SIGN LEASE AGREEMENT FOR ROAD MATERIALS DISTRICT NUMBER THREE: WHEREAS, District Number Three has requested the Board of County Commissioners of Weld County, Colorado, to sign a lease agreement with Homer Jennings of 510 Knox Court, Denver, Colorado, conveying the right to remove gravel, sand and road making and building materials for and in consideration of One Thousand Dollars ($1,000.00). which District Number Three shall remove from the following described lands, situate in the County of Weld, State of Colorado, to -wit: The Northeast Quarter of the Southeast Quarter (NE*SEI) of Section 23, Township 2 North, Range 66 West of the 6th P. M. Weld County, Colorado WHEREAS, Mr. Jennings agrees to furnish a right-of-way for ingress and egress, and WHEREAS, the Board believes it to be in the best interests of the County to sign said lease agreement NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Weld County, Colorado that they shall and do hereby accept and sign the aforementioned lease agreement, a copy of which is attached and made a part of this resolution. No..149651:i pourer, - I ✓ THIS LEASE AGREEMENT, Made this 19th day of October, 1966, by and between HOMER JENNINGS of Weld County, Colorado, party of the first part, and THE COUNTY OF WELD, in the State of Colorado, party of the second part; WITNESSETH: The party of the first part, for and in consideration of One Thousand Dollars ($1,000.00), payable in yearly installments of $500.00 'beginning October 15, 1966, to first party in hand paid by the party of the second part, the receipt of which is hereby confessed and acknowledged, does hereby lease unto the party of the second part, its successors and assigns, the right to remove all gravel, sand and road -making and building material which it shall be able to remove from the following described land, situate in the County of Weld, and State of Colorado, to -wit: The Northeast Quarter of the Southeast Quarter (NEISE}) of Section Twenty-three (23), Township Two (2) North, Range Sixty-six (66) West of the Sixth Principal Meridian. Also an easement for ingress and egress to move above materials. The Count of Weld, as a further consideration for this lease and by acceptance thereof, agrees to build a road into said property and to install a cattle guard and gate which shall become the property of the first party upon termination of this lease, the first party hereby to the second party the right to enter upon said lands at any time hereafter to excavate and remove therefrom all gravel, sand and earthen materials which it shall find suitable to its needs, together with the rights and privileges incident to the proper enjoyment thereof. This instrument shall give no title to said land, and shall only give the right to remove therefrom the part of the surface thereof as hereinabove set forth. This Lease shall be binding upon and inure to the benefit of the heirs, administrators and assigns of the parties of the first part and the successors and assigns of the part of the -1- 4`tr . 595 1496513 second part.
