Pipers, praying for the redemption of Tax Sale Certificate No . 1.12 from the tax eatles �f• 1905 of Lots 7---S- -9--10-6-11---l2-e -17 and 18, Block 21Pe,ckrrds- Subdivision, was presented this day, and whereupon the said 'petition and all mat— , ters therein contained having been duly , r'e'gularly and faithfully considered , and the Board' having found that ' all of said pr-operty as enumerated in said tax sale certificate No . 112 was erroneous , in as much as said property was assessed and paid 'for under! sdhedul'e' p/147 and erroneously assessed and sold for taxes under schedule P/227, and the Board having ascertained the fact that the error was -hot the fault Jot the petitioner , but an error lay by double assessment; therefore it was on motion ordered that ,the prayerr of petitioner be and 'the same is hereby Lgranted, ' ' and (the Treasurer is hereby authorized' and directed to issue proper redemption eertif ie-ate therefor . The clerk is ' hereby di rected to draw 's, lbucher and warrant , - made payable to ' the County Treasurer , in the Sum of $2 .92 `tb cover said redemption fees . • ' /x/ ' IN THE MATTER OF REDEMPTION FROM TAX SALE OF 1896 . • • A communication from the Lincoln Land Gompany, praying for the redemption of tax sale certificate No . 1065 from the tax sale of 1896 on Lot 1 , Block 7 , Raymer was presented , • • this day, and 'whereupon the said communication and all matters therein 'contained having been duly and regularly eonsidered, and the Board having found that Lot 1 , Block 7 , Raymer , as enumerated in said tax' sale certificate No . 1065 Was erroneous; in as much as the same was assessed and taxes paid thereon under schedule L/83 tax roll of 1895 , and erroneously assessed and sold for taxes under schedule W/47 , and the 'Board after a thorough investigation, found that the error' was not 'the fault of the owner thereof , but an errdr through 'double assessment-. Therefore it was on motion ordered that the prayer of the Lincoln Land Company be and the same is hereby granted, and the Treasurer be and he' 1s hereby authorized -and directed to issue proper redemption certificates therefor`. =V1_ IN THE MATTER OF' ASSIGNMENT OF TAX c /1( SALE CERTIFICATE NUMBER 16 , SALES OF 1907: The Board having' drily and regularly considered an& in-- vestigated the -application of E. R. House to purchase from' the county of 'Weld the certificate of purchase made to said county for the taxes due and unpaid for the year 1902 , on Lot 3 N.E..4 S . E.Q.' section 25 , Tp . 5N . , Range 66 best , which said property was bid in by and for said county as shown by certificate Number 16 , sales of 1903 , at the tax sale in Ranner.'by laws provided , on. the 31st day of December , 1903 , said applicant desiring to avoid the full payment of.; the full amount of the taxes assessed on said property since the date of said sale . • And the Board having been duly advised in the premises , upon motion duly seconded, and carried - it was ordered by the Board of County Commissioners of the County of Weld that the Treasurer of said l • 0 • • • ♦ 4 4 4 4 x • f • J ' county do sell , assign and deliver the said certificate of purchase to the said E. P . House, upon_ the receipt of the amount for which said property_ was bid in by the county, with interest and. pen- i alties accrued thereon from the date of sale , S per centum, together with the sum of one dollar and the further' sum of $12 22 . (A 'total of $15 .64 including 'said interest ) in lieu of the taxes asp- / sessed thereon since the date of sale , in manner and form as by statute provided . r 358 ; // IN THE MATTER OF REDEMPTION OF TAX SALE CERTIFICATE NUMBER 14 P. w, Allen, County Treasurer appeared before the Board and stated that in examining the -t-ax -r�eco-rd he had -mound -that, the ,N. E,.4 S.W.21 . Section 3 , Tp . 414 . , Range 66 West was sold for taxes under certificate No,, /443, sales of 1595 ,; that upon said .date said property belonged ,r to the United. States , as final proof had not been made until April 20th , 1905; that in (consequence of said -erroneous sale a cloud has been placed upon the title to sP,id land; that Mr . Zelder , owner thereof , is anxioua; ,to_ have \said cloud removed and requests that he be issued a redemption certi- ficate therefor , After carefully investigating all the records pertaining thereto it was found that the i�nfor- ration above given ,was correct , and , it isj ,the unanimous opinion of this, Board that said error should be corrected . Therefore it was ,on motion ordered that the County Treasurer be and he is hereby , authorized and; directed to issue proper redemption; certificates upon all of said property and: for-- ward same to Mr . •Zelders . h IN THE MATTER OF SALE OF REAL PROPERTY HELD BY WELL COUNTY. • Mr . IN THE MATTER OF PETITION FOR RIGHT OF WAY OVER AND ACROSS COUNTY ROADS BY THE GREAT WESTERN RAILWAY COMPANY . The Board then took up for consideration the following peti— tion of The Great Western Railway Company , viz: -- To the Honorable Board of County Commissioners of Weld County, Colorado . Gentlemen The Great Western Railway Company, a Corporation duly organized under and by virtue of the laws of the state of Colorado , and the petitioner herein, have constructed a railroad from Johnstown in Weld County, Colorado , extending to the town of Longmont , in Boulder County for the purpose of hauling sugar beets , farm products and for passenger and other traffic necessary in the conduct of its business and in the construction thereof it became necessary to cross through and over a number of Public Highways along and upon the line thereof . At each and every crossing there is required for a right of way a strip of land eighty feet in width, the same being flrty feet in width on each side of the center line of the track of The Great Western Railway, as the same is now constructed and operated. By reason of the premises the said The Great Western Railway Company , the petitioner herein, does hereby petition your Honorable Board for a Right of Way for a railroad crossing eighty feet in width, the same being forty feet on each side of the center of the track of the railroad of The Great Western Railway Company, as the same is now constructed and operated , through, over and across the following described Public Highways , described as follows , to-'wit : -- In Township Three , North , Range 68 West of the 6th P . The rights of way petitioned for herein are to be granted to said company for the purpose as herein stated, and such occupation by this corporation, its successors and assigns shall be subject to the condition that in the operation and maintenance of said railroad, that said corporation and its assigns will do and perform whatever a reasonable public necessity may require to maintain said ; crossings as a public highway as the public safety and convenience may require . McCleary praying for a rebate of 1906 taxes were presented , and after carefully investigating the claim of each petitioner , on motion ordered that Robert Graham be granted a rebate of 1906 Military Poll tax and that R. J. McCleary be granted a rebate of taxes on a valuation of $420 .00 / County Clerk' s report for the month of July, 1907 was presented , examined and on motion audited and ordered placed on file . `J The Board then took up the several bids received for plumbing and heating the Greeley Hospital. and after carefully examining same it was found that the bid of C . I . Day & Company was the lowest and best bid received , ,both on Heating as well as the Plumbing, therefore it was on motion ordered that C. I . Day & Company be and they are hereby awarded the contract , conditioned that the Board reservesthe right to later decide as to whether they wish the price given as per plans on the r 1bing or as per the suggestion of Dr . Your petitioner, The Interurben Construction Company, a corporation duly organized and ex— isting under and by virtue of the laws of the state of Colorado, hereby petitions the Board of County Commissioners of the County of Weld, in the State of Colorado, to grant to said Company the rights of way and franchise for the construction, operation, and maintenance of an electric railroad over, ,along and across the county road and public highways• of the County of Weld, described in the franchise hereinafter set forth. The said franchise herein petitioned for is in words and figures as follows: --- WHEREAS , The Interurben Construction company-, a corporation organized and existing under the laws of the state of Colorado , has filed with this Board its petition and application, together with the written consent of a majority , measured by the front foot , of the abutting property holders on each side of such county road, for a grant of rights of way and a franchise for the construction operation and maintenance of an electric railroad over, along and across the county roads numbers 10 , 327, 346 , 480 , 378, 145, 354,112, 77 and 35 , commonly known as the Greeley Denver Road, and across all intersecting county roads and public highways of the county of Weld, in the State of Colorado ; and 1HE SEAS, This Board has had under consideration the said petition, and it appears to this Board • that the said company desires in good faith to construct , maintain, and operate an electric railroad over , along and across certain designated public roads of the County of Weld, in said state; and WHEREAS, After due consideration it appears to this Board that the construction, operation and maintenance of such electric railroad would be a great convenience and profit to the inhabitants of, and add largely to the taxable property in this county. NOW, THEREFORE: Section 1. All requirements of law having been complied with by it , the right , privilege and authority is hereby granted to The Interurban Construction company, hereinafter called the Grantee , its successors and assigns , to build, construct , maintain and operate an electric railroad over , tpon, along and across the county roads Numbers 10 , 327, 346 , 480 , 378, 145, 354, 112, 77 and 35 , commonly known as the Greeley and Denver road, and over and across (but not along) all intersecting county roads and public highways of the County of Weld, in the State of Colorado , together with the necessary equipment appertaining thereto , including telegraph and telephone lines , with their ap- �r � l,0H.l i-r- f P urtenances, other devices , poles , wire rails , ties, cars and other appliances reasonably nemeses sary in connection therewith upon the conditions hereinafter provided. All of the necessary rights of way, easements , and privileges for the construction, maintenance and operation of said electric railroad are hereby included in this grant , subject to the conditions herein, and the grantee is hereby permitted to use electricity in any of its forms , gas , compressed air, or other mechanical motive power now known or which may hereafter be dis- covered ( except steam locomotives ) , for the operation of said railroad.
