WHEREAS, on May 17, 1967, a public hearing was had for the purpose
of hearing protestants, if any, regarding a change of zone from "A" Agricultural
District to "MH" Mobile Home District as requested by Herbert J. Nusser of
Route 4, Box 193, Greeley, Colorado, said area more particularly described as
follows:
A part of the Northeast Quarter of the Northwest Quarter (NE-41NW4)
Section 13, Township 5 North, Range 65 West of the 6th P. M.,
Weld County, Colorado, containing 7.36 acres, more or less
and
WHEREAS, there appeared no protestants to said change of zone.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that they hereby agree to uphold the recommendations
of the Weld County Planning Commission by granting said change of zone in the
Delta Area as requested by Herbert J. Nusser.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

Marshall Anderson: We will call the hearing to order, Mr. Telep will you
read the legal notice?
Mr. Telep: Let the record show that the following notice was read
pursuant to said notice same was published:
"Pursuant to the zoning laws of the State of Colorado, a public
hearing will be held in the Office of the Board of County Commissioners,
of Weld County, Weld County Court House, Greeley, Colorado, on May 17,
1967 at 1;30 P. M. O'Clock on the petition of Herbert J. Nusser of
Route 4 Box 193, Greeley, Colorado, requesting a Change of Zone from
"A" Agriculture to "MH" Mobile Home District in the Delta Area more
particularly described as follows:
A part of the Northeast quarter of the Northwest quarter
of Section 13, Township 5 North, Range 65 West of the
6th P. M. Weld County, Colorado, containing 7.36 acres m/1
Dated this 12th Day of May 1967 by the Board of County
Commissioners, Weld County, Colorado, By Ann Spomer, County
Clerk and Recorder and Clerk to the Board. Published twice
in the Greeley Booster April 14 and May 5."
Marshall Anderson: At this time we will hear from anyone opposing the
Change of Zone. If there is no opposition we will hear from the
people requesting the Change of Zone.
Herbert Nusser: Mr. Anderson, I am Herbert Nusser, owner of Riverside
Court I don't quite know how to present this but it was recommended
to me by the Planning Commission to change from agriculture to mobile
home because it was organized or set up before the zoning went into
effect, before the Planning Commission was organized or any zoning
was in effect.

Marshall Anderson: In other words this is more or less complying with
the county zoning.
Mr. Nusser: Yes, you see the Planning Commission was in 1963
and I was started in 1965 I believe.
Marshall Anderson: Is there anyone else who would care to make a statement
on this change of zone?
Mr. Telep" I might add Mr. Chairman - what was the recommendation
of the Planning Commission?
Marshall Anderson: The Planning Commission voted unanimously to grant this
change of zone.

It is about 7.3 acres - 7.36 What is the pleasure
In view of the Planning Commissions recommendation and
in view of the fact that there is no opposition to the zone request
I would entertain a motion to grant the change of zone from "A" to
"M H„
Harold Anderson: I second the motion.
Marshall Anderson: I will make it unanimous that the change of zone be
granted as recommended by the Weld County Planning Commission. The
hearing is adjourned.
