A regular meeting was held by the Board of County Commissioners of Weld
County, Colorado at 9:00 o'clock A. M., with the following present:

The minutes of the 30th instant were read, and there beinc no corrections
or objections thereto, same were ordered approved.
The following resolutions were presented:
RESOLUTION
WHEREAS, it is the desire of the Commissioner in District
.No. 3 to rent from Timpte, Inc. of 5990 North Washington Street,
Denver, Colorado, an end dump trailer, Model TT1OSBTED, Year 1966,
Capacity Two Ton, Serial No. 11540 for a price of $325.00 per month,
and,
WHEREAS, the County of Weld has been given the option to
purchase said vehicle with the rental of $325.00 per mouth to be
applied to purchase price less of 1% as penalty, and,
WHEREAS, it is understood that said vehicle shall be licensed
in the name of Timpte, Inc. with a tax exempt plate, and,
WHEREAS, it is understood that when said vehicle is no longer
in use by the County of Weld, said vehicle shall lose it's tax
exempt status and said license plate will be returned to the Clerk
and Recorder of Weld County,
NOW THEREFORE, BE IT RESOLVED that the County of Weld agrees
to rent from Timpte, Inc. of 59990 North Washington Street, Denver,
Colorado one end dump trailer Model TT1OSBTED, year 1966, Serial
No. 11540 for a $325.00 per month rental, with the option to
purchase said vehicle with the rental of $325.00 per month to be
applied to purchase price less 2 of 1% as penalty, and said vehicle
shall be issued a tax exempt plate to be used as long as said
vehicle is in the use of Weld County and when no longer used by the
County, the tax exempt plate shall be returned to the Clerk and
Recorder of Weld County.

COOPERATIVE AGREEMENT WITH
STATE HIGHWAY DEPARTMENT
PROJECT S 0057 (6):
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that they hereby approve a certain agreement with the State Highway
Commission of Colorado, a public corporation, for the use and benefit of the
Department of Highways of the State of Colorado, dated July 6, 1966, whereby
the County has reviewed and approved the Geometric Standards designated to
govern the construction of a Federal Aid Secondary Project S 0057 (6) of
improvements approximately 3.314 miles long beginning at the North limits of
Windsor - North on State Highway Number 257, as per terms of said agreement
on behalf of Weld County by signatures of the Board, as per agreement attached
hereto and made a part of this resolution.
The above and foregoing resolution was on motion duly made and
seconded, adopted by the following vote:

of Weld, Colorado, has presented to the Board of County Commissioners an application
for a County Retail License for sale of 3.2% beer only, and
WHEREAS, the said applicant having paid to the County Treasurer of
Weld County the sum of Fifty Dollars ($50.00) therefor, and having produced a
State Retail License Number J 3734 for sale of 3.2% beer only, outside the corporate
limits of any town or city in the County of Weld at the location described as follows:

having examined the said application and other qualifications of the applicant
do hereby grant County License Number 66-13 to said applicant to sell 3.2% beer
only at retail at said place, and do hereby authorize and direct the Issuance of
said license by the Chairman of the Board, attested by the County Clerk and Recorder
according to law, provided, however, that said license shall be issued upon the
express condition and agreement that the place where licensee is authorized to
sell beer under said license will be conducted in strict conformity to all laws
of the State of Colorado and rules and regulations relating thereto heretofore
passed by the Board of County Commissioners of Weld County, Colorado, and any
violation thereof shall be cause for revocation of the license.

WHEREAS, the Board of County Commissioners believes it to be in the best
interests of the County to accept said bid.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of
Weld County, Colorado that the bid of the Standard Oil Division of American Oil

RESOLUTION
WHEREAS, precinct registration has been made available to the voters
of Weld County for a number of years last past, and,
Z0EREAS, precinct registration was recently held in Weld County prior
to the primary election, and,
WHEREAS, the number of voters registering for the primary election
was very small, and that it does not warrant the continuation of precinct
registration in the County of Weld, and,
WHEREAS, under Section 49-4-3(1)(c) of the Colorado Revised Statutes
of 1963, "The Board of County Commissioners in any County with a population
of less than three hundred thousand may by resolution discontinue all
precinct registration in the County,
NOW, THEREFORE, BE IT RESOLVED that precinct registration shall be
discontinued as of November /Y. , 1966, and further that this resolution
may be rescinded by subsequent resolution of the Board at any time up to
five months preceding any general election.

I A-C.,:IT FOR PIPE LINE CONSTRUCTION
The request for permission to install a domestic water pipeline with
mains and service connection lines alongside and beneath County roadways in
the Districts One, Two and Three, as listed and described in Specifications
44-51.3; Schedules I, II and III, Plans and Base Maps Nos. 1, 2 and 3 for the
Central Weld County Water District, as prepared and submitted by Parker and
Underwood, Inc., of Greeley, Colorado, and by reference made a part hereof,
is granted subject to the following conditions and restrictions and agreement.
1. That markers will be placed at all intersections for reference
to pipelines.
2. That markers will be placed at every mile of pipeline.
3. That markers will be placed at major changes in alignment, nor
bridges, large culverts or other obstructions.
µ. That no open cut shall be made in any County road, and that all
excavations across County roads shall be by. tunneling, jacking or boring.
5. That Central Weld County Water District shall restore the disturbed
portions of all of the right-of-way and roadway to its original condition,
backfillin, to be well tamped and packed, the last 12 inches of backfill on
crossings to be stable granular material, such as crushed rock or gravel, and
all dirt and debris to be removed from all the right-of-way when work is
completed; that this line shall be buried in accordance with the County
2i1gineer's specifications; that all roadway signs taken down shall be replaced
immediately; that all tubes be marked ahead of the trencher; that trenching
be as cic;;e to the outer edge of shoulder as possible, not to exceed three
and one-half (31;) feet; that pipe be placed under all tubes and bridges; that
all lines under existing black top or hard surface roads must be bored or
pushed under the .7urfaced portion of the roadway; that the lines must be maintained
at :til tubes.
6. That the line must be maintained by you for a period of one year
and that you must check and maintain the backfill after all storms and assume
full responsibility for any damage it may cause.
7. That you save Weld County harmless from any and all claims of any
nature whatsoever which may arise by reason of granting permission to install
the above mentioned pipeline, including costs, if any are incurred, in the
defense of any claims made by any person, firm or corporation by reason of the
installation of said pipeline and the maintenance thereof.
8. Weld County shall not be responsible for any damages caused in the
maintenance of the highways to installations placed inside the highway right of
way.

9. The County retains the right to inspect the completed work, and
said work will be completed to the satisfaction of the County. If said work, or
any portion thereof, is not completed to the satisfaction of County, the County
may by written notice require the necessary corrections, and said corrections shall
be made within three months of said notice. Upon failure to make corrections
following the written notice, the County shall have the right to remove said
pipeline at the expense of the licensee.
10. This understanding and agrecrlent will be binding upon your
respective agents, heirs, executors, administrators, successors and assigns.

by and between MELD COUNTY, State of Colorado, by The Board of County Commissioners,
for its respective interests, party of the first part, and LAFFERTY MOVING AND
STORAGE of Greeley, Colorado, party of the second part, WITNESSETH:
WHEREAS, the party of the first part is the owner of voting machines which
presently are in the warehouse of second party, and in the care and custody of
second party, and,
WHEREAS, party of the first part is desirous of placing certain machines in
specified voting precincts located in various part of the City of Greeley and
the County of Weld, and,
WHEREAS, party of the second part is in the moving and storage business and
is the owner and operator of the necessary vehicles to deliver said machines to
the specified voting precincts,
NOW THEREFORE, for and in consideration of the mutual promises, agreements
and covenants hereinafter contained, the parties hereto hereby agree and contract
as follows, to -wit:
1. Farty of the second part hereby agrees to deliver from his warehouse
all of the voting machines to the specified voting precincts as shall be directed
by the County Clerk; party of the second party hereby further agrees to furnish
sufficient number of trucks to deliver said voting machines on time in order that

Before the County Planning Commission shall approve a special request for the
locations of a gravel pit, quarry or open mining operation in any "A" or "A"-1"
Agricultural District, or in any "I" Industrial District the applicant shall be
required to furnish the following information:
(a) A rehabilitation site plan showing how the area will be reclaimed after
the gravel pit, quarry or open mining operation is completed;
(b) A time schedule indicating when steps for rehabilitation will occur and
the total time period for the gravel pit, quarry or mining operation; and
(c) 'Such special information as may be required by the County Planning Commission
to assure future compatibility of the operation with the surrounding area.
Such information may include, but is not limited to, the following:
1. A description of the measures to be taken to be sure that stagnant
water bodies will no be created;
2. The slopes of proposed excavations;
3. Precautions to protect existing houses, ditches, roads, or other
improvements on adjacent properties, and
4. The proposed location of fences to discourage the use of the site by
non -employees.

Special Areas Subject to Flooding . . Fcr the purpose of this Resolution,
there are hereby ettablished "Flood Plain i,rees" as shown on the Zoning
District Maps of 1'1e1d County within which the following restrictions shall
apply:
(1) No dwelling, mobile home, school, church or other place of assembly shall
be permitted;
(2) No storage of materials which could he moved by flood waters shall be per-
mitted unless the materials are secured adequately to prevent their being
moved downstream during periods of flooding
(3) No dumping of debris which might be moved downstream during periods of
flooding shall be permitted; and
(4) Accessory buildings or other structures located in areas subject to flood-
ing shall be constructed only after having been approved by the Weld Coun-
ty Planning Commission, which shall first be assured that such buildings
or structures will not impede the flow of water during periods of intense
flooding.
Amend Section VI, Supplementary Regulations, by adding a paragraph 6.6, Unit Develop-
ment
6.6. Unit Developments . . Unit developments which may be permitted in the "H" High
Density Residential District, the "E" Estate District, and in the "R" Residen-
tial District, subject in each instance to being shown on a plan as defined,
processed and approved as follows:
(1) A unit development shall be defined as a project which is controlled by one
owner, corporation or agency, or the subject of an application filed joint-
ly by the owners of the property to be included, which is located on at
least 20 acres of land, including usable open spaces for the mutual benefit
of the entire tract, and which is planned to provide variety and diversity
so that maximum long-range benefits of unique site design can be achieved
while still protecting the surrounding area.
(2) Normal zoning standards for "minimum setback," "minimum lot area," "mini-
mum lot width," " minimum side yards," " minimum rear yards," "maximum
height of buildings," may vary as specified on the unit development plan,
(3) An application for a unit development shall contain the following informa-
tion:
( )
proposed name of the area;
total acreage;
a site plan showing the proposed location and dimensions of all struc-
tures;
land to be retained as functional open space, the purpose for which it
is to be used, and an explanation of how such open space will be pre-
served and maintained;
a circulation plan for vehicles and pedestrians;
uses to be developed in the area, and the proposed density of develop-
ment;
a legal description of the property;
the proposed construction schedule;
landscaping proposals; and
such additional information as may be requested by the County Planning
Commission and by the Board of County Commissioners in order to justify
granting the exceptions required for the unit development.
Unit developments shall have --
a maximum density not to exceed 12 dwelling units per acre; and
a minimum amount of usable open space (exclusive of parking and strees)
of not less than 25 percent of the total acreage.
Review procedure . . before a building permit is granted for a structure
which is part of a unit development plan, a general plan for the entire unit
development shall be approved by the County Planning Commission and by the
Board of County Commissioners who shall be guided in their review by the
intent of this zoning Resolution, by the unique conditions of the land
invoied, and by the Countywide need for such developments. Follot;'ino such
official approval, the general unit development plan shall he recorded in
the files of the Board of County Commissioners. Proposed amendments to the
official unit development plan shall be processed in a similar manner.
Amend Section VIII,. Amendments, paragraph 8.2, Special Procedure, by adding a para-
graph to read as follows
(4) For proposed amendments to the Toning Area �:ap, the County Planning Commission
shall require the applicant to post public notices on the property requesting
rezoning. In such cases, notices shall be posted at least 10 days prior to the
hearing date. Such notices shall be readable from public roads adjacent to the
area and shall contain the following information!
(a) rezoning reguest number
(b) from zoning district to zoning district;
(c) date and place of public hearing;
(d) location and phone number of the public office where additional information
can be obtained.
Amend Section VIII, Amendments, by adding a paragraph 8.4, to read as follows:
8.4 Conditional Review . . Rezoning requests for an iv�H, T, B, C, I or S District
shall be accompanied by a tentative site plan -and a tentative time schedule
for construction of the development. Within six months after rezoning to one
of the above districts, the owner or his representative shall present a final
site plan and final construction schedule to the County Planning Commission
for their review and recommendations. Construction of the proposed buildings
shall commence within twelve months after the area has benn rezoned. If con-
struction does not proceed according to schedule, or within a six months exten-
sion period which may, upon request, be granted by the County Commissioners, the
County Planning Commission shall instigate action to rezone the district.

Amend the Subdivision Regulations by adding an entire Section III A, Improvements, to
read as follows:
SECTION III A
IMPROVEMENTS
In each new subdivision the subdivider and the County Planning Commission, subject to
approval by the Board of County Commissioners, shall agree on the type, location and
extent of necessary public improvements depending on the characteristics of the pro-
posed development and its relationships to surrounding areas. Improvements shall be
made by the subdivider at his expense according to the minimum standards specified
by the Weld County Board of County Commissioners.
3A.1 Adiacent to Incorporated Areas
Whenever a subdivision is proposed within one mile of an incorporated community
located in geld County or located in any adjacent county, the subdivider shall
be required to install improvements in accordance with the requirements and stan-
dards that would exist if the plat were developed within the corporate limits of
that community.
3A.2 Other Areas
Whenever a subdivision is proposed for an area located more than one mile from
any incorporated community, or where the incorporated municipality lacks stand-
ards for improvements, the following standards shall apply:
(1)
Surface Improvements
(a) Permanent survey monuments shall be set at all subdivision boundary
corners and at points within the subdivision normally not more than
1,220 feet nor less than 660 feet apart and placed in such locations
so as not to be disturbed during construction. Such monuments shall
be concrete at least 36" in length and 4" square with a suitable cen-
ter point.
(b) Street Paving
(1) !/hen the residential density exceeds one lot per 13,000 square feet,
and in areas zoned for commercial and industrial development, all
streets shall be paved with concrete or bituminous material to the
widths and grades required by these regulations;
(2) when residential density is less than one lot per 13,000 square feet,
a gravel surface shall be the minimum requirement.
(c) Curbs, gutters and sidewalks shall be required where lot widths are less
than 90 feet and where the County Planning Commission deems them neces-
ary for the proper drainage of storm water or for the protection of
public safety and welfare.
(d) Street name signs shall be installed at all intersections in the subdi-
vision. Street names shall be approved by the County Planning Commis-
sion.
(e) Trees may be planted and are encouraged in all new subdivisions.
(2) Utilities
(a) Water lines, where required, shall be designed to connect each lot with
mains of not less than six inches in diameter.
(b) Fire hydrants shall be required in subdivions with an average density
greater than one lot per 13,000 square feet. Hydrants shall be spaced
not more than 1,000 feet apart and provided with adequate water pres-
sure for fire fighting purposes.
(c) Storm drainage provisions shall be accomplished according to the stipu-
lations stated on the preliminary plat for easements, culverts, check
dams, etc.
(d) Underground placement of all utility lines is encouraged by the County
Planning Commission to preserve the natural character of the County.
(3) Other Improvements
Other improvements not specifically mentioned herein and found appropriate
and necessary by the County Planning Commission or Board of County Commis-
sioners, shall be constructed at the subdivider's expense within such time
and in conformance with such specifications as deemed necessary and appro-
priate.

(4) Guarantee of Completion
(a) No Final Plat shall be approved by the Board of County Commissioners
or accepted by the County Clerk until the improvements listed are con-
structed and approved by the Board of County Commissioners.
(b) In lieu of such prior construction, the Board of County Commissioners
may accept a surity bond or certified check sufficient to cover 50
of the estimated cost of the required improvements, or they may accept
such other legal assurances as may be deemed approriate.
(c) As each stage of improvements is comply ed and accepted, any guarantee
bond or certified check which may have been posted for that stage of
improvements shall be released upon written request by the subdivider
to the Board of County Commissioners.
PROPOSED AMENDEMNTS
MOBILE HOME AND MOBILE HOME PARK REGULATIONS
Amend the adopting resolution to read as follows!
A resolution defining and regulating mobile homes, mobile home parks and mobile home
subdivisions in Weld County: establishing minimum standards governing the construct-
ion and maintenance of mobile home parks; establishing minimum standards governing the
provided utilities and facilities, and other physical items and conditions to make
mobile homes safe, sanitary and fit for human habitation; fixing the responsibilities
and duties of owners and onerators of mobile home parks, authorizing the inspection of
mobile home parks; and, fixing penalties for violations.
Amend Section 1, Purpose, the first sentence to read as follows:
Each year more families seek mobile homes in Jeld County for temporary and per-
manent housing. In order to provide safe, healthful living conditions for resi-
dents within these mobile homes, as well as to protect the publich health and
safety of adjacent residential areas, the following regulations are proposed
for adoption as minimum standards.
Amend Section 14, Individual Mobile Homes, paragraph 14.3(A) the first sentence to
read as follows:
Where an individual mobile home is proposed to be parked on a private lot, and
used for living quarters, it shall be considered as a "dwelling" and, as such,
shall comply with applicable zoning, safety and health regulations as well as
the applicable parts of section 4.2 and sections 7 through 12 of these regula-
tions.
Amend Section XV, Supervision, Penalties, by adding a paragraph 15.4 to read as fol-
lows:
15.4 Guarantee of Completion
In order to assure that the improvements in the mobile home park or in the
mobile home subdivision are completed according to County standards, all
of the required improvements for the area to be occupied by the mobile
homes shall be installed prior to the issuance of a mobile home park per-
mit or the selling of a lot. In lieu of such prior construction, the Board
of County Commissioners may accept a surety bond or certified check suffi-
cient to cover the estimated cost of all required improvements.

adduced upon said hearing and having considered the testimony, evidence, petitie:i:
and remonstrance filed with said Board, and having carefully weighed the same,
now makes the following findings:
1. The applicant failed to sustain the burden of proof as to the
reasonable requirements of the neighborhood.
The evidence shows that there are several other three-way cutlet
in the area known as the "neighborhood". Evidence shows that there has been no

location as evidenced by personal testimony and petitions are strongly opposed
co of the license.
3. That each of the preceding findings in and of themselves and
independent of each other constitute a separate and individual ground for derany

DEED OF RELINQUISHMENT
THIS DEED, Made this 14th day of September, 1966, by and between
THE COUNTY OF WELD, by and through the Board of County Commissioners
of Weld County, Colorado, party of the first part, and RAY B. KNAPP
and LORENE I. KNAPP, owners of the surface of the land described in
the recitals herein, parties of the second part, WITNESSETH:
Recitals.
By deed recorded March 19, 1943, in Book 1107, page 166, Weld
County conveyed to
certain real estate in Weld County, Colorado, a portion of which is
described, as follows:
A tract of land located in the NEi of Section 28, Township
5 North, Range 66 West of the 6th P.M., Weld County, Colo-
rado, being further described as follows: Beginning at the
Northeast corner of said Section 28 and considering the
East line of said NEI of said Section 28 to bear North
01°31'17" West and with all bearings contained here relative
thereto: Thence South 89° 47' 20" West along the North
line of said NEi of Section 28, a distance of 609.42 feet to
a point on the Northeasterly bank and 20 feet more or less
as measured at right angles to the centerline of an existing
irrigation ditch; thence along the Northeasterly bank of
said irrigation ditch and 20 feet more or less as measured
at right angles to the centerline of said irrigation
ditch by the following four courses and distances: South

as follows: Reserving all oil, gas or other minerals by Weld County,
Colorado.
The present owners of the surface of the land hereinabove described
contemplate using said land or causing it to be used for residential
purposes and desire that Weld County relinquish its right to enter
upon and use the surface of said land pursuant to the rights reserved
under the aforesaid exceptions and reservations. Weld County is
willing to relinquish, with respect to the land above described, its
said right of entry upon the surface of said land, upon the understand-
ing, however, that Weld County's title to said oil. gas or other
minerals shall in no way be affected, and that Weld County shall have
the right to remove such oil, gas or other minerals from the aforesaid
land by slant drilling, subteraneous entries, by means of operations
conducted on the surface of other lands or otherwise by any means or
methods suitable to Weld County, its successors or assigns, but with-
out entering upon or using the surface of the above -described land.
RELINQUISHMENT AND QUIT CLAIM
NOW THEREFORE, Weld County for in consideration of the sum of
Twenty-five Dollars ($25.00) to it paid, the receipt of which is hereby
acknowledged, has relinquished and forever Quit Claimed, and, by
these presents does relinquish and forever Quit Claim unto the owner
or owners of the surface of the land described in the Recitals
hereof, his, her, its or their grantors, heirs, successors and assigns,
with respect to said land described in said Recitals, the right to
enter upon the surface of said land by virtue of the exceptions and
reservations contained in said deed recorded March 19, 1943, and hereinabove
quoted in said Recitals, it being the intent hereof to relinquish
only the right to enter upon the surface of said land and to leave in
full force and effect all other rights reserved to Weld County in
said deed, it being expressly understood that Weld County's title to
said oil, gas or other minerals shall in no way be affected, and that
Weld County and any lessee or licensee of said Weld County shall have
the right to remove such oil, gas or other minerals from the aforesaid
land by slant drilling, subterranean entries, by means of operations
conducted on the surface of other lands or otherwise by any means or
methods suitable to Weld County, its successors and assigns, but with-
out entering upon or using the surface of the above described land,
and in such manner as not to damage the surface of said land or to
interfere with the use thereof by said owner or owners, his, her,
its or their grantees, heirs, successors or assigns.
It is the intention hereof that, in the event the surface of the
land affected by this relinquishment is separately owned by lot,
parcel or subdivision, the interest herein relinquished to any grantee
shall be limited to the particular lot, parcel or subdivision of
which such grantee is the surface owner, and such interest shall
not extend to any other lot, parcel or subdivision thereof.

This relinquishment and quit claim is made subject to the specific
understanding that all of the terms, conditions, provisions, exceptions
and reservations contained in said deed dated March 19, 1943, shall
continue in full force and effect with respect to all lands conveyed
thereby and not covered by this relinquishment and quit claim and
it is further specifically understood that all terms, conditions,
provisions, exceptions and reservations contained in said deed
dated March 19, 1943, and, not relinquished hereunder shall continue
in full force and effect with respect to the land herein above described.

WHEREAS, The Board of County Commissioners is aware of the fact that several
of the fund levies have exceeded maximum limits and their intention is to bring
the tax levy into compliance as soon as possible, and,
WHEREAS, in view of general economic conditions as they affect the taxpayers
of Weld County, the Board has determined to limit 1967 appropriations to amounts
appropriated for the calendar year 1966 except to make adjustments in permanent.
County employees' salaries in all instances where total annual compensation does not
exceed $7,000.00, and,
WHEREAS, it is determined that the pay increase that shall be made will be
at the rate of 5%, and,
WHEREAS, with regard to certain departments which are governed by appointed
boards, the 5% increase shall be effective to present positions or to vacant positions
and any reduction in a department's appropriation by reason of the restrictions as imposed
shall cause a like decrease in the total appropriation for 1967, and interim saldry
increases not provided in budget will not be allowed, and,
WHEREAS , the Board is cognizant of the fact that studies and projection have and
are being made to provide retirement coverage other than social security and should any
change be accomplished during the year 1967, the Board believes that a contingency
appropriation can be utilized to cover any additional costs, and,
WHEREAS, preliminary budget requests for capital outlay expenditures total
approximately the same amount as in 1966 and the Board intends to approve a total of
$90,000.00 for all departments and offices , and further that. all expenditures from this
appropriation must have commissioner approval prior to entering into any purchase
committment, and unless the above mentioned approval shall have been obtained in a
regular meeting of the Commissioners, payment for any capital outlay or improvement
will not be allowed.
NOW THEREFORE, BE IT RESOLVED THAT based upon the examination of the 1967
budget requests and preliminary budgets of the various departments and based upon
the comparative figures for the year 1964, 1965 and 1966 as well as preliminary

the year 1966 and therefore of necessity the department budgets must remain the same e

RESOLUTION
WHEREAS, Mrs. Sidow has requested that she be allowed to develop the area
described as Lots 38 to 43, Block M and Block 4, Wolff Garden Subdivision, Town
of Evans, Colorado, as a used lumber yard, and,
WHEREAS, said request has been approved by The Weld County Planning Commission
as to the best use of the area, and,
WHEREAS, The Planning Commission has recommended that the area be developed
into a used lumber yard, and that it be zoned accordingly, provided the owner
dedicate to the public a road for ingress and egress to Block Four, which right-
of-way shall be 30 feet wide, and,
WHEREAS, The Board of County Commissioners has approved the recommendations
of the Planning Commission,
NOW THEREFORE, BE IT RESOLVED that the area owned by Mrs. Sidow, to -wit:

Notice is hereby given that a proposed budget has been
submitted to the Board of County Commissioners of Weld County,
Colorado for the ensuing fiscal year of 1967. A copy of such
proposed budget has been filed in the office of the Board of
County Commissioners where same is open for public inspection.
Such proposed budget will be considered at a regular meeting
of the Board of County Commissioners to be held at their offices
in the Weld County Court House, Greeley, Colorado on Monday,
October 24, 1966 at 10:00 o'clock A. M.

RESOLUTION
WHEREAS, the Colorado Tax Commission on November 2, 1965, advised the
Weld County Corrunissioners that upon receipt of the Weld County application
for an 8.15 mill levy for the County General Fund for 1965, that it was 3.15
in excess of the statutory limit set forth in 1963 C. R. S. 36-3-1, and,
WHEREAS, the Colorado Tax Commission reduced the 8.15 mills to 5 mills,
the maximum statutory levy for the General Fund, and placed 3.15 mills into
the Contingency Fund, and,
WHEREAS, The Board of County Commissioners was then advised that said
monies raised by the 3.15 mills could be transferred from the Contingency
Fund into the County General Fund when the need arose, and,
WHEREAS, the need has now arisen whereby the County General Fund is in
need of this money in the amount of $500900.00 to meet the budgeted obligations
of Weld County, and,
WHEREAS, in the opinion of The Board of County Commissioners this is a
transfer of funds as authorized and approved by the Colorado Tax Commission
and as contemplated by the Statutes of the State of Colorado,
NOW THEREFORE, BE IT RESOLVED, that $500,000.00 shall be transferred
from the Contingent Fund of Weld County, Colorado into the Weld County General
Fund in accordance with the instructions of the Colorado Tax Commission.

WHEREAS, the Uniform Building Code, 1964 Edition, was adopted
by reference on August 17, 1966, and,
WHEREAS, at the time of adoption of the code, the County of Weld
was not completely zoned, and,
WHEREAS, now that the entire County of Weld is zoned, it is
imperative that the scope of the Resolution be enlarged, and,
WHEREAS, to enlarge the scope of said resolution requires an
amendment of Section IIIA of that resolution passed August 17, 1966,
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF WELD COUNTY, COLORADO that Section III - Scope of Resolution,
Part (A) shall now read as follows: "The provisions of this Resolution

Article 8, Page 628, (100-8-2-a), the Board of County Commissioners shall
apportion such Oil Royalties received under the Federal Leasing Act received
by them between the school fund and the road fund, provided that not more than
seventy-five percent of said money shall be apportioned to either of said funds;
and
WHEREAS, the Board believes it to be to the best interests of the
County to apportion said money equally to both funds.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado that they do hereby apportion fifty percent of the Oil
Royalties received under the Federal Leasing Act by them to the school fund and
fifty percent of said royalties received by them to the road fund.

having examined said application and the other qualifications of the applicant
do hereby grant License Number 66-16 to said applicant to sell 3.2% beer only
at retail at said place, and do hereby authorize and direct the issuance of
said License by the Chairman of the Board, attested by the County Clerk and
Recorder of Weld County, good for one year from the date of issue unless revoked,
according to law, provided, however, that said license shall be issued upon the
express condition and agreement that the place where licensee is authorized to
sell beer under said license will be conducted in strict conformity to all laws
of the State of Colorado and rules and regulations relating thereto heretofore

by and between HOMER JENNINGS of Weld County, Colorado, party of
the first part, and THE COUNTY OF WELD, in the State of Colorado,
party of the second part; WITNESSETH:

1'he party of the first part, for and in consideration of
One Thousand Dollars ($1,000.00), payable in yearly installments
of $500.00 beginning October 15, 1966, to first party in hand
paid by the party of the second part, the receipt of which is hereby
confessed and acknowledged, does hereby lease unto the party of
the second part, its successors and assigns, the right to remove
all gravel, sand and road -making and building material which it
shall be able to remove from the following described land, situate
in the County of Weld, and State of Colorado, to -wit:
The Northeast Quarter of the Southeast Quarter (NE%SEA)
of Section Twenty-three (23), Township Two (2) North,
Range Sixty-six (66) West of the Sixth Principal
Meridian. Also an easement for ingress and egress
to move above materials.
The Count of Weld, as a further consideration for this lease
and by acceptance thereof, agrees to build a road into said property
and to install a cattle guard and gate which shall become the property
of the first party upon termination of this lease, the first party
hereby to the second party the right to enter upon said lands at
any time hereafter to excavate and remove therefrom all gravel,
sand and earthen materials which it shall find suitable to its needs,
together with the rights and privileges incident to the proper
enjoyment thereof.
This instrument shall give no title to said land, and shall only
give the right to remove therefrom the part of the surface thereof aS
hereinabove set forth. This Lease shall be binding upon and inure to
the benefit of the heirs, administrators and assigns of the parties
of the first part and the successors and assigns of the part of the
second part.
This lease shall be for a term of two years beginning October 15,
1966 and ending October 15, 1968. The first party grants the second
party an option to renew said lease for an additional term of two

years under the same conditions and terms;'provided, the second party
shall notify the first party in writing thirty days prior to the
termination of this lease of its intention to renew said lease.

The following resolution was presented:
TO ADOPT THE BUDGET FOR THE
ENSUING YEAR, 1967:
WHEREAS, the Board of County Commissioners of Weld County, Colorado
did cause to be published a notice showing that a proposed budget was open for
inspection by the public, and
WHEREAS, after careful review and consideration, the Board believes it to
be to the best interests of the County to adopt said budget, hereby attached and
made a part of this resolution.
NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
of Weld County, Colorado does and they do hereby adopt the aforementioned budget
setting forth expenditures to be made in the ensuing fiscal year, beainnino_
January 1, 1967 and ending December 31, 1967.
The above and foregoing resolution was, on motion duly made and seconded
adopted by the following vote:
