The value of the property in controversy or the amount involved for which relief is sought in this action does not exceed the sum of $2,000.00. 2. Respondents are, and were at all times hereinafter mentioned, the duly elected, qualified and acting members of the Board of County Commissioners of Weld County, State of Colorado. 3. By virtue of their office as members of the Board of County Commissioners, respondents are vested with the duty of issuing beer, wine and spirit- uous liquor licenses as provided by Ch. 75, Art. 2, C.R.S., as amended. 4. On June 20, 1961 complainants filed their application in proper form with respondents for a license to sell beer, wine and apirituous liquor at re- tail, said application complying in every respect with the provisions of Ch. 75, Art. 2, C.R.S., as amended; thereafter and on July 19, 1961, the date set for hearing on said application, a hearing was held by respondents; that said date, time and place of the hearing was set by respondents. Complainants have fully complied, in all re- spects, with every provision of said Ch. 75, Art. 2, C.R.S., as amended. 5. Respondents on August 9, 1961, denied complainants' application without legal justification or cause. 6. Said action of the respondents in denying complainants' application was and is illegal, arbitrary and capricious, without good cause, contrary to undisputed evidence and a gross abuse of discretion and denies complainants due process of law, in that the undisputed evidence before respondents was and is that complainants have fully complied with every provision of Ch. 75, Art. 2, C.R.S., and therefore was legally en- titled to the license applied for. WHEREFORE, complainants pray that this Court make and enter an order directed to respondents, (1) to certify to this Court a full and complete transcript of all the documentary and other evidence had in this matter before the respondents; (2) to certify a full transcript of any oral testimony taken before the Board; (3) to show cause why the license referred to in complainants' application should not be granted; that such evidence be taken as may be necessary for the proper disposition of the issues herein, and for such relief as may appear. THEREFORE, BE IT RESOLVED, that the Board of County Commissioners does hereby accept the bid from Sinclair Refining Company for gasoline to be delivered to the Weld County Shop in the amount of approximately 100,000 gallons as per bid attached hereto. Reed and Millard H. Ewing, as members thereof, and Order of August 18, 1961 then entered. Summons was regularly issued and served and Answer filed by Respondents. Petition in intervention was filed by Intervenors, Ralph Farr, James Milne, Dr. Alvin Berg, Warren Monfort and R. R. Rose, they requesting permission to intervene and file their answer, a copy of which Answer was filed with the Clerk August 31, 1961. 120 Come now the Complainants, Raymond W. Bailey and Floyd A. HURD, RT. 4, BOX 29, GREELEY, COLORADO: 4 l SEPTEMBER 6, 1961 MINUTES OF A MEETING OF THE BOARD OF PUBLIC WEL- FARE IN WELD COUNTY, WAS HELD AT 2:00P.M., SEPT. 6th, 1961: 286 122 The Director reported that he had had a meeting with the Economics Committee of the Weld County Medical Society and had discussed the anticipated needs for 1962 for physicians' services. The Department and the Exonomics Committee have been studying the use of physicians'services and have tested the costs for care against a reduced fee schedule worked out by the Committee and the Director and approved by the Medical Society. This study indicates that there should be in increase of approxi- mately $15,000.00 in 1962 for physicians' services in the home and office. The Medical Society pointed out that they are also giving a great deal of service in the hospital for which the Society is paid at the rate of $500.00 per month. The Committee indicated that the Society is not requesting any increase for this service, however. The Committee has indicated that they wish to meet with the Board of County Commissioners and the Di- rector in the near future to discuss their needs for 1962. The Director recommended that a surplus commodity distribution program be established approximately November 1 in Weld County. He pointed out that for the remainder of 1961 in estimating expenditures, an amount of approximately $1,500.00 had been included for the establishment of the commodity program. He also pointed out that an amount of $8,000.00 for cost of distribution and a salary for a commodity clerk had been includedin the 1962 expenditures. The Board instructed the Director to do the pre- liminary work necessary in establishment of the commodity program. It is anticipated that the Board and the Director will made a visitation to Larimer County to examine their com- modity program. The Director discussed with the Board plans for attendance of the Board and the Director at the Biennial Meeting of the American Public Welfare Association November 29 through December 2, 1961 in Chicago. All Board members are interested in attending this program since it is felt that it will be of significant value in the ad- ministration of the public welfare program. Plans for attendance were not finalized, however. The Director recommended that the Board members attend the Colorado Conference of Social Welfare to be held in Denver the week of September 24. He pointed out that a special program has been planned for county commissioners around the matter of problems of non-support. This is to be scheduled for Tuesday, September 26. The Board indicated that they were interested in attending this meeting. WHEREAS, the Board of County Commissioners is confronted with the problem of increased costs of operating the Weld County Nursing Home, and WHEREAS, the present daily room rates charged to and paid by present pay patients in said Weld County Nursing Home do not cover the actual costs incurred by the County for their care and keep, and WHEREAS, the Board has determined that to meet the increased costs of operating said Weld County Nursing Home, and in order to provide the services that it has been accustomed to providing to all such pay patients, all daily room rates of pay patients at said home must be increased. NOW, THEREFORE, BE IT RESOLVED, that beginning December 1, 1961, and thereafter until further order of the Board, all charges made to present pay patients of the Weld County Nursing Home shall be increased $2.00 per day per patient; and that all new pay patients at said Weld County Nursing Home on and after date of this resolu- tion shall be charged at the rate of $10.00 per day for private room, and $9.00 per day for semi -private room. EWING THE BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO In the matter of creating a Supplemental Public Works Fund for a Fourth Floor Addition to the new hospital wing, and to provide and accumulate funds for constructing and equipping same: WHEREAS, by Resolution passed October 19, 1958, the Board of Weld County Commissioners did create in the office of the County Treasurer the Public Works Fund -Hospital Addition and allocated same to the construction of a three (3) story wing to the Weld County General Hospital, and WHEREAS, the Board of Trustees of the Weld County General Hospital and its architects have demonstrated and recommended that an additional one (1) floor should be added to the three (3) floor wing heretofore authorized to be constructed; that such Fourth Floor Addition is advisable and necessary in the public interest of Weld County. NOW, THEREFORE, BE IT RESOLVED, that for the purpose of providing and accumulating funds for the construction and completion of the additional floor to the new hospital wing, a Public Works Fund which shall be known as the Supplemental Public Works Fund -Hospital Addition is hereby created and that a levy of .75 mill be made and levied on each dollar of real property value in Weld County; that to enable the additional floor of the new hospital wing to be completed, there will be needed an additional $115,000.00 and requiring a tax levy of .75 mill as hereinabove stated, which levy shall be made for the year 1962 only; Provided, however, that said levy shall not be effective until after a public hearing on the said proposal for such proposed levy; that which such hearing is hereby called and set for October 25, 1961, at the office of the Board of County Commissioners in the Weld County Court House. BE IT FURTHER RESOLVED, that public notice of such hearing shall be given by publication of a notice thereof, same for said time and place in the official newspaper of said County;to-wit: The Greeley Booster, a public newspaper, not less than ten days before such hearing. The BOARD convened at 2:00 pm., this 23rd day of October, 1961. All the members of the Board were present. Mr. Tito Garcia, Com- modity Clerk, was also present. 1. A discussion of the program of Farm Surplus Commodity Dis- tribution was the first item on the agenda. Mr. Tito Garcia, Commodity Clerk, was intro- duced to the Board. The required agreement between the State and County in order to initiate this program was discussed. The two copies of the Agreement were then signed by the Commis- sioners. Various locations for a warehouse in Greeley were discussed. The Director requested that the Board consider making available some space at Island Grove Park. However, it was determined that due to the needs for space during fair time that space would not be available for this program. A search for adequate space at a reasonable rental will continue to be made. The Director indicated that the date of first distribution would be approximately November 15 if space were made available. The Commissioners agreed that the program should be initiated as soon as possible. II. The Director presented certain recommendations to the Board in regard to certification and payment for hospital care of indigent non-public welfare cases. He pointed out that the hospital bill for the month of September exceeded $14,500.00. This was the third largest billing received to date this year. Approximately $6,500.00 of that amount was for non-public welfare cases. The Director had previously indicated that addi- tional restrictions might have to be placed on this program if the Department were to stay within a reasonable amount. The following recommendations were made and adopted by the Board of Commissioners: A. No bills for indigent non-public welfare cases referred by the hospital less than $50.00 are to be accepted. B. The standards for determination of eligibility for indigent non-public welfare cases are reduced to 80% of Aid to De- pendent Children standards. C. Whenever possible, partial payment by the recipient and the County is to be arranged. III. The Directos also made certain recommendations in regard to the General Assistance Program which are to be considered as temporary Measurers until a full study of the General Assistance Program is accomplished. The recommendations were approved as follows: A. No assistance is to be given to employables until thirty days after their last full employment. B. All employable persons must be registered with the Colorado Employment Service. OCTOBER 23, 1961 MINUTES OF A MEETING OF THE BOARD OF PUBLIC WELFARE IN WELD COUNTY, WAS HELD ON OCTOBER 23, 1961: 06 132 C. All food orders are to be accompanied by a standare list of basic foods which may be purchased. D. Whenever possible, employables may be requested to work for assistance in the County buildings or surplus commodity program. The work so done will be computed on the basis of the current minimum wage law. E.
