c/o Jack Hale, Superintendent of Schools for said district, for a con- ditional use permit to locate school district administrative offices on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Is requesting a conditional use permit in order to continue using the building for this purpose. Weld County Planning staff recommends approval of this request for the following reasons: (1 ) It complies with the Comprehensive Plan of Weld County inasmuch as the activity will occur in the Windsor Comprehensive Plan area; (2) it complies with the Weld County Zoning Resolution; (3) Windsor recommends approval ; and (4) the County Health Department recommends approval , subject to an agreement being reached with the State Highway Dept. regardinga;cess onto Highway 392. Mr. Honn stated that he has talked with Jack Hale, Superintendent, and was informed that Mr. Hale is in the process of working out an access agreement with the State Highway Department. It was requested by the Planning staff that this agreement be received by the Planning Office prior to this request for conditional use permit being presented to the Board of County Commissioners. There was some confusion as to whether this office is on the city sewer system or if it has a septic tank. It does have a septic tank. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of this conditional use permit subject to recommendations by the Planning staff. Motion, by Mr. Anderson, seconded, Marge Yost. A vote of "Aye" by Mr. Nix, Mr. Anderson, Mrs. Yost, Mr. Rothe, and Mr. Elliott. Motion Carried. Ni N% Sec. 13 Tl R68 APPEARANCE: Mr. Haley DISCUSSION: Mr. Haley stated that he purchased the property with the intent of raising greyhounds. Henry Johnson is the only neighbor who is located near Mr. Haley, but he has signed the petition to grant this request. The Weld County Planning staff recommends approval for the following reasons: (1 ) Complies with the Weld County Comprehensive Plan in that it does not adversely affect agricultural interests; (2) complies with the Weld County Zoning Resolution; (3) Town of Dacona approves; and (4) County Health Dept. recommends approval . Subject to: (1 ) Con- struction beginning within one years time of the Board of County Commissioners' approval ; (2) the permit to be issued to Mr. Howard Haley and that said permit will terminate at such time as Mr. Haley or his immediate family are no longer the operators of said kennel , and (3) maximum number of dogs to be no more than 40 dogs at any one time. RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Planning staff recommendations. Motion by Marge Yost, seconded by Mr. Anderson. A vote of "Aye" by Mr. Nix, Mr. Anderson, Mrs. Yost, Mr. Rothe, and Mr. Elliott. Motion Carried. In general, the increased subdivision of land neces- sitates increased approaches onto the servicing highway and the increased development of the land adds to the traffic volumes. These factors, in addition to others, down-grade the serviceability (capability) of the existing roadway to handle the traffic. Uncontrolled access onto a highway is particularly damaging to the serviceability of a roadway as each turning movement creates a disturbance in the traffic flow pattern. As the serviceability of the roadway de- creases, the demand for up-grading of the roadway increases. Therefore, we feel that as developments are permitted along the State Highway System due consideration should be given to the items noted on the attached sheets. Very truly yours, DWIGHT M. NTS Since the advent of the Environmental Protection Act, it has become necessary to take into consideration of what the impact will be upon the noise and air pollution levels at the site of the contemplated improvements (houses, businesses, etc.) caused by the traffic on the highway adjacent to the improvements. In the case where such improvements are being contem- plated along an existing highway, we feel that in the total planning process the developers or those con- templating improvements should bear the responsibility to provide whatever noise abatement measures that might be required to meet the minimum decibel standard. In general, our experiences and testing to date indi- cates that improvements (residential) should be set- back a minimum of 150' to 200' from the traveled way, unless acne other type of noise abatement measures (walls, earth berms, etc.) are constructed. And as might be expected, the degree of air pollution de- creases as the distance from the source increases. • RIGHT OF WAY REQUIREMENTS Preservation of at least the minimum right of way that will be required fo. improvement of the high- way to handle the increased load. Our traffic projections for State Highway 392 through this area would indicate the need for a minimum of 100' of right of way (50' each side of centerline) . We would request that any additional width to meet this requirement, above our present right of way, be protected either by reservation, setback, or dedication (preferably the latter) as local zoning laws and regulations will permit. DRAINAGE REQUIREMENTS Oftentimes, developments change the run-off factors and increase the drainage structures required to handle tue increased water flow; therefore, dee consideration should be given to how this additional drainage will be disposed of, if this additional flow is anticipated to be of significant proportions. If in the site for the proposed improvement, it is anticipated that the land will be leveled or re- contoured, it should he noted that the Division of Highways will not permit drainage to flow into the borrow ditches from adjacent land unless it has historically done so. Also drainage from sewage lines or sewage ponds or other waste water will not be permitted to drain onto the highway right of way. DRIVEWAY PERMIT REQUIREMENTS We request that if possible approaches (driveways) be kept to a minimum and present approaches be utilized whenever possible. Also entrances off streets or roads other than the main arterials be considered. However, in all instances, where new approaches or alterations of approaches entering onto State High- ways are contemplated, the Division of Highways requires that a permit be obtained prior to any con- struction of the approach. These permits are avail- able thru our Maintenance Superintendent, Milo Ballinger, located at 1420 Second Street, Greeley, Colorado. GENERAL PROVISIONS FIRST: The Applicant represents all parties in interest, and affirms that the driveway approach(es) is to be constructed by him for the bona fide purpose of securing access to his property and not for the purpose of doing business or servicing vehicles on the highway right-of-way. SECOND: The applicant shall furnish all labor and materials, perform all work, and pay all costs in connection with the construction of the driveway(s) and its appurtenances on the right-of-way. All work shall be completed within 30 days of the Permit date. THIRD: The type of construction shall he as designated and/or approved by the Division of Highways and all materials used shall he of satisfactory quality and subject to inspection and approval by the Division. FOURTH: The traveling public shall he protected during the installation with proper warning signs and signals and the Division of Highways and its duly appointed agents and employees shall he held harmless against any action for personal injury or property damage sustained by reason of the exercise of the Permit. FIFTH: The Applicant shall assume responsibility for the removal or clearance of snow, ice or sleet upon any portion of the driveway approach(es) even though deposited on the driveway(s) in the course of the Division's snow removal operations. SIXTH: in the event it becomes necessary to remove any right-of-way fence, the posts on either side of the entrance shall he oecurely braced before the fence is cut to prevent any slacking of the remaining fence, and all posts and wire removed hall be turned over to the District representative of the Division of Highways. SEVENTH: No revisions or additions shall he made to the driveway(s) or its appurtenances on the right-of-way without the written permission of the Division of Highways.
