PORTION OF JOHNSON STREET - HOWSER AND TIMBERS SUBDIVISION:
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado that the Chairman be and he is hereby authorized to sign order of partial
vacation as submitted by Attorney John Henderson thereby vacating the East twenty-
five (25) feet of Johnson Street between Woodward Avenue and Kaiser Avenue in
Howser and Timbers Subdivision, Keenesburg, Colorado.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

WHEREAS, the following named owners of Real Estate here-
after described, have petitioned the Board of County Commis-
sioners of Weld County, Colorado to vacate the East twenty-
five (E 25) feet of Re -located Johnson Street (said Re -location
having been made by Resolution recorded in Book 1629, Page
500, Weld County, Colorado records) between the South boundary
line of Kiser Avenue and the North boundary line of the County
road, also called Woodward Avenue, excepting that part of said
twenty-five (25) foot strip lying between the North boundary
line and the South boundary line of Kipp Avenue, in Plat of
Howser and Timbers Subdivision of a portion of the Southeast
Quarter (SE4) of the Northeast Quarter (NE4.) of Section twenty-
six (26) , in Township Two (2) North, .ange Sixty-four (64)

a. Charles H. Starks --Tract Four (4) in Howser and
Timbers Subdivision,together with a strip of land twenty-
five (25) feet in width abutting said Tract Four (4) on the

WHEREAS, said Re -located portion of Johnson Street, was
Re -located by virtue of Deed recorded November 7, 1962 in
Book 1629, Page 499, Weld County, Colorado records and pur-
suant to Resolution of the Board of County Commissioners of
Weld County, Colorado dated November 7, 1962 and recorded in
Book 1629, Page 500, Weld County, Colorado records, said Re-
located portion of Johnson Street comprising a strip of land
for a roadway, seventy-five (75) feet in width and extending
from the South boundary line of Kiser Avenue to the North
boundary line of the County road, also called Woodward Avenue,
as shown in said Plat of Howser and Timbers Subdivision, and
WHEREAS, The East twenty-five (E 25) feet of said Re-
located Johnson Street is not being used as a roadway by the
public and it is not necessary to have designated and
established as a roadway, the East twenty-five -five (cE 25) feet
o': said 1:e -located Johnson ;street, and
;E .&EAS. no part of said Re -located Johnson Street,
between the South boundary line of Kiser Avenue and the North
boundary line o_f the County road, also called Woodward Avenue:

NOW, THEREFORE, IT IS HEREBY ORDERED, That the East
twenty-five (E 25) feet of Re -located Johnson Street (by
Resolution recorded in Book 1629, Page 500, Weld County,
Colorado records) between the South boundary line of Kiser
Avenue and the North boundary line of the County road, also
called Woodward Avenue, excepting that part of said twenty-
five (25) foot scrip lying between the North boundary line
and the South boundary line of Kipp Avenue, in Plat of Houser
and Timbers Subdivision of a portion of the Southeast Quarter
(SE4) of the Northeast Quarter (NF;) of Section Twenty-six
(26), in Township Two (2) North, Range Sixty-four (64) West
of the 6th P.M. in Weld County, Colorado, be, and the same
is hereby vacated, and the title of said vacated portion of
Re -located Johnson Street, above described, be vested in the
owners of the land on the East abutting such vacated portion
of Re -located Johnson Street.

1. That Charles H. Starks of Keenesburg, Weld County,
Colorado, is the owner of the following described property
in Weld County, Colorado: Tracts Four (4) and Five (5) in
Howser and Timbers Subdivision of a portion of the Southeast
Quarter (SE) of the Northeast Quarter (NE) of Section
Twenty-six (26) , in Township Two (2) North, Range Sixty-four
(64) West of the 6th P.M., together with a strip of land
twenty-five (25) feet in width abutting said Tract Four (4)
on the West between the South boundary line of Kiser Avenue
and the North boundary line of Kipp Avenue, as shown and
designated in Plat of said Howser and Timbers Subdivision;
said twenty-five (25) foot strip being a portion of Johnson
Street vacated by Order of the Board of County Commissioners
of Weld County, Colorado, dated November 7, 1962, and recorded
November 7, 1962 in Book 1629, Page 497 Weld County records, and
Donald S. Laux and Evelyn L. Laux, of Keenesburg, Weld
County, Colorado, as joint tenants and not as tenants in common,
are the owners of the following described property in Weld

2. That a part of Johnson Street, designated as such in
Plat of Howser and Timbers Subdivision, Weld County, Colorado
was Re -located by virtue of Deed recorded November 7, 1962, in
Book 1629, Page 499 Weld County, Colorado, records and pursuant
co Resolution of the Board of County Commissioners, Weld County,
Colorado, dated November 7, 1962, and recorded in Book 1629,
Page 500 Weld County, Colorado records.
3. That said Re -located portion of Johnson Street described
in the instruments in Paragraph 2 above, comprises a strip of
land, for a roadway, seventy-five (75) feet in width and extend-
ing from the South boundary line of Kiser Avenue to the North
boundary line of the County road, also called Woodward Avenue,
as shown in said Plat of Howser and Timbers Subdivision. That
the public has been using only fifty (50) feet of the width of
said Re -located Johnson Street, as a roadway; that said Johnson
Street, North of Kiser Avenue, as shown in said Plat of Howser
and Timbers Subdivision, is likewise only fifty (50) feet in width.
That the above -named owners of said property abutting Re -located
Johnson Street on the East, have constructed and are now using
improvements which intrude into the East twenty-five (E 25) fee:
of said Re -located Johnson Street, being that part of Re -located
Johnson Street not usedby the public.
The undersigned petition for the vacation of the East

Town and
c. No e::isting rights of way or easements for sewer,
gas, water or similar pipe lines and appurtenances,
or for ditches or canals and appurtenances, or for
electric, telephone or similar lines and appurten-
ances, extend over and along the East Twenty-five
(E 25) feet of said Re -located Johnson Street,
above described.
WHEREFORE, the hereinafter named Petitioners pray that
the East twenty-five (E 25) feet of Re -located Johnson Street
(by Resolution recorded in Book 1629, Page 500 Weld County,
Colorado records) between the South boundary line of Kiser
Avenue and the North boundary line of the County road, also
called Woodward Avenue, excepting that part of said twenty-
five (25) foot strip lying between the North boundary line and
the South boundary line of Kipp Avenue, be vacated, and the
title of said vacated portion of Johnson Street, above described,
be vested in the owners of the land on the East abutting such
vacated portion of Re -located Johnson Street.
