WHEREAS, a public hearing was held on Wednesday, December 18,
1968, at 11:00 A, M, in the chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing a petition of Winograd
Co. and Freeman Truck Bodies, Box 776, Greeley, Colorado, requesting a
change of zone from "A" Agricultural District to "I" Industrial District, and
WHEREAS, the petitioners were present, and
WHEREAS, there was no one present in opposition to the change of
zone, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the re-
quest of the petitioners and studied the recommendations of the Weld County
Planning Commission as submitted on November 6, 1968, and having been fully
informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, that the petition of Winograd Co. and Freeman Truck Bod-
ies, Box 776, Greeley, Colorado, for change of zone from "A" Agricultural
District to "I" Industrial District, said area being more particularly described
as follows:
A parcel of land located in the Northwest Quarter (NW -1) of
Section Six (6), Township Four (4) North, Range Sixty-five
(65) West of the 6th P. M. , Weld County, Colorado, de-
scribed as follows: Beginning at a point on the East line of
said NW4, 400 feet South of the Northeast corner thereof,
thence South 0° 32' West 458 feet along the East line of said
NW4 to its intersection with the westerly right of way line of
the Union Pacific Railroad, thence South 36° 17' West 485
feet along westerly right of way line, thence North 74° 46'
West 210 feet to the easterly right of way line of U.S. High-
way No. 85, thence North 29° 36' East 912 feet along said
easterly right of way line, thence East 43. 1 feet to the place
of beginning, containing 4 acres, more or less,
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department,
2. All applicable subdivision regulations and zoning regulations shall
be followed and complied with to the satisfaction of the Board of County Commis-
sioners of Weld County, Colorado,
3. Subject to the approval of the Town of LaSalle, Colorado.

Mr. Harold Anderson: We are called to hear the change of zone request by
Winograd Company and Freeman Truck Bodies.
Mr. Telep: Let the record show that this hearing came on at
11:00 o'clock A. M., December 18, 1968, on the petition of
Winograd Company and Freeman Truck Bodies Box 776, Greeley,
Colorado, for a change of zone from "A" Agricultural District
to "I" Industrial District. For a parcel of land containing
4 acres more or less and located in the Northwest quarter
of Section 6, Township 4 North, Range 65 West of the 6th
P. M. and described in metes and bounds. As was duly
published as required by law. Let the record further
show that all three members of the Board of County
Commissioners are present as is the County Attorney.
Also let the record further show that the petitioners are
present and represented by Mr. Harold Winograd, who will
make the presentation to the Board. At this time
Mr. Chairman you may ask Mr. Winograd if he would like
to make an opening statement.
Mr. Winograd:
I am the owner of the property in question and Vice
President of the Winograd Company. I am a record owner of
the property in question. The petition is for a change
of zoning from "A" Agricultural to "I" Industrial to
orient you with the location of this piece of property
it lies between Highway 85 and the Union Pacific right-of-way
at La Salle and the east side of the Highway and running in
the direction of the La Salle overpass. You may remember
there are large piles of lime that have been piled up there.
Between Fishers shop and the home Jack Fisher used to live
in - that area- the ditch runs across - the lime piles
adjoin it -on the east and the highway adjoins it on the
west and it is virtually land that can not be used for
-agriculture, the lime, the ditch running through it.
It has been vacant and an eye sore for many many years.
Well Marshall Freeman of Freeman Truck Bodies
of La Salle was interested in purchasing it - has a
contract for purchasing it subject to the change of
zoning to be used in connection with his business in
the use of building truck bodies. For that purpose
he needs "I" zoning. We have provided for the county
zecords from the abstract company showing the owners
within the described distance in all directions. We
presented a petition sanctioned by the sizable majority
of those owners for the; change of zoning. It has been
posted the prescribed amount of time. I am told by
Mr. Elgin of the Planning Commission and shown signed
receipts of notification - formal notification- from
the Planning Commission has gone out to all these owners
and from what he tells me no protest has been loged against
this change. The Town of La Salle out of courtesy, I understand,
it is outside their city limits, were notified of the proposed
change. We have been informed by W. S. Fisher, a member of
that town board that they took no contrary action but in fact
sanctioned this change.

At this time it doesn't have but I assume since it
adjoins the railroad right-of-way it could be arranged.

we are now. We figure on putting up a building there later
on. We have no room to park trucks where we are now.
I would like to read into the record, with your
permission Mr. Chairman, let the record further show that
-the Weld County Planning Commission on November 6th, 1968
recommended favorably this request for rezoning be granted
Of course subject to the approval of the Town of La Salle.
Which it has been my understanding has been done, as evidenced
by the testimony of Mr. Harold Winograd. We have on file all
of these returned receipts to certify that certified registered
mail went out to those people owning property within 500 feet.
You have conformed to the law and have had a favorable reaction.

Mr. Elgin: I was informed through the office that no adverse type
of complaint has been made to our office regarding this.
Mr. Dunbar: There weren't any protestors at your hearing?
Mr. Elgin: No, there were none at the hearing.
Mr. Harold Anderson: There is no objection presented here by petition or
otherwise.
Mr. Winograd' Not that I am aware of.
Mr. Dunbar: Well actually it is an area where it would certainly be
conforming with industrial zoning between the highway and the
Union Pacific Railroad. In view of the recommendation by the
Planning Commission. I am going to recommend that the change
of zone be recommended.
Mr. Marshall Anderson: I will second the motion.
Mr. Harold Anderson: It has been regularly moved and seconded that the
request for a change of zone be granted. I will make it
ianamious.
