claim and demand which the said part i ea of the first part ha V e in and to the following described
situate, lying and being in the County of Weld and State of Colorado, to-wit: A strip of ground for right
of way purposes for a public highway across a portion of the Northeast
Quarter (NEI) of Section Seventeen (17) , Township Six ( 6) North of Range
Sixty—three ( 63) "rest of the Sixth Principal Meridian, said strip of ground
being sixty feet ( 60 ft . ) in width parallel to the right of way of the
Union Pacific Railroad Company as aaid railroad right of way crosses the
Northeast Quarter (NE ) of said section, the South boundary line of said
railroad right of way constituting the North boundary line of this right
of way for public road hereby granted.
As one of the considerations hereof and as a condition for delivery
of this deed, second party agrees to construct promptly and before the open-
ing{of said road a statutory lawful fence along the South boundary of said
right of way and road hereby granted and agrees that it will not change
any of the grades of the lateral ditches leading to said Northeast Quarter
(NE*) and will do no damage to said ditches.
First party, Isaiah S. Wolf, covenants that he is- present holder of
note secured by deed of trust on said land and joins herein for the pur—
pose of releasing lien of said deed of trust only as to said sixty foot
(30) ft. strip of right of way above described.

and runway thereunder across Coal Creek as an underpass for livestock.

We have marked out the line of said road as located by us by turning a furrow on each side of said proposed road.
We estimate the probable cost of opening said road to travel to be '___.We the undersigned viewers hereby recommend that the road herein
describe;I be granted us petitioned for. Cost to open same about $400.00
not including fencing. We recommend that County fence said road with
three wires with posts thirty feet apart or four wires with posts thirty-
three feet apart . We further recommend that the dike on the C. Holdorf
place be replaced with pipe, the benefit thereof being equal to the damage .
There is a crossing to establish over the Extension Northside Lateral.
Also a Lateral crossing to establish.
Also a Lateral crossing to establish over the Big "FUSEY^ , near Cornish.
• Balance of land benefited by establishment of said road.

at this price ; being located right on the ground ,
he would probably do it cheaper than anyone else

agreed and donate him the - right of way, with the I
understanding that we have a good fence .
