HomeMy WebLinkAbout960749 RESOLUTION RE: CONSENT TO CORRECTION TO SUBDIVISION EXEMPTION #576 - CLAUS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on March 25, 1996, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, and Section 2-19 of the Weld County Subdivision Regulations, did approve Subdivision Exemption#576, for Clayton Claus, 3759 Weld County Road 36, Platteville, Colorado 80651, for property which is located in part of Section 3, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat, and WHEREAS, on April 24, 1996, the Board considered a request to consent to a correction to Subdivision Exemption#576, which will decrease said subdivision lot in size to allow for a 30-foot road along the south side of Highland Ditch, which allowance was originally intended by the applicants but was erroneously omitted, and WHEREAS, corrections to subdivision exemptions are allowed pursuant to Section 11.16 of the Weld County Subdivision Ordinance to correct errors in the plats of approved subdivision exemptions, if such corrections are consistent with the intent of the original applications. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the correction to Subdivision Exemption #576, submitted by Clayton Claus, be, and hereby is, consented to. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 24th day of April, A.D., 1996. The applicant is requesting to extend the external boundary of Lot B of RE-1860, as well as the external boundary of the subdivision lot (SE-576). Because the original recorded exemption/subdivision exemption applications were originally approved by the Board, Staff is submitting the requested changes to the applications for the Board's consideration. Olson Re: Boundary Survey on Claus RE 1860 and SE 576 and Olson Bros LLC NE 1/4 Section 3, Township 3 North, Range 68 West of 6th P.M. Request: Change boundary as surveyed When application for the RE and SE was applied for the boundary given was the one as recorded. However, the boundaries as used with the neighbors to the north arc different and a correction is requested. The yellow shows where Lot B will be expanded to the existing fence line and the blue line shows where SE 576 lot will decrease in size to allow for a 30 foot road along the south side of Highland Ditch. The SE lot will remain 4+ acres. Clayton Clays' The land owners to the north, Olson Bros LLC, have concurred and agree to the necessity of this boundary adjustment and further have agreed to exchange quitclaim deeds defining said boundary subject to review and approval of the legal description and also providing that the proposed cross- conveyances are not considered by the County of Weld to constitute any form of land split or division. Therefore, also request that you confirm that this boundary adjustment will not affect any current or future right of Olson Bros LLC, its heirs, successors or assigns, to subdivide or seek any other land uses that it may desire. �/./� el Roger E.
