AUTHORIZING COUNTY ATTORNEY TO JOIN BOARD OF COMMISSIONERS
AS PARTY PETITIONER WITH THE COLORADO DEPARTMENT OF HIGHWAYS:
BE IT RESOLVED, that the Board of County Commissioners of Weld County
hereby approves Colorado Department of Highways Project No. U 007-1(9), U. S.
Highway #34 -By-pass of Greeley, provides for the improvement of S. H. #16 in
Weld County, and authorizes the County Attorney to join said Board of County
Commissioners as party petitioner with the Colorado Department of Highways in
the event it becomes necessary to acquire needed right-of-way by condemnation,
it being understood that all court costs and awards to property owners are to
be paid by said Colorado Department of Highways.
The above and foregoing resolution was, on motion duly made and
seconded, adopted by the following vote:

AULT STORAGE SITE:
WHEREAS, the Union Pacific Railroad Company has tendered to Weld
County, Colorado, an agreement extending to and including November 30, 1969
the term of that certain lease dated December 1, 1948, as extended, whereby
the Railroad Company leased to the County of Weld, State of Colorado, a
portion of its right of way at Ault, Weld County, Colorado, for storage ana
mixing of road repair material, and
WHEREAS, the Board has said proposed agreement before it and has
given it careful review and consideration, and
WHEREAS, it is considered that the best interests of said County
will be subserved by the acceptance of said agreement.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Weld County, Colorado, that the term of the agreement submitted by the Union
Pacific Company as aforesaid be and the same is hereby accepted; that the
Chairman of the Board be and he is hereby authorized to execute said agreement
in behalf of the County; that the Clerk of the Board be and she is hereby
authorized and directed to attest said agreement and to attach to each duplicate
original of said agreement a certified copy of this resolution.

LEASE - OPTION - PURCHASE
AGREEMENT
THIS AGREEMENT made and entered into this 3/..411-- day of
March, 1965, by and between Weld County, a political subdivision
of the State of Colorado, by the Board of County Commissioners for
its respective interests, the Lessee, and Bachman's, Inc. a
Colorado Corporation, of Greeley, Colorado, the Lessor, WITNESSETH:
WHEREAS, it has become necessary to provide metal shelving
for the law books of the law library of Weld County, Colorado, and,
WHEREAS, it is necessary to preserve the books which are a
valuable asset to the Court System of Weld County, by placing
them in metal shelves, and,
WHEREAS, the present shelving and book cases have become in-
adequate and do not provide the required protection needed for
said books, and,
WHEREAS, under Section 36-1-4 of the Colorado Revised Statutes
1963, the County Commissioners of each County are required to
furnish adequate County buildings and to furnish same, and,
WHEREAS, Bachman's have agreed to furnish the required metal
shelving for the law library books on a lease, option and purchase
arrangement.
NOW THEREFORE, in consideration of mutual promises, covenants,
and agreements herein contained and the payments herein provided
the following is agreed between the parties hereto:
(1) The Lessor shall lease to the Lessee the equipment
following:

(2) The Lessor shall receive rental psysents an follows:

(3) The Lessor shall pass title to said equipment to
Lessee on January 15, 1968, provided all payments herein have been

(4) The Lessee agrees to slake all payments as herein
provided under the terms of this Agreement.
(5) The Lessee agrees to surrender to Lessor, upon non-
payment of any installment, all items covered by this Agreement,
in same condition as received, ordinary wear excepted.
(6) The term of this Agreement shall be for 32 months
from May 1, 1965 to January 15, 1968.
(7) The equipment herein described shall be delivered
to the Lessee by May 1, 1965 when first payment is made.
IN WITNESS WHEREOF, the Board of County Commissioners, by
and through its Chairman, has caused this Lease, Option and
Purchase Agreement to be subscribed and attested by the Clerk
of said Board and said Lessor by and through its President and

of .03 cents per gallon be imposed upon all aviation gasoline
delivered to the Weld County Municipal Airport for sale, use, or
other disposition thereof, and that said charge shall be made to

party shall furnish to the Weld County Municipal Airport Board
copies of all delivery tickets concerning said aviation gasoline.

to "C" Commercial as requested by Roland Krier of Route 4 Box 318, Greeley, Colorado,
said area more particularly described as follows:

All that part of Lots 1 and 2 of the NE4SE- of Section 15,
Township 5 North, Range 65 West of the 6th P. M., according
to the subdivision of lands by the Union Colony of Colorado,
lying North and East of U. S. Highway 34, being old State

REGARDING PROJECT S 0024(23):
BE IT RESOLVED, by the Board of County Commissioners of Weld
County, Colorado, that they hereby approve a certain agreement with the
State Highway Commission of Colorado, a public corporation, for the use
and benefit of the Department of Highways of the State of Colorado, dated
April 28, 1965, whereby the County has reviewed and approved the Geometric
Standards designated to govern the construction of a Federal Aid Secondary
Project S 0024(23) of improvements approximately 1.994 miles long, from
2.0 miles West of Ault at the easterly end of Project S 0024(13) and
extending easterly on State Highway No. 14, as per terms of said Agreement
on behalf of Weld County by signatures of the Board, as per attached
agreement, and made a part of this resolution.

of Weld, State of Colorado, an agreement renewing for a period of five years
beginning September 1, 1965 and extending to and including August 31, 1970 the
term of the contract dated September 17, 1935, covering lease of premises of
the Railroad Company in Weld County, Colorado to be used for highway purposes,
said agreement being identified as Railroad Company's C. D. No. 21155-F, and
WHEREAS, the Board has said proposed agreement before it and has given
it careful review and consideration, and
WHEREAS, it is considered that the best interests of said County will
be subserv'ed by the acceptance of said agreement.

The application of Gerda L. Heffley for a license to sell 3.2
beer only at a location in a portion of the E}SW* of Section 11,
Twp. 1 North, Range 68 West of the 6th P.Y., Weld County, Colorado,
came on for hearing May 12, 1965, and the Board of County Commissioners
of the County of Weld having heard the testimony and evidence adduced
upon said hearing and having considered the testimony, evidence and
petition in favor of granting said license and the remonstrances
against the granting of said license, and having carefully weighed
the same now makes the following findings:
1. The evidence discloses that the application was duly
made, and that notice thereof and of said hearing was duly given
by publication as required by law.
2. That no question was raised nor objection offered

The Colorado Statutes provide:

"No County officer shall be allowed to contract for purchases for and
on behalf of Weld County, any books, stationery, records, printing,
lithographing or other supplies of any kind for use in his office and
no supplies shall be procured in any other manner than as provided
in 36-1-9 to 36-1-12". Said sections referred to, give power of pur-
chase to the Board of County Commissioners and any purchases other
than by the Board are legal only after ratification of the Board.
BE IT FURTHER RESOLVED, that if any officer, agent or
employee of Weld County, Colorado, other than the Board of County
Commissioners, attempts to make purchases without requisitions and
approval of the Board, such person acts at the peril of:
(1) The Board refusing to pay for any such purchases, or
(2) The Board deducting the cost from the salary of
employee, or
(3) If the Board has the power, the removal from the
position held by such purchaser.

A MEETING OF THE BOARD OF PUBLIC WELFARE IN WELD COUNTY
The Weld County Board of Public Welfare met at 1:30 p.m. on April 14, 1965.
Those present were: Mr. Ed Dunbar, Mr. Percy Odle, and Mrs. Margaret McOuin.
The purpose of the meeting was to

The Weld County Welfare Board met at 2:00 p.m., on May 12, 1965.
Those present were: Mr. Percy Odle, Mr. Ed Dunbar, and Mrs. Margaret
McOuin.
This meeting was for the purpose of considering a Child Welfare
Supervisor II to meet the Federal requirement by July 1, 1965, for five
workers per supervisor and sixty cases per worker. It was explained to
the Board that the department had only recently been notified of these
requirements.
Because supervisors are very hard to find, and we have good prospects
of securing an individual who meets the qualifications, and who may be
leaving the Boulder County Welfare Department by July 1, 1965, request
is being made of the Board that the department be permitted to offer a
salary of $628.00 per month, which is two steps above our beginning
salary. Both Mr. Dunbar and Mr. Odle gave their permission to hire at
the step recommended by the Director.
Since there was no further business, the meeting adjourned at
2 :45 p.m.

The Weld County Welfare Board met at 11:00 a.m., March 3, 1965.
Those present were: Mr. Elmer Shultz, chairman; Mr. Percy Odle,
Mr. Tom Richardson, County Attorney, and Mrs. Margaret Meouin.
It vas brought to the attention of the Board the need for additional
office space to meet the Federal requirements of supervisors and workers
by July 1, 1967. The Board felt that it would be ippossible to consider
it at this time because of the expense of completing certain space in
the service building which vas not planned for this year.
The Director inquired about the Addressograph plates which had not
yet been secured. There was no lepor't on this item at this time.
In storage at the welfare department are many old order books, dating
back to 1936. Inquiry vas made as to what disposition could be made of
these in order to alleviate our storage bpace. Mr. Richardson stated
that if the books had been audited and passed the audit and were seven
years or more old, they could be destroyed. However, It would be neces-
sary to secure permission from the State Archives officer. This regu-
lation can be found in the 1963 Statutes, revised Volume 6, Section 131-
3-5.
The matter of compensation was discussed as it was necessary to give
the State Department an answer before April 1. This had been brought tc
the attention of the Board at a previous meeting, but they had wished to
delay the matter. Since the Metropolitan Plan was the same as the county
plan, it was recommended by the Director that steps 2-7 be adopted for
all case workers and all clerical staff. By unanimous consent of all
mSrs of the Board, the 2-7 steps on the compensation plan were adopts.
There being no further business, the meeting adjourned at 11:55 a.m.

The application of Albert Solis for a three way outlet
license came on for hearing May 19, 1965 at 2:00 P.Y. and the
Board of County Commissioners of the County of Weld having heard
the testimony and evidence adduced upon said hearing and having
considered the testimony, evidence, petitions and remonstrances
filed with said Board, and having carefully weighed the same now
makes the following findings:
1. The applicant failed to sustain the burden of proof
as to the reasonable requirements of the neighborhood.
The evidence shows that there is another three-way outlet
in the area described as neighborhood. The evidence shows that
there has been no substantial tial increase in population since the
last license was issued. The evidence shows that expectant patronage
of the business would be residents of other areas, motorists and
other passers-by and there is evidence that prospective patrons now
have the opportunity to patronize similar establishments within a
reasonable mileage of the applicant's location.
2. The desires of the inhabitants of the neighborhood
of said proposed location as evidenced by personal testimony and
petitions are opposed to the issuance of the license. momen.
3. That each of the preceding findings in and of themselves
and independent of each other constitute a separate and individual
ground for denial of the license.

The application of Maxine G. LePore, d/b/a Park 'N Pack for a
retail package liquor store license came on for hearing May 12, 1965
at 2:00 P.M. and the Board of County Coiiesionere of the County of

ing and having considered the testimony, evidence, petitions and
remonstrances filed with said Board, and having carefully weighed the

Notice is hereby given that final payment for the work contracted
by Manion -Cropper Const. Co. on the 2nd day of October, 1964 for the
general work on remodeling offices in the Weld County Court House and
Weld County Services Building will be made on or after July 20, 1965,
and all persons, companies or corporations that have furnished labor,
materials or other supplies used by Manion -Cropper Construction Co.,
in or about the performance of the work contracted to be done on said
buildingsand whose claim therefore has not been paid by Manion -Cropper
Construction Co. on or before the 19th day of July, 1965, should file
prior to July 10, 1965 with the Board of County Commissioners of Weld
County, Colorado, or with Claude A. Nash, Architect, 1869 So. Pearl St.

NOTICE
Notice is hereby given that the Board of County Commissioners
of Weld County, Colorado, sitting as a Board of Equalization,
will meet in their office at the County Court House, Greeley,
Colorado, beginning on the second Monday, the 12th day of July,
1965, to hear petitions or appeals relative to the 1965 assessments
and said hearings will continue from day to day until the 28th
day of July, 1965.
Colo. Revised Statutes,1964, Chapter 137-2-35 provides: In all
cases where the complaint of the taxpayer has been overruled by
the County Assessor, the taxpayer may take on appeal from his
decision to the Board of County Commissioners, sitting as a
Board of Equalization, of the County wherein the property is
assessed. Such petition or appeal shall describe the property
claimed to be unjustly or erroneously assessed, the sum at which
it is assessed, its true cash value, and state what is a just
assessment thereon compared with other like property, such petition
shall be verified by the petitioner or some one in his behalf, and
on the written grounds of the refuel of the Assessor shall be
attached to and accompany said petition.
