M. in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing a petition of Charles Steven Munger, RFD, Hudson, Colorado, requesting a change of zone from "A" Agricultural District to "I" Industrial District, and WHEREAS, the petitioner was present and represented by his attorney, William Bohlender, and zone, and WHEREAS, there was no one present in opposition to the change of i WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the re- quest of the petitioner and studied the recommendations of the Weld County Planning Commission as submitted on July 22, 1968, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS, that the petition of Charles Steven Munger, RFD, Hudson, Colorado, for change of zone from "A" Agricultural District to "I" Industrial District, said area being more particularly described as follows: The East Half (EZ) of Section 32, Township Three (3) North, Range Sixty-five (65) West of the 6th P. M. , Weld County, Colorado; except a strip of land through, upon, over, and across the NE+ of Section 32, Township 3 North, Range 65 West, said strip of land being 55 feet wide and extending 30 feet right and 25 feet left of the center line of the Speer Canal, passing through the points of the following described traverse line and varying not more than 8 feet from the line connecting said points, said center line being described as follows, to - wit: Beginning at a point on the west line of the NE+ of Sec- tion 32, 373 feet south of the north quarter -corner thereof, said point being designated as Station 1724+74. 5; thence south 49°19' east 274.3 feet to Station 1727+50; thence south 87°57' east 347.5 to Station 1731+00; thence north 47°42' east 249.1 feet to Station 1733+50; thence north 09°14' east 96. 2 feet to Station 1734+50; thence north 18°17' west 214 feet to Station 1736+63. 5; a point on the north line of Section 32, 684 feet, more or less east of the north quarter -corner thereof; containing 1. 5 acres more or less, is hereby granted under the conditions following: 1. Mr. Telep: I would like the record to show that this matter came on for hearing at 11:00 o'clock, September 4, 1968 at the request of Charles S. Munger, RFD, Hudson, Colorado, for a Change of Zone from "A" Agricultural District to "I" Industrial District on a parcel of land located on the Ek of Section 32, Township 3 North, Range 63 West of the 6th P. M., Weld County, Colorado. more particularly described in meets and bounds which I will not read but it has been published as required by law - containing 1.5 acres more or less -- Mr. Bohlender: That is the exception that only contain the small amount of land, Mr. Telep, the total amount is 320 acres. What you have the 1.5 something is the exception out for the -- Mr. Telep: Alright I would like to have the record sorrected to that this is all of the east half the exception being 1.5 acres more or less, thank you, Bill. Mr. Bohlender: Gentlemen, I am representing Mr. Bohlender and the parties concerned with this Change of Zone request and we would like to briefly run through, by several people here, the proposal and exactly what we intend to do. As set out in your notice this is a request to change from "A" Agricultural District to "I" Industrial District. In general the proposal is to set up a plant that will take care of junk automobiles and package them in a method that they can disposed of. At the outset I would like to say that of course we are all concerned with this type of operation and believe it is very valuable to have one in Weld County. We hope to show you what we intend to do and the reason for this location of it. Mr. Mu n g e r : First of all Mr. Munger, you are the owner of this property, isn't this right? Yes. Mr. Bohlender: You have an option to sell this property to Mr. Herbert E. Webb, upon this zoning request - is that true? Mr. Munger: Yes. Mr. Bohlender: Would you tell the Commissioners the approximate location of your property? In relation to the Milton Lake. Mr. Munger: From the Milton Lake - about a mile and a half south and a mile to the corner back west - to the northeast corner. Mr. Bohlender: Its the east half of Section 32, Township 3, Range 65. Who are your neighbors around there? Mr. Munger: The closest one is Mr. Glover. The rest of them are quite a ways away. 3 Mr. Bohlender: Mr. Munger: Mr. Bohlender: Mr. Webb: Mr. Bohlender: Mr. Webb: Mr. Bohlender: Mr. Webb: Mr. Bohlender: It isn't a very thickly populated area is it? No. Mr. Webb would you state your full name? Herbert H. Webb. What is your residence? 1130 Oneida, Denver, Colorado. What is your occupation? I am in moble home sale right now. Is it correct that you have an option to purchase the Munger property that we are considering here provided that it is zoned so that you can do what you propose there? Mr. Webb: Yes Mr. Bohlender: And what bacically do you propose to operate on this property? Mr. Webb: It is a method of packaging old automobiles into about 300 pound bales - we have the machinery now - the baler and the cutter. It cuts and bales them into about 303 pound bales. That is the main thing I am just getting rid of the older car bodies. Mr. Bohlender: Do you have a man that is going to conduct this operation? Mr. Webb: Yes, Max Goodwin Mr. Bohlender: I believe you furnished a financial statement and I believe your net worth was something over two hundred thousand dollais is that right? Mr. Webb: Yes. Mr. Bohlender: Mr. Goodwin, would you stand up and come forward here now. Please state your full name. 4 Mr. Goodwin: My name is Max A Goodwin Mr. Bohlender: What is your residence sir? Mr. Goodwin: 2141 East 66th Avenue, Denver, Colorado. Mr. Bohlender: Are you the gentleman Mr. Webb mentioned who will operate this operation? Yes. Mr. Goodwin: Mr. Bohlender: Would you explain to the Commissioners what you propose to do and generally how this is set up. Mr. Goodwin: (Shows Commissioners drawings and pictures of equipment) This is a burning oveo - our old cars will go into this burning oven and be set on fire and will be burned. The smote will be pumped through to a filter chamber and into the filtering chamber into an after burner. There is no smoke available to the eye. Mr. Marshall Anderson: Does it comply to the air pollution laws? Mr. Goodwin: Yes. The Adams County Board said they would approve this. The man in the post office who signs the burning permits said this was the best he has seen yet. After they are burned they are taken out of here and lifted onto the tracks and disected with acetylene torches up to the heavy irons are taken away from it - excuse me this machine right here - it is cut into four pieces - and the four pieces are run through this machine that bales approximacley 300 to 400 pounds. Mr. Harold Anderson: This is a compressor? Mr. Goodwin: No this is a shearing machine. That shears it up and this is the compressor. That bales it. There is 220 acres there that we plan on breaking into 5 acre plats to lease out to each individual junk dealer throughout the counties to get them out of their locations and get them away from the eye sores in which they are in at the present time. It will also serve to bring in the 5 car bodies for the disposal end of them. Mr. Marshall Anderson: In other words they are going to deliver these cares to you. Mr. Goodwin: We have facilites for hauling our cars in and also these people will haul them to us to dispose of them and to get them out of their yards. Any body that is moved because of their zoning can lease a 5 acre plot and set up a business on that. See, we will use approximately 100 acres for the master operation. Mr. Bohlender: Approximately how many cars could you take care of row at your present plant? Mr. Goodwin: As of today we could handle approximately 35 automobiles at the present plant - on an eight hour shift. In over a year it would run in the neighborhood of 7,000 with the new nachine. It the business warrants it we will put in another press so we can multiply our production. Mr. Bohlender: Now you have had experience in this area and have heard about other machines that cost in the millions and so forth - they seem to talk about succes - now what is the problem here? Mr. Goodwin: The one in Houston, Texas, right now cost almost 6.5 million dollars - it was shipped in from Japan. It has to have 500 cars per day to operate it under a paying proposition and they shut the machine down for three days and bring cars in and operate one day. It isn't planning out very well for the machinery. Mr. Bohlender: So in summary the problem is to get some of these cars to these monsters like this where you don't have the problem of investment and you will be able to handle this and make a profitable venture - it this right? Mr. Goodwin: Yes sir. this is a slower operation but it gives the public and everyone a chance to bring their automobiles to us and dispose of them as it is needed. They have to pay for what: they haul in -in order to get the quanity. Mr. Bohlender: I believe you mentioned to me that you need to get approval before making many contacts but you know that you have cars available. I believed you mentioned Erie, a few of the people along the main highway ( super highway) Mr. Bohlender: Did you contact the other people in Weld County to see that you get these cars - in other words it would be a clean-up process and a benefit to the county also. Mr. Goodwin: Thats right. Most of the people will haul them into us and bring them in free of charge to us. Down there where I am set up at the present time they even pay us to let them run the cars in. Mr. M. Anderson: Do you have an operation going now? Mr. Goodwin: At the present - yes. it is at 60th and Federal in Denver. Mr. Dunbar: Mr. Dunbar: Mr. Goodman: You have had experience in this? What kind of an investment do you expect? Yes, I have had experience in this type of business. The most investment is in the machinery and equipment, the other is just hard work. Mr. Bohlender: Do you or Mr. Webb have the approximate cost of the machinery? Mr. Webb: The machinery we have there already - has cast about Mr. Goodwin: 28 thousand so far. And we do have to set up the burner. Right now we oven have it/bought and it is suppose to be delivered today. We are in the process of ironing out the bugs and getting everything situated so we can move in on the property up here without any delay and go right into operation. Mr. Bohlender: Approximately how long would it take to set this up in you opinion at this time say that you were given the zoning change and could procede how long do you anticipate your stages of operation would be then? Mr. Goodwin: Not over one year's complete time to be in full production. Mr. Bohlender: You say in full production - when would you say you would start partial production? Mr. Goodwin: We can start partial production immediately after we set up the burning oven and make sure or clear the smog control. It would take approximately 30 days to set the burner up. Mr. Bohlender: So what I am actually driving at is for instance if the Commissioners saw fit to conditionally zone this for a year certain depending upon you taking/steps which means getting the plant in operation do you feel that you could do this or be willing to - Mr. Webb specifically - abide by conditional zone. If he didn't put it in operation and nothing was done it would revert back - but if it were working and were proceding within a year it would go to a permanent zone - would this be satisfactory? Mr. Goodwin: I would say so. Mr. M. Anderson: Then what you are saying Bill, is that conditional zoning upon completion of the operation in getting started. Mr. Bohlender: Yes, in other words, within a year's time in getting the plant started we might have different of production. If it is just weeds or something then it would revert back. We would be willing to abide by that type of stipulation with the county on that. Mr. Dunbar: This zone request was reviewed by the Planning Commission what was there - would you read their recommendation. 8 Mr. Telep: I have a resolution of the Weld County Planning Commission dated July 22, 1969 ( correction should read July 22, 1968) stating that - not stating - correction recommending this change of zone unfavorabley for the reason - that and I quote " that the transportation facilities in the area are not adequate for industrial use and there are no similar uses in the area". In addition I have a letter here from the Hudson area Chamber of Commerce dated August 13, 1968. It is addressed to the Board of County Commissioners, Court House, Greeley, Colorado. (Letter was read in hearing and said letter is attached to and made part of the file) With exception of voicing disatisfaction of the change for this variance - it doesn't give any reasons - I would like to make particular note of that before the Board. Mr. Bohlender: Mr. Telep does the file from the Planning Commission show that there is some consent by property owners in the area. Mr. Telep: No that would be with the Planning Commission. Mr. Bohlender: Unfortunately we had some consent before them we did not have duplicate copies - we have one gentlemen here who would like to make a statement concerning where you live and please state your name first then where you live. Mr. Glover: I am Mr. A. W. Glover, I am on the west half of 32, the same section as Mr. Munger and I can't see that this would hurt our neighborhood. Mr. Telep: How far is this from the town of Hudson? Mr. Glover: It is seven and a half miles north and one and a half miles west. Mr. Telep: That is Hudson,Colorado, is that correct? This letter just mentions northwest of town. Mr. Bohlender: How many neighbors are there in there besides yourself? 9 Mr. Bohlender(cont) Are you probably the closest neighbor to Mr. Munger Mr. Glover: Yes, I am the next west half of that section. We are a half mile from his place. Mr. Bohlender: Is anyone else living anywhere within a half mile of where you live to the Munger properLy? Mr. Glover: No, the closest one is one mile , the edge of Mr. Munger's east line. Mr. Bohlender: So you have no objection to what has been proposed Fare is that correct? Mr. Glover: I can't see that it would hurt anything at all in that part of the country. Mr. Bohlender: Mr. Clover: Mr. Bohlender: Mr. Glover: Mr. Marshall Anderson: Do you gentlemen have any questions? I am not paid to say this - I didn't even ask him to come in. When Mr. Munger told me what he was going to do, I said I would come up and put my two cents worth in. Thank you sir. I have some questions - how far back off this county road is this operation going to be - is it going to be back west over the hill? Mr. Goodwin: Yes sir. Mr. Anderson: Is it going to set right on the road? Mr. Webb pointed out on map to Commissioners the area involved. Mr. Dunbar: One question I would like to ask its probably the same thing - would you object to a fairly wide buffer zone around this industrial zoning if it would come to that? 10 Mr. Goodwin: Well I don't see why we should - as long as it doesn't have any thing to do with the operation. But this would be considered a storage yard here. Mr. Dunbar: You know what I am getting at - as long as I don't have an unsightly situation along the road. Mr. Bohlender: Isn't this kind of down in a ravine - isn't this richt? Mr. Goodwin: Well our main operation is - well here is the house right here and we will be down in here. Mr. Timothy: Marsh, may I say I have checked that property from north to east and it is rolling in such a manner that it would be very difficult to see when you get a half a mile away from it. Mr. Anderson: We have had a lot of complaints rejarding these auto wrecking yards immediately to the highway. I was wondering i= they would agree to set back 500 feet from the county road. Mr. Bohlender; What would a 500 foot set -back do to your plans Mr. Webb: i guess the way he has his plans there - they are going to have a road come down through the center of it. We could put a fence up if we were given enough time - you know A nice fence up there would shut off more than the 500 feet. Mr. Arb erson: That seems to be the main complaint - we have one where the person put up a ten foot fence for this and for his own protection. Mr. Webb: Yes - you need this fence for your own protection too. The other one improves the yards there. Mr. Bohlender: I think that perhaps the best thing if one of you or all of you go out there to see which way would be best for your set back that would be the most agreeable considering the terrain because I myself have not seen it and think we 11 need to look at it to see which would be the best condition to impose there. Mr. Dunbar: What was the main objection to it from the standpoint of the Planning Commission. Mr. Goodwin; The road facilities. Mr. Bohlender: I talked to one member of the Planning Commission this morning and I thought he would be here and I understand that there only objection was the fact that they didn't want to change a zone because you would have to build a new road or something. But we have no objection to the present road facilities. As I understand it there is no problem concerned on the facilities roads or otherwise. So we have no request for in the present or future for roads. Mr. Dunbar: Are there any protestants here? Is there any more testimony? Mr. Bohlender: That basically - I will just make some final statements but that is basically what we have to offer to you. There were consents in the Planning Commission of other people around. I know of no objection and we have one gentleman here. Mr. Timothy : The only people contacted was the property adjoing the property on each side. There were only three people contacted and that was Adam Mosier, Mr. Flader, who owns the whole section to the south of it and Mr. Glover. We felt that that should he adequate because they cover 3/4 of the adjoining property. Mr. Dunbar: Mr. Timothy: Mr. Dunbar: What was their reaction? They were in favor - they signed the Do you have additional ground there, Mr. Munger Just the half section. 12 Mr. Andersen: Now this parcel of land that was withheld - is that the l wing quarters or -- Mr. Bohlender: No that is the right of way of the Speer Canal. Mr. Telep: Bill, I would like to ask one question here in order to clarify things of the people who are present here this morning other than Mr. & Mrs Munger - they are in the favor of granting this variance - or the change of zone from agriculture to industrial. Let the record show that all the people here and that is Mr. and Mrs. Glover who are neighbors of the Mungers and own adjacent property are in favor of the granting of this change of zone Let the record further show that there is no one present at this hearing in opposition to the granting of this change of zone. Mr. Andersen: I would like to ask one question, how are these packaged - these will be trucked out of there - they will not be left there for any length of time. Mr. Goodwin: No, other than the length of time they are waiting for markets. They will be hauled from there to Platteville or the nearest railroad. Mr. Bohlender: These then are shipped by rail then to the foundaries that process them. Yes, Mr. Goodwin: Mr. Dunbar: Is it your consenus that this would be a permanent installation or will it be more on a temporary basis or will it be dismanteled at a later date? Do you get,caught up? Mr. Goodwin: No, at the present time in the Denver area - around the Tri-County Area there approximately 658,000 cars in backlog now to be disposed of. There are approximately 350,000 of them per year being resole from new automobiles leaving 350,000 more on handle backlog. Pressed steel at the present time can/200,000 of these cars per year in disposing of them. At the present time he is having trouble in burning his cars and he hasn't been operating. 13 Mr. Goodwin: By this time next year we will have over one million cars in backlog in that area alone which will triple itself by not being able to dispose of them. In the meantime I think we can handle approximately 75,000 a year. Until we can get set up to the point where we can use another press. Mr. Dunbar: Is it definite that you are going to go in or is this just a proposal? Mr. Goodwin: No we are going in - we have the machinery bought and it is set up and we are ironing the bugs out of thq(nachinery we are setting up our burners to take all the flaws and things out to make the smog control happy and the Board of Health and as soon as we go into full operation we will move right up here onto the farm immediately and go into operation. But we do need this set-up for future plans in order to keep our up. Mr. Andersen: Do I understand it that you are moving this equipment in from your present location in Denver. Mr. Goodwin: Yes sir, the present location address is 2880 West 60th Avenue. Mr. Andersen: You have heard this request what is your pleasure?
