RESOLUTION
WHEREAS, a public hearing was held on Wednesday, October 1,
1969, at 2:00 p.m. in the Chambers of the Board of County Commissioners
of Weld County, Greeley, Colorado, for the purpose of hearing the
petition of Robert Helmer, 3500 35th Avenue; Greeley, Colorado, re-
questing a change of zone from "A" Agricultural District to "MH" Mobile
Home District, and
WHEREAS, the petitioner was present and represented by his
attorney, Robert A. Ruyle, and
WHEREAS, there was no one present in opposition to the change
of zone, and

WHEREAS, the Board of County Commissioners heard all the
testimony and statements from those present, and
WHEREAS, the Board of County Commissioners has studied
the request of the petitioner and studied the recommendation of the
Weld County Planning Commission as submitted on August 19, 1969,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF
COUNTY COMMISSIONERS that the petition of Robert Helmer, 3500 35th
Avenue, Greeley, Colorado, for a change of zone from "A" Agricultural
District to "MH" Mobile Home District, said area being more particularly
described as follows:
A tract of land situate in the West Half of the Southwest cuarter
(W21SW*) of Section 24, Township 5 North, Range 66 West of the
6th P. M. , Weld County, Colorado, more particularly described
as follows:
Beginning at a point on the South line of said Section 24, whence
the Southwest corner of said Section 24 bears North 89°03'30"
West, 448.26'; thence North 00°11'15" East, 700.44'; thence
South 89°03'30" East, 889. 43' to a point on the East line of
said West Half of Southwest Cuarter (WZSWS ); thence South 00°50'05"
West, 700. 39' to a point on the South line of said Section 24;
thence North 89°03'30" West, 881.83' along the South line of
said Section 24 to the point of beginning, containing 14.24 acres,
more or less,
is hereby granted under the conditions following:
(1) Any water and sanitation facilities to be installed shall be
approved by the State Health Department.
(2) All applicable subdivision regulations, and zoning regulations,
shall be followed and complied with to the satisfaction of the Board of
County Commissioners, Weld County, Colorado.

hearing will be held in the Office of the Board of County Commissioners
of Weld County, Colorado, County Court House at Greeley, Colorado,
at the time specified. All persons in any manner interested in the
following proposed change of zone are requested to attend and may be
heard.

As a quorum was present, the Weld County Planning Commission was ready to do
business.
SUBJECT: Minutes
MOTION: By Mr. Bartels to approve the minutes of the last meeting was mailed
to the members. Second by Mr. Bowles. A unanimous vote of "Aye". Motion
carried.
APPLICANT: Robert Helmer — JAMB, Inc.

SUBJECT: Zone change A - MH
LOCATION: W% SW-} Sec 24 T5 R66 - 14.24 acres
APPEARANCE: Mr. Helmer, Robert Ruyle, Attorney
DISCUSSION: Mr. Ruyle explained they are asking for an extension of the present
mobile home zoning which was granted in 1967. The original zoning is now
fully developed. Mr. Ruyle presented the plan for the entire area. There
are 98 presently and will have 197 when completely developed. The water is
supplied by the Central Weld Water District. A copy of the tract between
Hill IN Park Sanitation District and JAMB, Inc. was presented which takes
care of the sewage. Recreational facilities are in excess of what is re—
quired by the regulations.
MOTION: By Mr. Bartels to recommend approval of the zone change to the Board of
County Commissioners. Second by Mr. Watson. A unanimous vote of "Aye".
Motion carried.
APPLICANT: Orville Shaklee
CASE NUMBER: S-68
SUBJECT: Preliminary plat Char -Ley -Mary Subdivision
LOCATION: NW* Sec 24 T5 R66
APPEARANCE: Mr. Shaklee, Gerald McCrea
DISCUSSION: Recommendation from Traffic Safety Committee to follow the present
street standards. Mr. McCrea presented the plat. Contemplated 6 to 8 lots
per year. Water would be supplied by the City of Greeley. The State Healti
Department has requested additional information on adjoining utilities for
sewage disposal. Percolation tests have been made and is good. The nearest
sanitation district would be Hill IN Park. Mr. Shaklee stated he could not
afford this at this time. Mr. Paul stated septic tanks would have to be
approved by the State Health Department and they strongly urge formation of
sanitation districts.
MOTION: By Mr. Lepore to table the matter at this time. Second by Mr. Bartels.
A unanimous vote of "Aye". Motion carried.
MOTION: By Mr. Watson to disapprove the preliminary plat, there being lack of

AGREEMENT
THIS AGREEMENT made and entered into the date
set forth below by and between, Hill -N -Park Sanitation Dist-
rict, Weld County, Colorado, hereinafter called District,
and JAMB, Inc.
WITNESSETH:
WHEREAS the District owns and operates a sewage
lagoon and
WHEREAS JAMR, Inc. is the owner and operator of
a mobile home park and desires the use 9f. the District's
lagoon and
NOW, THEREFORE, in consideration of the premises
and the mutual promises of the parties set forth below the
parties agree as follows;
1. The District shall process sewage from the
mobile home park presently operated by JAMR, Inc. at the
sewage lagoon owned and operated by the District.
2. JAMR, Inc. shall construct a sewage line from
the said mobile home park to the said lagoon at its own
expense. It shall account in detail to the District con-
cerning the cost of said sewage line.
3. JAMR, Inc. shall pay to the District $2.00
per month per trailer occupying said mobile home park or
$100.00 per month whichever is the greater until September
1. 1969 and thereafter JAMR shall pay the District the
sum of $2.00 per month per trailer occupying said mobile home
perk or $200.00 per month whichever is treater.
4. JAMR, Inc. shall pay to the District the sum
of $3,000.00 upon execution hereof.
5. Should any individual tap on to the sewage
line from said mobile home park to said lagoon that indivi-
dual shall pay a tap fee to the District of $250.00. Should
any commercial organization tap on to said sewage line, the
fee for such tap shall be determined by agreement between
the organization seeking to tap on to said line and the
District.
5. JAMR, Inc. shall have the right to recover
75 and no more of the cost of construction of said sewage
line. Said recovery shall be accomplished as follows;
(a) Of the sun provided for in paragraph 3
above from and after September 1, 1071 50%
cue shall be retained by JAMR, Inc.
(b) $200.00 of the $250.00 fee provided for
in paragraph 5 above shall be paid to JAMR, Inc. 75% of the
commercial tap fee provided for in paragraph 5 above shall
be paid to JAMR, Inc.
7. All payments provided for herein to be made
by JAMR, Inc. to the District shall commence September 1,
1968.

8. This agreement shall expire ten years from the
date hereof. The parties may then renegotiate the terms
hereof.

9. This agreement shall be binding upon the suc-
cessors and assigns of the parties.
