STATF,M N T It the commission: On April 20, 1949, the Board of County Commissioners of Weld County, Colorado, filed an application with the Commission far authority to establish a new highway crossing at grade over The Chicago, Burlington & Quincy Railroad Company's right of way at a point 381 feet west of said Railroad's Mile Post No. 290 at Sligo, Colorado. The location of said crossing is more partionlArly shown on Exhibit No. 1, at Location "Ye on said exhibit. The matter was set for hearing in Greeley, Colorado, on July 27, 1949, at the Court House, and after due notice to all interestedinterested Ilnrties was ₹.here heard and taken under advisement. _c , At the hearing, Mr. Carl J. Magnuson, Weld County Commissioner, testified that there had been a small community at ego, Colorado, but that at present there was only one residence and one school building. Mr. Magnuson stated that he had received a letter from the County Superintendent of Schools of Weld County, to the effect that on July 12, 1949, the School Board had voted to dissolve the School District at Sligo and to move the school building elsewhere. Mr. Magnuson further stated that a new County road along the section line common to Sections 26 and 35, Township 10 North, Range 61 West, had been constructed and the County is awaiting permission from this Commission to cross the tracks of; the Chicago, Burlington & Quincy Railroad Company. The County will construct the crossing and provide ade- quate drainage. Mr. E. W. Oviatt, Field Construction Engineer of the Colorado State Highway Department, testified that the State Highway Department was interested only in the drainage problem presented by the new grade crossing. He stated that the Highway Department would be glad to cooperate with the County and the Railroad in the establishment of said drainage. Mr. G. B. Andress, Assistant Superintendent of the Sterling Divi- sion of the Chicago, Burlington & Quincy Railroad Company, testified that the ?iilroad had no objection to the opening of the new crossing if the other two crossings, as shown on Exhibit No. 1, were closed. The other two crossings referred to are located at Mile Post. 289.53 and at Nile Post 289.61, on the line of the Chicago, Burlington & Quincy Railroad Companyr between Sterling, Colorado, and Cheyenne, Wyoming. Mr. Andress stated that he had personally visited the site of the proposed crossing, together with Mr. Graham, District Engineer of the C. 8. 4: Q. Railroad Company, and that, at the time of said visit, it was observed that the natural drainage at the location of the proposed crossing is to the east, and that, if the approach road to the crossing did not have proper drainage, the water would back up to the northwest and would probably wash out the fill. The District Engineer told Mr. Andress that in his opinion it will be necessary to have at least an 18-inch diameter pipe for drainage under the proposed road -2- crossing. Mr. Andress further stated that if the proposed crossing is granted, the Railroad Company would furnish and install suitable barri- cades at the present existing crossings to effectively block these cross- ings in the event the Commission orders them closed. The Railroad also would remove existing crossing protection at the existing crossings if so ordered by the Commission. On July 1, 1949, the Commission received a letter from Paul N. Lodwick, County Superintendent of Schools of Weld County, asking that the Main Street crossing in Sligo be left open until August 15, 1949. This request was made in the event the Commission decided, after the hearing had been held, to order the above-mentioned crossing closed. The Superin- tendent stated that if the School District at Sligo was discontinued, they would want to move the school building to Grover, Colorado. It would be much more convenient if they could use the Main Street crossing to move the school instead of the proposed new crossing. The Commission also received a letter from W. D. Woodard, the rural mail-carrier for this area, in which be stated that the new proposed crossing would be a great benefit to him as, a rural mail-carrier, and to all the people residing in the country east of Sligo. He stated in the letter that, in the winter time, the Main Street crossing blocks badly after each heavy snowstorm, and that the new proposed crossing would eliminate this trouble. His letter also stated that the Grossing located south of Main Street, being Location "t' on Exhibit No. 1, has not been used for the past several years, and in his opinion was not necessary and should be closed; that even if the Main Street crossing is closed, he can give as good or better service to his patrons by the use of the new pro- posed crossing and the relocation of their rural mail boxes. He recom- mended the opening of the proposed crossing and also the closing of both existing crossings.. FiIik1zG� THE COMMISSION FINDS: 1. That the foregoing Statement is incorporated herein by -3- 30 ?G reference. 2. That the public convenience and necessity require the con- struction, establishment, and maintenance and operation of a County highway crossing, at grade, over the right of way and tracks of the Chicago, Bur- lington & Quincy Railroad Company at the lo9ation described in the fore- going Statement and as more fully shown in Exhibit No. 1. 3. _fit the pablie..eeavenianoa-nrd neoereity no longer require the two crossings now in existence at Sligo, Colorado, and that said crossings should be abandoned and closed. • THE COMMISSION ORDERS: That applicant, the Board of County Ommaisaioners of Weld County, Colorado, be, and it hereby is, authorised to construct, establish, main- tain, and operate a highway crossing, at grade, an and across the Chicago, Burlington & Quincy Railroad Company's right of way and tracks at a point designated as Mile Post 290.07, said point being more fully shown in Paw hibit No. 1, the same being made, by reference, a part hereof. That applicant, the Board of County Commissioners of Weld Counts., Colorado, shall furnish material and labor, at its own expense, to perform the necessary work of constructing said aroysing, and shall provide proper drainage, consisting of an 18-inch diameter:pipe of suitable length to allow proper drainage under the new crossing. That said applicant also shall furnish and install the "All Busses Stop" sign provided for in General Order No. .33 of The Public Utilities Commission of the State of Colorado, being designated as "W-4." That Chicago, Burlington & Quincy Railroad Company shalt provide and maintain a standard crosabuck sign, in conformance with Bulletin No. 3 of the .American Association of Railroads, Joint C®ittee on Grade Crossing Protection, as adopted by this Commission, at the new crossing site. That the public convenience and necessity no longer require the existing crossings located as shown in Exhibit No. 1 at Mile Post 289.53 and Mile Post 289.61, and the same shall be abandoned and closed, and the -4- the Railroad Company, at its expense, shall furnish and maintain suitable barricades and remove the materials on the Railroad right of way neces- sary to eliminate said existing crossings.
