AND AGREEMENT WITH MINER AND MINER, INC.:
WHEREAS, a contract and agreement has been submitted by Miner and Miner, Inc.,
consulting engineers, Greeley, Colorado, providing engineering services in connection
with the heating and air condition modifications for the Weld County Courthouse; and
WHEREAS, after due consideration, the Board believes it to be to the best inter-
ests of the County to sign said contract and agreement.
NOW, THEREFORE, BE IT RESOLVED, that the Chairman of the Board of County
Commissioners, Weld County, Colorado, be and he is hereby authorized to sign the afore-
mentioned contract and agreement, attached and made a part of this resolution.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote:

Subject: Heating & Air Condition Modifications
Weld County Courthouse
Gentlemen:
This will acknowledge receipt of your letter of October 4, 1962,
authorizing us to proceed with the engineering in connection with the
subject project.
We will provide complete engineering services for the subject facilities
including all necessary conferences with the Board of County Commissioners
and the Building Engineer, final working drawings and specifications to
permit selection of a contractor(s) by competitive bidding, and general
supervision of the work.
We shall effect and maintain workmen's compensation coverage as required
by law, and we shall pay all unemployment insurance and social security
taxes due in connection with work performed under this proposal.
We shall maintain personal injury and property damage insurance at all times
while engaged in performance of the proposed work in the following amounts;
and we shall furnish you, if requested, with effective certificates of insurance
for same:
Bodily injury liability
other than automobile
Property damage liability
other than automobile
$100,000 each person
$300,000 each accident
$ 25,000 each accident
$ 50,000 aggregate

We shall assume the defense of and save you harmless from all suits or claims
of any name or description brought against you for or on account of injury or
damage to person or property, received or sustained by any person or persons
on or about or in connection with the work performed under this proposal,
however the same may occur; provided that said injury or damage arises from
or is incidental to the performance of the work under this proposal.
We propose that you shall pay and we shall accept in full payment and satisfaction
for all services rendered including all labor, subsistence, equipment, transportation
and materials expended or used in the performance of service under this proposal
the amount specified as follows:
Seven (7%) percent of the total cost of construction, of which
Twenty (20%) percent will be payable on approval of preliminary
drawings; Sixty (60%) percent will be payable on completion of
working drawings and specifications;
Final twenty (20%) percent will be payable on completion of
construction and final acceptance of building.
We are proceeding with the work as authorized in your letter of October 4, 1962.
We appreciate the opportunity to present this proposal and shall look forward to
working with you.
