The minutes of August 16, 1961 were read and approved.
The following resolutions were passed by the Commissioners.
WHEREAS, Joe Smith Machinery, Denver, Colorado has offered $750.00
for one 1948 Seaman Pulltype Mixer, Model MHD 72-28-2 and,
WHEREAS, the Board believes it to be to the best interests of the
county to accept said offer.
NOW, BE IT RESOLVED, that the Chairman of the Board of County Com-
missioners, Weld County, Colorado, be and he is hereby authorized to convey one 1948 Sea-
man Pulltype Mixer, Model MHD 72-28-2, County Number 278, to Joe Smith Machinery Co.,
Denver, Colorado.
Reference is hereby made to Weld County Receipt Number 17989.

BOARD OF COUNTY COMMISSIONERS of

Respondents.
Complaints, by their attorneys, Houtchens and Houtchens, allege:
1. The value of the property in controversy or the amount involved
for which relief is sought in this action does not exceed the sum of $2,000.00.
2. Respondents are, and were at all times hereinafter mentioned,
the duly elected, qualified and acting members of the Board of County Commissioners
of Weld County, State of Colorado.
3. By virtue of their office as members of the Board of County
Commissioners, respondents are vested with the duty of issuing beer, wine and spirit-
uous liquor licenses as provided by Ch. 75, Art. 2, C.R.S., as amended.
4. On June 20, 1961 complainants filed their application in proper
form with respondents for a license to sell beer, wine and apirituous liquor at re-
tail, said application complying in every respect with the provisions of Ch. 75, Art.
2, C.R.S., as amended; thereafter and on July 19, 1961, the date set for hearing on
said application, a hearing was held by respondents; that said date, time and place
of the hearing was set by respondents. Complainants have fully complied, in all re-
spects, with every provision of said Ch. 75, Art. 2, C.R.S., as amended.
5. Respondents on August 9, 1961, denied complainants' application
without legal justification or cause.
6. Said action of the respondents in denying complainants' application
was and is illegal, arbitrary and capricious, without good cause, contrary to undisputed
evidence and a gross abuse of discretion and denies complainants due process of law, in
that the undisputed evidence before respondents was and is that complainants have fully
complied with every provision of Ch. 75, Art. 2, C.R.S., and therefore was legally en-
titled to the license applied for.
WHEREFORE, complainants pray that this Court make and enter an order
directed to respondents, (1) to certify to this Court a full and complete transcript
of all the documentary and other evidence had in this matter before the respondents;
(2) to certify a full transcript of any oral testimony taken before the Board; (3) to
show cause why the license referred to in complainants' application should not be
granted; that such evidence be taken as may be necessary for the proper disposition of
the issues herein, and for such relief as may appear.

WHEREAS, the Board of County Commissioners, having examined the said
application and the other qualifications of the applicant do hereby grant License Number
716 to said applicant to sell 3.2% beer only at retail, at said place, and do hereby author-
ize and direct the issuance of said license by the Chairman of the Board, attested by the
County Clerk and Recorder of Weld County, good for one year from the date of issue unless
revoked, according to law, provided, however, that said license shall be issued upon the
express condition and agreement that the place where licensee is authorized to sell beer
under said license will be conducted in strict conformity to all laws of the State of Colorado
and rules and regulations relating thereto heretofore passed by the Board of County Commis-
sioners of Weld County, Colorado and any violation thereof shall be cause for revocation of
the license.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

WHEREAS, Sinclair Refining Company has submitted a low bid of 19.49t
per gallon including state tax to deliver Ethyl gasoline for an approximate period begin-
ning August 23, 1961 and ending December 23, 1961, and
WHEREAS, the Board of County Commissioners believes it to be to the
best interests of the county to accept said bid.
THEREFORE, BE IT RESOLVED, that the Board of County Commissioners
does hereby accept the bid from Sinclair Refining Company for gasoline to be delivered to
the Weld County Shop in the amount of approximately 100,000 gallons as per bid attached
hereto.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

The respondents by their attorney, Samuel S. Telep, answer the com-
plaint herein as follows:
1. Respondents admit the averments of Paragraph 1 and 2 of the
complaint.
2. In answer to Paragraph 3 of the complaint, respondents deny that
said Board is vested with the duty of issuing liquor licenses under Chapter 75, Article 2,
1953 Colorado Revised Statutes, but that said Board under said law is the local licensing
authority for Weld County with the authority and discretion of granting or denying said
licenses under the terms and provisions of said law.
3. Respondents admit the averments of Paragraph 4 of the complaint.
4. Respondents deny the averments of Paragraphs 5 and 6 of the
Application for Beer, Wine and Spirituous Liquor License to
State of Colorado, Ex Officio State Licensing Authority,
Application to the Board of County Commissioners of Weld
County, Colorado, and Affidavit of Clerk and Recorder of
the County of Weld, with check payable to Weld County,
Colorado, in the amount of $325.00, and check payable to
Secretary of State, in the amount of $25.00, attached.

Following is a comment taken from the Report of Examination for the
Six Months Ending June 30, 1961, prepared by Dunham, Stephenson and Associates, Cer-
tified Public Accountants:
"We noted that certain amounts paid to county officers
and employees for mileage and meal allowances (expense
vouchers) were not supported by receipts or details of
expenses incurred. We recommend that all claims for
this type of expenditure be fully supported."
In view of the above comment, we are asking those county officers and
employees submitting expense vouchers to comply with the above instructions, giving
receipts wherever possible, or details of expense such as meals, telephone, office rent,
clerical help, etc.

REQUEST FOR MODIFICATION OF WHEREAS, the Greeley Chamber of Commerce has optioned the O. H.
FREEWAY AGREEMENT AT GREELEY, Shearer farm between First Avenue and the Union Pacific Railroad and between 2Oth
COLORADO: Street and 25th Street and intends to develope this area as an industrial Park, and
WHEREAS, the Greeley Chamber of Commerce has requested a grade cross-
ing of the freeway at 22nd Street, to serve this new Industrial area, and
WHEREAS, this Board is desirous of cooperating with the Chamber of
Commerce, and
WHEREAS, the public crossing of the freeway at 22nd Street would be
of benefit to the community and to the City of Greeley, Colorado serving a new indus-
trial area, and
NOW, BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that consideration be given to the request that the Agreement re-
garding the Greeley By-pass on U. S. Highway #85 (State Highway #3) be modified to
include a grade crossing at 22nd Street for the welfare of the County, its people
and patrons.

This matter comes on to be heard this Thursday, September 21,
1961, at 10:00 o'clock A.M., under the Order of August 18, 1961, under which Order Respon-
dents were directed to certify to this Court on or before August 28, 1961, all of the doc-
umentary and other evidence presented in the hearing of the Complainants on their application
before the Board of County Commissioners of Weld County, Colorado, for a license to sell
beer, wine and spirituous liquor, and to show cause on this date why this Court should not
grant the relief prayer for in Complainant's Complaint.
Complaint was filed in this Court August 18, 1961, by Com-
plainants and against Respondents, Board of County Commissioners of Weld County, State of
Colorado, and Elmer L. Shultz, T. V. Reed and Millard H. Ewing, as members thereof, and
Order of August 18, 1961 then entered. Summons was regularly issued and served and Answer
filed by Respondents. Petition in intervention was filed by Intervenors, Ralph Farr, James
Milne, Dr. Alvin Berg, Warren Monfort and R. R. Rose, they requesting permission to intervene
and file their answer, a copy of which Answer was filed with the Clerk August 31, 1961.

Come now the Complainants, Raymond W. Bailey and Floyd A. Sharp, in
person and by their counsel of record Houtchens and Houtchens by S. Robert Houtchens
and John J. Dooley, and Respondents by their counsel Samuel S. Telep. Walter F.
Scherer, Attorney of 834 Majestic Building, Denver, Colorado, appears for the inter-
venors and renews the Petition to permit the Intervenors to appear herein. Counsel
for Complainants object to the granting of the Petition for the reason order was not
before entered granting the Petition of intervention.
The Court finding the Complainants have not been prejudiced by the
delay, it is Ordered the Petition in Intervention and Answer as filed with the Clerk
are accepted andofficially filed with this Court and the Intervenors are given per-
mission to intervene and proceed, represented by their Attorney Walter F. Scherer,
The Respondents complied with the Order of August 18, 1961, and on
August 28, 1961, filed a reporter's transcript of the testimony heard by Respondents
at the hearing of Complainant's application for a license and filed all exhibits and
all documentary and other evidence had in such matter before Respondents at the hearing
on the application for the license, all as listed in the receipt issued by the Clerk of
this Court upon the filing of such matters, as shown by the files. All the parties and
counsel indicate they are ready for hearing. Arguments of counsel are heard, hearing is had,
and the Court being now sufficiently advised,
Finds Respondents acted within their proper discretion in denying the
application of Complainants for a liquor license to dispense beer, wine and spitituous
liquors by the drink and Respondents did not act arbitrarily or capriciously and did
not abuse their discretion in denying the license.
It is ORDERED the action of the Board of County Commissioners of Weld
County, State of Colorado, and the individual members thereof, Respondents herein, in
denying the application for the license applied for by Complainants be and the same is
affirmed and sustained by this Court and it is Further ORDERED Complainant's Complaint
be and the same is dismissed at their costs.
Petition for a rehearing is dispensed with and the Court makes this a
final Findings and Judgment and all rights of Appeal or for Writ of Error are preserved
to Complainants.

owner of
Lots 7, 9, 17 and 19, in Block 9, and Lot 9 in Block 14,
all in the Town of Mead, Weld County, Colorado, and
WHEREAS, said property, excepting therefrom the oil, gas and other
minerals therein; has been duly advertised for sale at a public auction held on Sept-
ember 13, 1961 at the hour of 1:30 o'clock, P.M., in the office of the Board of County
Commissioners, and
WHEREAS, at said sale, Jacob W. Stotts and Dorothy K. Stotts, as
joint tenants and not as tenants in common, Mead, Colorado, bid $190.00 as the pur-
chase price for said property and, being the highest and best bidder, said property was
sold to said Jacob W. Stotts and Dorothy K. Stotts, as joint tenants and not as tenants
in common, Mead, Colorado.
NOW, THEREFORE, BE IT RESOLVED, and it is hereby ordered that Charles
0. Bursiel, County Treasurer of Weld County, Colorado, is hereby constituted and appoint-
ed as Commissioner of Weld County, Colorado, to make a conveyance, by quit claim deed,
of said property, as aforesaid, to said Jacob W. Stotts and Dorothy K. Stotts, which
property is more particularly described as follows, to -wit:
Lots 7, 9, 17 and 19, in Block 9, and Lot 9 in Block 14,
all in the Town of Mead, Weld County, Colorado
except reservations in favor of the Union Pacific Railroad Company and except reservations
in the United States Patent and reserving existing reservoir sites and irrigation ditches,
if any, existing rights of way for public highways and roads, and to any and all existing
easements or rights of way, however evidenced or acquired, and subject to existing leases
and reserving therefrom. to grantor, all oil, gas and other minerals therein or thereunder.
IT IS FURTHER ORDERED, that to such conveyance, the said Charles 0.
Bursiel, County Treasurer, is authorized to affix the seal of said County and said con-
veyance, when executed according to this order, shall have the effect to transfer to said

WHEREAS, satisfactory affidavit and bonds necessary to indemnify
and hold Weld County Harmless on account of alleged loss of original Warrant have been filed
in the office of the Board of Commissioners.

The Director distributed the copies of the 1962 Budget Message
to each of the Commissioners. He suggested that this material should be used in conjunc-
tion with the budget request for the 1962 year, and would be willing to discuss any item
in the Budget Message which the Commissioners might have questions on. Mr. Reed suggested
that the copies of the Budget Message should also be made available to other interested
groups.

The Director reported that he had had a meeting with the Economics
Committee of the Weld County Medical Society and had discussed the anticipated needs
for 1962 for physicians' services. The Department and the Exonomics Committee have
been studying the use of physicians'services and have tested the costs for care against
a reduced fee schedule worked out by the Committee and the Director and approved by
the Medical Society. This study indicates that there should be in increase of approxi-
mately $15,000.00 in 1962 for physicians' services in the home and office. The Medical
Society pointed out that they are also giving a great deal of service in the hospital
for which the Society is paid at the rate of $500.00 per month. The Committee indicated
that the Society is not requesting any increase for this service, however. The Committee
has indicated that they wish to meet with the Board of County Commissioners and the Di-
rector in the near future to discuss their needs for 1962.
The Director recommended that a surplus commodity distribution program
be established approximately November 1 in Weld County. He pointed out that for the
remainder of 1961 in estimating expenditures, an amount of approximately $1,500.00 had
been included for the establishment of the commodity program. He also pointed out that
an amount of $8,000.00 for cost of distribution and a salary for a commodity clerk had
been includedin the 1962 expenditures. The Board instructed the Director to do the pre-
liminary work necessary in establishment of the commodity program. It is anticipated that
the Board and the Director will made a visitation to Larimer County to examine their com-
modity program.
The Director discussed with the Board plans for attendance of the
Board and the Director at the Biennial Meeting of the American Public Welfare Association
November 29 through December 2, 1961 in Chicago. All Board members are interested in
attending this program since it is felt that it will be of significant value in the ad-
ministration of the public welfare program. Plans for attendance were not finalized,
however.
The Director recommended that the Board members attend the Colorado
Conference of Social Welfare to be held in Denver the week of September 24. He pointed
out that a special program has been planned for county commissioners around the matter
of problems of non-support. This is to be scheduled for Tuesday, September 26. The
Board indicated that they were interested in attending this meeting.
Since there was no further business, the meeting was adjourned to
4:00 p.m.

The State Board of qualization, having duly let in accordance with law, has
fixed the assessed valuation of the State for the year 1961 at 't?,69p,''.',335., and
has fixed the mill levy "or the year 1961 for State purposes at 1.45 mills, to be
distributed to the various State funds as shown on Schedule "A" attached hereto
and made a part hereof.
The valuation of your County for the year 1961, as fixed by the State Board of
qualization, is as shown on the attached Schedule "B" and your County has been
charged with State taxes on that valuation.
Your attention is directed to the following special taxes to be levied:
Section S-7-4, CRS, 1953, as amended, provides for a tax levy of twenty (20)
mills on each dollar of assessed valuation on all sheep and goats, except those in
feed lots, to be paid into the State Treasury and credited to the Predatory Animal
Fund.
Section A-1¢-2, fRS, 1953, as amended, provides for a tax levy of three (3)
mills on each dollar of assessed valuation on all sheep and goats in Colorado
(except those in feed lots) to be levied and collected as other State taxes end
paid into the State Treasury; to be kept in a separate fund which shall be known
as the Vibrio Fund, from which a total of not more than fifteen thousand dollars
( 11,000.00) per year shall be made available to Colorado State University according
to the provisions of the act.
Section 92-34-1, CRS, 1953, as amended, provides that there shall be levied
and collected a tax equal to one -tenth of one percent upon assessed valuation of
all producing and non -producing metalliferous mining property, including lode claims,
placer and mill sites together with all improvement thereon, to be forwarded to the
State Treasurer and credited to the Metal Miningnd.

The following resolutions were passed by the Commissioners.
WHEREAS, the Board of County Commissioners is confronted with the
problem of increased costs of operating the Weld County Nursing Home, and
WHEREAS, the present daily room rates charged to and paid by present
pay patients in said Weld County Nursing Home do not cover the actual costs incurred
by the County for their care and keep, and
WHEREAS, the Board has determined that to meet the increased costs
of operating said Weld County Nursing Home, and in order to provide the services that
it has been accustomed to providing to all such pay patients, all daily room rates of
pay patients at said home must be increased.
NOW, THEREFORE, BE IT RESOLVED, that beginning December 1, 1961, and
thereafter until further order of the Board, all charges made to present pay patients
of the Weld County Nursing Home shall be increased $2.00 per day per patient; and that
all new pay patients at said Weld County Nursing Home on and after date of this resolu-
tion shall be charged at the rate of $10.00 per day for private room, and $9.00 per
day for semi -private room.

In the matter of creating a Supplemental Public Works Fund for a
Fourth Floor Addition to the new hospital wing, and to provide and accumulate funds for
constructing and equipping same:
WHEREAS, by Resolution passed October 19, 1958, the Board of Weld
County Commissioners did create in the office of the County Treasurer the Public Works
Fund -Hospital Addition and allocated same to the construction of a three (3) story
wing to the Weld County General Hospital, and
WHEREAS, the Board of Trustees of the Weld County General Hospital
and its architects have demonstrated and recommended that an additional one (1) floor
should be added to the three (3) floor wing heretofore authorized to be constructed;
that such Fourth Floor Addition is advisable and necessary in the public interest of
Weld County.
NOW, THEREFORE, BE IT RESOLVED, that for the purpose of providing
and accumulating funds for the construction and completion of the additional floor
to the new hospital wing, a Public Works Fund which shall be known as the Supplemental
Public Works Fund -Hospital Addition is hereby created and that a levy of .75 mill be
made and levied on each dollar of real property value in Weld County; that to enable
the additional floor of the new hospital wing to be completed, there will be needed
an additional $115,000.00 and requiring a tax levy of .75 mill as hereinabove stated,
which levy shall be made for the year 1962 only;
Provided, however, that said levy shall not be effective until after
a public hearing on the said proposal for such proposed levy; that which such hearing
is hereby called and set for October 25, 1961, at the office of the Board of County
Commissioners in the Weld County Court House.
BE IT FURTHER RESOLVED, that public notice of such hearing shall be
given by publication of a notice thereof, same for said time and place in the official
newspaper of said County;to-wit: The Greeley Booster, a public newspaper, not less
than ten days before such hearing.
The above and foregoing resolution was, on motion duly made and

all requirements of said Mobile Homes and Mobile Home Parks, and
WHEREAS, the regulations have met with the approval of the
Board of Weld County Commissioners,
THEREFORE, BE IT RESOLVED, that the Official Mobile Home and

Section 62, Page 437, as amended First Extraordinary Session Laws, 1953, Chapter

the Board of County Commissioners shall apportion such Oil Royalties received
under the Federal Leasing Act received by them between the school fund and the
road fund, provided that not more than seventy-five percent of said money shall
be apportioned to either of said funds, and
WHEREAS, the Board believes it to be to the best interests of
said county to apportion said money equally to both funds.
NOW, BE IT RESOLVED, by the Board of County Commissioners of
Weld County, Colorado, that they hereby apportion fifty percent of the oil
royalties received under the Federal Leasing Act by them to the school fund
and fifty percent of said royalties received by them to the road fund.

The following resolution wag passed by the Commissioners.
The BOARD convened at 2:00 pm., this 23rd day of October, 1961.
All the members of the Board were present. Mr. Tito Garcia, Com-
modity Clerk, was also present.
1. A discussion of the program of Farm Surplus Commodity Dis-
tribution was the first item on the agenda. Mr. Tito Garcia, Commodity Clerk, was intro-
duced to the Board. The required agreement between the State and County in order to initiate
this program was discussed. The two copies of the Agreement were then signed by the Commis-
sioners.
Various locations for a warehouse in Greeley were discussed.
The Director requested that the Board consider making available some space at Island Grove
Park. However, it was determined that due to the needs for space during fair time that space
would not be available for this program. A search for adequate space at a reasonable rental
will continue to be made.
The Director indicated that the date of first distribution
would be approximately November 15 if space were made available. The Commissioners agreed
that the program should be initiated as soon as possible.
II. The Director presented certain recommendations to the Board in
regard to certification and payment for hospital care of indigent non-public welfare cases.
He pointed out that the hospital bill for the month of September exceeded $14,500.00. This
was the third largest billing received to date this year. Approximately $6,500.00 of that
amount was for non-public welfare cases. The Director had previously indicated that addi-
tional restrictions might have to be placed on this program if the Department were to stay
within a reasonable amount. The following recommendations were made and adopted by the
Board of Commissioners:
A. No bills for indigent non-public welfare cases referred
by the hospital less than $50.00 are to be accepted.
B. The standards for determination of eligibility for indigent
non-public welfare cases are reduced to 80% of Aid to De-
pendent Children standards.
C. Whenever possible, partial payment by the recipient and
the County is to be arranged.
III. The Directos also made certain recommendations in regard to the
General Assistance Program which are to be considered as temporary Measurers until a full study
of the General Assistance Program is accomplished. The recommendations were approved as
follows:
A. No assistance is to be given to employables until thirty
days after their last full employment.
B. All employable persons must be registered with the Colorado
Employment Service.

unclaimed funds presently in possession and control of the Weld County Treasurer
shall be transferred to the County General Fund.
NOW, THEREFORE, BE IT FURTHER RESOLVED, that Charles 0. Bursiel,
as County Treasurer of Weld County, Cola'ado, be and is hereby authorized to transfer
the funds hereinabove mentioned to the County General Fund and to be used as needed
in the conduct of the affairs of Weld County.
