Ni". Jerry Sevin of this office previously contacted the Board regarding
rights of entry to install underground cables under and across the highways
of Weld County. In Civil Number 6912, Weld County is named as a party
defendant and has no doubt been served. Because of the military necessity
and a time requirement to secure rights of entry plus the fact the County's
interest in the roads and highways was unknown, the County was named a
party to the suit.
However, it is desirable, if possible, to negotiate a voluntary right
of entry for survey exploration and construction. Inclosed is draft copy
of a letter permit in triplicate for right of entry which may be used for
granting immediate right of entry to the United States of America, conditioned
on the contractor, prior to construction, coordinating with your representative
construction and procedures, underground cables will cross under the road
right o£ way at the place of crossing. No specifications are available and
the exact location of the crossings are not known. If a voluntary right of
entry and later a voluntary agreement as to the exact locations can be
negotiated, the county will be dismissed as a party to condemnation action.
The letter should be signed by the County Board and two copies returned to
this office. The third copy may be retained by you. Because of the
military necessity and a time requirement, it is desirable that the
United States be granted a letter permit for immediate right of entry.
