HomeMy WebLinkAbout670206.tiffRESOLUTION WHEREAS, Dekalb Agricultural Association, Inc., Sycamore Road, De Kalb, Illinois 60115, has requested permission to locate a commercial poultry farm operation on the Southwest Quarter (Sidi) of Section 29, Township 2 North, Range 65 West of the 6th Principal Meridian, Weld County, Colorado, containing 160 acres, more or less, and WHEREAS, the Weld County Planning Commission has approved this request by resolution dated November 7, 1967, and WHEREAS, the said requested business location is in an agricultural zone as set forth by the Planning Commission of Weld County, and WHEREAS, according to Section 3.3(3) of the Zoning Resolution of Weld County, said commercial poultry farm operation is authorized upon the approval of the Board of County Commissioners; NOW, THEREFORE, BE IT RESOLVED that Dekalb Agricultural Association, Inc., of Sycamore Road, De Kalb, Illinois, is hereby authorized to operate a commercial poultry farm on the Southwest Quarter (SW4) of Section 29, Township 2 North, Range 65 West of the 6th Principal Meridian, Weld County, Colorado, as provided by Section 3.3(3) of the Zoning Resolution of Weld County, Colorado. Mr. Watson stated the matter would be taken under advisement. After due consideration, this matter is to be referred to the County Attorney. NEZ and the Si of Sec 23 T1 R66 FOR: Paul Radasch and Donald C. Goelz Paul Radasch stated the necessary changes had been made. The prelimin- ary and final plats are the same. Percolations tests have been made and approved. Mr. Goelz stated the covenants will not permit lots tobe divided. Mr. Heitman stated the covenants 'regarding mobile homes has already been broken. Asked why they needed 3 more 4 sections when there is only one house in the first quarter section. Mr. Goelz stated all of the lots in the first filing have been sold. Mr. Watson questioned if the area would be developed if all mobile homes were denied. Mr. Goelz thought it would. Mr. Radasch stated the paragraph in the cove- nants allowing mobile homes for 6 months could be deleted. Mr. Goelz agreed to this. Mr. Bean asked why they showed street dedications form ing double frontage lots if the streets were not going to be developed. Mr. Goelz stated a performance bond for the construction of streets would be posted. Mathews and Tate Avenues are to be developed. Mr. Bowles stated he thought 160 acres on the north should be sufficient at this time. Mr. Heitman stated he couldn't see the need for the whole section, should be developed a quarter at a time. He moved to table the matter until we can coordinate a basis for denial. Mr. Watson stated that he felt the need wasn't there. The school board and the telephone company have registered complaints. Mr. Bean suggested the application for the preliminary plat for the SW4 only be approved, pointing out what will be constructed and cost estimated and agreements be put in writing that they will improve the one pending before final plat is accepted or post bond accordingly. Also that the matter of mobile homes be fully understood by both parties and that you would recommend that they delete the temporary right to have mobile homes in the area or this board would not look favorably on any more devel- opment in this area, as far as the east half. It should be made clear that the board questions even going to this additional quarter at this time in view of the improvements that have been done and they would be very unlikely to favor any further plotting in the area until more development has occurred'in the not plotted and pending area.
