HomeMy WebLinkAbout630204.tiffDEDICATION OF PERPETUAL RIGHT OF WAY ARROWHEAD, SECOND FILING: BE IT RESOLVED, by the Board of County Commissioners,of Weld County, Colorado, that they hereby accept the dedication of perpetual right-of-way over the public roads, streets, highways, easements in behalf of the public, in Arrowhead, Second Filing, being a part of the North Half (Ni) of Section 27, Township 5 North, Range 66 West of the 6th P.M., more particularly described as follows: Beginning at the northwest corner of Section 27, Township 5 North, Range 66 West of the 6th Principal Meridian, said corner being the True Point of Beginning; Thence South 89° 48' 40" East 420.80 feeti Thence South 00° 00' 00" West 887.19 feet; Thence South 90° 00' 00" East 310.00 feet; Thence South 09° 27' 40" West 60.83 feet; Thence South 00° 00' 00" West 990.00 feet; Thence South 90° 00' 00" East 860.00 feet; Thence South 83° 12' 50" East 675.35 feet; Thence South 90o 00' 00" East 346.81 feet; Thence North 35 59' 50" East 72.11 feet; Thence South 20° 19' 00" East 350.00 feet; Thence South 69° 41' 00" West 30.00 feet; Thence South 21° 13' 30" East 385.00 feet to the South line of the North Half (Ni), Section 27, Township 5 North, Range 66 West of 6th Principal Meridian; Thence South 89° 52' 36" West along said South line of North Half (Ni), Section 27, 2,802.06 feet to the West Quarter Corner (Wor.) of said Section 27; Thence North 01° 31' 17" West 2,664.53 feet along the West line of said Section 27 to the Northwest Corner of said Section 27, said Northwest corner being the True Point of Beginning; BE IT FURTHER RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the accompanying plat is accepted and approved for filing, and the public roads, streets, highways, easements thereon shown are accepted by the County of Weld provided, however, that the County of Weld will undertake maintenance of roads, streets, and rights -of -way after they have been constructed by the subdivider, not the County of Weld. McCreery Greeley Colorado Dear Dr. and Mrs. McCreery: rc. et „ In behalf of Lake Arrowhead, Inc., this letter of intent is written in connection with your purchase of Lots 22 and 23, in Block 1, Second Filing, Arrowhead, Weld County, Colorado. It is the intention of Lake Arrowhead, Inc. to bring City of Greeley water and natural gas to the front of your property in the street adjacent thereto (or to the utility easement traversing your property, if circumstances require such a location), without cost to you. This will be accomplished no later than two years from the date of this letter. It should be understood, however, that the cost of physically making the necessary water and gas taps will be your obligation. This is to advise further that irrigation water and rights -of - way for transporting this water to lots in Arrowhead are avail- able, but no effort will be conducted at the present time to make these facilities available to you. It is the intent of Lake Arrowhead, Inc. to develop such irrigation facilities as a necessary requisite of the orderly development of the entire area when a sufficient number of lots have been sold to justify such expenditure. It is contemplated that all users of said water will be charged with their pro rata share for use of water and maintenance of the ditch facilities. No definite assurance can be given at this time as to when such facilities will be available, other than it will be incumbent upon Lake Arrowhead, Inc. to develop the same when a sufficient need arises. Lake Arrowhead, Inc. has no present contemplation of hard sur- facing highways in the area, but proposes to construct roads of Dr. and Mrs. Donald C. McCreery Page 2 May 14, 1963 a nature equivalent to that now utilized across the dam. Lake Arrowhead, Inc. agrees to furnish you with good and mer- chantable'title to the above described lots and to furnish you at its expense with either an abstract duly certified to at least the date of this letter or a title policy. Lake Arrowhead, Inc. indicates that it intends to be bound by its commitments herein contained and under the terms and con- ditions herein specified.
