RESOLUTION
WHEREAS, a public hearing was held on Wednesday, November 26,
1969, at 2:00 P. M. in the Chambers of the Board of County Commissioners
of Weld County, Colorado, for the purpose of hearing the petition of
Robert Swanson, 107 East 57th Street, Loveland, Colorado, requesting
a change of zone from "H" High Density District, to "MH" Mobile Home
District, and
WHEREAS, petitioner was present and represented by his agent,
Edgar F. Bartels, and
WHEREAS, there was no one present in opposition to the change
of zone, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements from those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioner and studied the recommendation of the Weld
County Planning Commission as submitted on October 7, 1969, and having
been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS, that the petition of Robert Swanson, 107 East 57th Street,
Loveland, Colorado, for a change of zone from "H" High Density District
to "MH" Mobile Home District, said area being more particularly described
as follows:
The South 200' of the North Half (N4) of Lots Five (5) and Six (6)
of the Southwest Quarter of the Southwest Quarter (SW3SW ),
Section Nine (9), Township Five (5) North, Range Sixty-five (65)
West of the 6th P. M. , Weld County, Colorado, containing 3
acres, more or less,
is hereby granted under the conditions following:
(1) Any water and sanitation facilities to be installed shall be
approved by the State Health Department.
(2) All applicable subdivision regulations, and zoning regulations,
shall be followed and complied with to the satisfaction of the Board of
County Commissioners, Weld County, Colorado.

I hereby certify that pursuant to a notice dated October 15, 1969,
duly published October 24, 1969 and November 21, 1969, a public hearing was
had for a Change of Zone as requested by Robert Swanson. On motion by
Mr. Harold Anderson, seconded by Mr. Billings it was voted to grant said
request. A resolution was ordered drawn granting said Change of Zone.

Mr. Anderson: We will call this meeting to order, Mr. Telep will
you make the record for this Change of Zone Request for Mr. Robert
Swanson, 107 East 57th Street, Loveland, Colorado.
Mr. Telep: Thank you Mr. Chairman, Let the record show that
this cause come on regularly to be heard today, November 26th 1969,
at 2:00 P. M. on the petition of Robert Swanson of 107 East 5th Street,
Loveland, Colorado, for a Change of Zone from "H" High Density District
to "MH" Mobile Home District of a parcel of land containing 3 acres
more or less. More particularly described as has been shown in the
notice that was duly published as required by law on October 24 and
November 21 respectively 1969.
Letthe record further show that there is on file
a resolution of the Weld County Planning Commission dated October 7,
1969, whereby the Planning Commission recommends favorably to the
Board of County Commissioners that this area ought to be rezoned -
be done in accordance with the petition, in that it meets the zoning
regulations.
Let the record further show, Mr. Chairman, that counsel
sees no one present in the Chambers who is either in favor or against
this petition. I think Mr. Chairman it would be in order now. I might
add that the petitioner is here - in person with Agent Edgar Bartels.
I believe it is in order to proceed Mr. Chairman.

Mr. Chairman, may I speak on Mr. behalf if it
is according to your will. What Mr. and Mrs. Swanson
Mr. Telep: Would you give your name and address for the record?
Mr. Bartels: My name is Edgar Bartels, 910 Ninth Avenue, Greeley,
Colorado, and I am acting as agent on behalf of Mr. and Mrs. Swanson
who are before you folks here to get a rezoning of a multi -family
R what it is counsel?

High Density to MH Mobile Home District.
As you know the Swanson's were before you folks
about a year ago or a little over a year ago. At that time you
zoned a parcel of ground approximately 5 acres on the corner of
First Avenue and Twentieth Street. Since that time they have developed
this area, now showing 38 trailers and it is a nice development, I think
you will agree if you have driven by it or through the development.
The have a fully paved, oiled road, they have the grass in, I think
they have complied pretty much with the all the regulations set forth
by you folks. I would like to report, I know that at the Planning
Commission, they gave a report as to the population - I think all
trailer parks are concerned and particularly the school districts
are concerned with the number of children. The last time I reported
there were three children, but the Swanson's advised me their was
an addition last week, so there are four children, 8 dogs and no
cats. So you see as they told you, a little over a year ago, this
was bascially a development for older people as well as young people
who have not any family or a small family.
It is now their intent and they ask for you people
to zone a 200 foot piece parcel directly north of the existing
development. This would allow them to put in 28 more trailers. The
ground, the remaining ground which they are purchasing, or are taking
up in their option which would amount to 130 feet. It is their plan
to have this as a area between - kind of a buffer area - between
the livestock commission there and their particular development of
25 trailers. This was discussed with the livestock people and I
would like to report to you that they are very pleased to hear this
because again they are naturally concerned with children and anything
possibly close to them. So this 130 between the two areas was something
they were pleased as well as the Swansons in trying to continue with
the good development. They thought this was good for —

Lefty is this going to leave the old Rush house there?
No, I think it is there intent to tear it down.
Marsh, because it is a sore eye - it is something that has been nothing
but problems.
Mr. Anderson: Does this include all the Rush property?
Mr. Bartels: Right. There is a total of 10 acres approximately.
You could say they,: a not going to do anything with that 130
other than to use it as a buffer area. So it is such unless Mr. and
Mrs. Swanson have something to add here, that is basically our story.
Do you have anything you want to add? Are there any questions that
you have that we could answer?

In other words this would remove the Rush property?
Right.
Is there anyone in the room opposing this application?
Let the record show that there are no'• protestants in the room and
that three people are present supporting the application. Do you
have any questions Harold? Do you have any Mr. Telep?
Mr. Harold Anderson: No.
Mr. Telep: No, Mr. Chairman.
Mr. Anderson: There is no one here against it and three people forit
we will take this hearing under advisement. We will declare this hearing
closed.

Mr. Chairman, if I make a suggestion, In view of the
fact that no one is against it, this Board composed of two members
never the less is a quorum and it may grant this change of zone if it
so desires. If you wish to let the record show or if you wish to take
it under advisement you can do that too.
