AUTHORIZING COMMISSION' DISTRICT NO. TWO
TO SIGN REQUEST AND AGREEMENT WITH THE
FRANKLIN LAND COMPANY=

WHEREAS, the Franklin Land Company has requested approval to make certain
changes onxFourth Street atXTwenty-sixth Avenue Court in Greeley, Colorado, thereby
complying with axdrainage program previously approved by the City of Greeley and the
FHA officials; and
WHEREAS, in consideration of the approval to the foregoing request, the
Franklin Land Company agrees to save the said City and Weld County harmless from and
to indemnify them against any and all liability and damages that might result from
the granting of said request; and
WHEREAS, the Board believes it to be to the best interests of the County
to grant same.
NOV, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld
County, Colorado, that the Commissioner of District No. Two, Elmer L. Shultz, be and
he is hereby authorized to sign the request and agreement with the Franklin Land Com-
pany, according to the terms and conditions setforth in said agreement, a copy of which
is hereto attached and made a part of this resolution.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote,

Is behalf of our clients, the Framklia Lead Company, developers of Broad-
view Acres Subdivision we herewith request your appewal of the work described
heroin. This work is to be seeemplishsd os Fourth Street at 26th Avenue
Court. Fourth Street at this point is partially is the City of Greeley
mad partially is weld County.
The work shall consist of the levering of the csaterlise of Fourth Street
as shame on the omslosed plans. The work would Is assempliahsd by bladisg

proper curing a single seal of IC 3 asphalt and chips would be applied in
acosrdaass with City of Greeley Spsciticatiou.
It is understood that the completed work will be equal to or better than
the present primmest is lts quality end that all at will be aoamplishsd
by the Franklin Lead Cowpony without cost to the City of Greeley or to
Weld County.
The purpose of this work is to lamer Fourth street at the said intersection
as that the storm water tres a $0 year design storm sea pass this inter-
secties without inundating the adjacent FM► mortgaged homes. This will
comply with a trainees program previously approved by the City of Oroulsy
and the FHA officials.

The City of Greeley, Colorado
Petitioners, whose names are affixed hereto, state and represent
as follows:
That requests have been made of the County of Weld and City of
Greeley that Fourth Street at its intersection with 26 Avenue Court
be lowered or graded to permit access from 26 Avenue Court unto
Fourth Street.
That if the roadway is lowered waste, drainage and flood waters
will be directed from their natural drainage course and basin unto
lands North of and below Fourth Street to the great damage of the
petitioners hereto.
That the proposed grading would cause a swale or depression in
Fourth Street creating serious traffic and maintenance problems on
a roadway that is heavily traveled and will become more so as the
area is developed.
Thar: Lo permit said grading would relieve the developers of
subdivision lands to the North thereof of their just and legal
obligation to properly dispose of run-off water created as the result
of their own acts and would impose serious burdens on petitioners,
the County, City and others to provide facilities for the proper
disposal of such waters.
Wherefore the undersigned petition and request that the grade
and level of Fourth Street at said point be maintained as the same
now exists; and that the matter of the proper drainage of said
subdivision be taken up by the County and City Planning Commissions
with the developers thereof.
