Anderson, Chairman County Courthouse Greeley, Colorado 80631 Dear Mr. Anderson: The official files of this department reflect that Weld County, Colorado is the owner and operator of an asphalt batch plant that has been operating periodically in an area of the state where the emission stan- dards provided in the Air Pollution Control Act are in force and effect. In August 1967, this operation was observed to be in violation and you were officially notified to that effect on September 8, 1967. Since that date personnel from this department and the Weld County Health Department, through conference, conciliation and persuasion, have endeavored to abate the problem. The plant was last inspected on August 7, 1969 and it was found that air pollution control equipment to reduce the emissions of dense smoke has not been installed and the emissions therefrom were in violation of the law (Section 66-29-5 (a), (b), (c) and (d), Colorado Revised Statutes 1963, Vol. 10, Perm. Cum. Supp. 1967). Accordingly, the division finds that efforts to abate the violation through conference, conciliation and persuasion have failed and that further violations should not be permitted to continue unabated and that a period of five days from and after the date of receipt of this order is a reasonable time within which the County shall comply therewith. NOW THEREFORE you are hereby ORDERED to CEASE AND DESIST the practice of emitting smoke and air contaminants from your asphalt batch plant that violate the emission standards of the "Air Pollution Control Act," as above specified, within five (5) days from and after the date of receipt of this order. Please be advised that the Board and its Counsel have throughly studied your letter and have noted its contents. In view of the fact that time is of the essence, and tW eld County may be placed in a position of undue hardship, we respectfully ask that a hearing be had before your Board in order that Weld County may be granted a temporary stay of execution of your Order and that Weld County might be granted some additional time in which to bring its asphalt batch plant within the standards of the Act. GREELEY DAVID WERKING, DOS, GREELEY IBv CERTIFIED MAIL -No. 157997 JUL This letter is to confirm our meeting of June 27, 1974 with, Mr. Ralph Patten, operator of the Weld County Asphalt Plant located approximately two miles north, two miles east of Pierce, CO. (NWT, Sec 7, T8N, R65W) and our meeting with your- self and Mr. Glenn Billings, County Commissioner on July 2, 1974. At these times, we discussed the fact that no permit to operate this plant had been granted under provisions of Regulation 3(III)(A-I) of the Colorado Air Pollution Control Commission governing the Authority to Construct and Permit to Operate. The County had submitted a proper format for modification of the emission control devices on the asphalt plant under provisions of Regulation 3 of the Colorado Air Pollution Control Commission and authority to construct the new controls on August 10, 1972. The expiration date of this authority to construct permit was February 10, 1973. We also discussed the excessive particulate emanating from the asphalt plant dryer stack on June 27, 1974. An opacity violation in excess of 20% was noted from approximately 2:13 P.M. to 2:22 P.M. on June 27, 1974. Pursuant to the provisions of Section 3-16-2, Colorado Revised Statutes 1963, as amended (Perm. Cum. Supp.) and Sections 66-31-4, 66-31-8, 66-31-9 and 66-31-12 of the "Air Pollution Control Act of 1970" (Ch. 64 C.S.L. 1970), Regulations 3(III) (A) and (B) and Regulation 1(A)(1) are as follows: Reg. 3(III)(A): No person shall begin operation of any new air contamination source mentioned in II(B) of this Regulation without notifying the Division at least thirty (30) days prior to operation. Reg. 3(III)(B): No person shall cause or permit the operation of any new air contamination source mentioned in II (B) of this Regulation without applying for a permit to operate from the Division. Box 758 Greeley, Colorado 80631 Gentlemen: OFFICIAL NOTIFICATION OF VIOLATION and CEASE AND DESIST ORDER You are hereby notified that investigation by the Colorado Department of Health and the Weld County Health Department has established that your operations within and upon the site of the County of Weld's asphalt plant located northeast of Pierce, in the County of Weld, State of Colorado, is in violation of Regulation No. 1, Section I.A.1. as adopted by the Colorado Air Pollution Control Commission pursuant to the Colorado Air Pollution Control Act of 1970. Regulation No. 1, Section I. A. 1. reads as follows: 1. I. A. 1: "No person shall emit or cause to be emitted into the atmosphere, from any air contamina- tion source of emission whatsoever, any air contaminant which is of such a shade or den- sity as to obscure an observer's vision to a degree in excess of 20% opacity. Instrumen- tation which results in equivalent readings may be used in specific installations if ap- proved in advance by the Air Pollution Con- trol Division. (25-7-108 (2) and (2) (a)." With respect to regulatory provisions of Regulation No. 1, Section I. A. 1, an inspection of Weld County's asphalt plant was conducted August 14, 1975 by Mr. Ronald K. Stow, a representative of the Weld County Health Depart- ment. The inspection was conducted to observe and record emissions emanat- ing from the asphalt plant in terms of opacity. Excessive emissions rang- ing from 55% to 85% opacity were observed emanating from the asphalt plant dryer stack on August 14, 1975 for an eight -(8) minute period, beginning at Board of County Commissioners Weld County Page 2 August 27, 1975 2:20 p.m. and ending at 2:28 p.m. Neither the Weld County Health Depart- ment nor the Colorado Department of Health, Air Pollution Control Division, had received any reports of upset conditions in explanation of said exces- sive emissions concerning operations of Weld County's asphalt plant for the time period specified above. WHEREAS, the Air Pollution Control Act of 1970, Section 25-7-110, requires the Air Pollution Control Division to enforce compliance with emission con- trol regulations promulgated pursuant to the provisions of Sections 25-7- 108, 25-7-109, and 25-7-112 of said Act, including the enforcement of Regu- lation No. 1, and WHEREAS, on September 18, 1973 the Weld County Health Department, as agent of the State of Colorado, issued you a CEASE AND DESIST ORDER against the subject asphalt plant, based on violations of Regulation 1. I. A. 1 (as set forth herein above),in particular, a violation in excess of 20% opacity (100% opacity observed --see attached Field Work Sheet), based on observation on September 5, 1973 between the hour of 1:57 and 2:05 p.m. on said date, and of Regulation No. 3,III A. and B. (see attached). Said CEASE AND DESIST ORDER remains fully effective and enforceable and is not rendered unenforce- able by the instant CEASE AND DESIST ORDER issued on the basis of the later observation and is not abated by reason of your seasonal termination of op- erations in 1974. Your request for hearing should respond to both observed violations and, as regards the violation of Commission Regulation No. 3, answer your failure to install the high -efficiency wet fan exhaust scrubber for which an Authority to Construct was issued by this office November 27, 1974, the State Engineer's office having granted you a well permit to enable the operation of said control device on or about July 3, 1974. NOW THEREFORE, pursuant to the provisions of Sections 25-7-110 and 25-7-113 of said Act, the Division hereby issues this NOTIFICATION OF VIOLATION of the regulatory provisions of Regulation No. 1, Section I. A. 1, based on the observation herein above stated and further hereby orders the County of Weld, its agents and employees to CEASE AND DESIST the operation of said asphalt plant, immediately, upon receipt of this Notice and Order, for rea- sons of said plant violating Regulation No. 1, Section I. A. 1 on the occa- sions herein above stated, hereby intending to pursue enforcement action of the earlier CEASE AND DESIST ORDER of September 18, 1973. These ORDERS shall become final upon receipt, unless within twenty days af- ter receipt a request in writing is made for a hearing pursuant to provi- sions of Section 25-7-113 (4) (a) (I), (II) and (III) of the Colorado Air Pollution Control Act of 1970 (see attached excerpt). You may file said request for a hearing with the Commission or Variance Board to determine any one of the matters included within the provisions of said Section 25-7-113(4) aforesaid. You are further notified that your request dated Board of County Commissioners Weld County Page 3 August 27, 1975 August 8, 1975, directed to the Weld County Health Department, requesting permission of said office to grant you a variance to operate the violating asphalt plant subject hereof from August 11, 1975 to September 30, 1975 has no force and effect to stay the effectiveness of this Order, for the reason that only the Colorado Air Pollution Variance Board has the juris- diction and authority to hold hearings, and as a result thereof, to grant variances from applicable regulations of the Commission. Such request cannot be considered a request to the said Variance Board for the purposes of this action, since it is not deemed to be responsive to the action taken by the Division pursuant hereto.
