FOR EXTENDED) DOCKET NO. 95A-54-9T WAIVER OF RULE 17 .2 , 4 CCR 723-2 . ) ORDER REOPENING DOCKETS, NOTICE OF HEARING, ORDER OF CONSOLIDATION, AND PROCEDURAL 9RDER Mailed Date : December 1, 1995 Adopted Date : November 29, 1995 I. BY THE COMMISSION: Statement 1 . The Commission hereby reopens Docket Nos . 92A-109T and 93A- 440T and sets a hearing in the above-captioned dockets . In Docket No. 92A-109T, Decision No. C93-36, the Commission approved the application by U S WEST Communications, Inc. ( "USWC" or "Company" ) , for completion of the second phase of the Rural Facilities Improve- ment Program ( "-RFIP II" ) . In part, the RFIP II orders mandated the conversion of all USWC multi-party telephone customers to single- party service by December 31, 1996, and also authorized special (''�,`c Il_ I CA/ • 952543 rate recovery of RFIP II costs through tariff riders . Decision No. C93-36 specified that if RFIP II conversions were not completed by the required dates, the authorized tariff riders would cease until completion. In Docket No. 93A-440T, Decision No. C94-206 the required schedule for completion of RFIP II conversions was accel- erated to December 31, 1995 . 2 . In Docket No. 95A-549T, USWC has requested a waiver of Rule 17 . 2 , 4 CCR 723-2 (multi-party customers must be converted to single-party status) as it relates to completion of RFIP II . That application suggests that the Company will not complete RFIP II requirements by December 31, 1995 as required by Decision Nos. C93- 36 and C94-206 . 3 . Docket Nos. 92A-109T and 93A-440T are hereby reopened for the purposes discussed here and are consolidated for hearing with Docket No. 95A-549T at the below-specified time and date . At the hearing scheduled in this order, the Commission shall consider USWC' s request for waiver as set forth in Docket No. 95A-549T. In the event the Commission denies the request for waiver and the Com- pany is unable to complete the RFIP II conversions by December 31, 1995, the hearing scheduled herein shall also address what orders the Commission should enter in response to the Company' s failure to complete the RFIP II conversions by December 31, 1995 . Such an order might include a directive to USWC to eliminate the RFIP II rider effective January 1, 1996 . 4 . USWC is directed to file a report updating the status of the RFIP II program (e.g. , the most currently available information regarding the number of multi-party customers who remain uncon- 2 verted to single-party status, the Company' s most current estimates as to when the program will be completed) on or before 12 : 00 p.m, December 12 , 1995 . In addition, at the hearing scheduled herein, the Company shall be prepared to present evidence and witnesses relating to these matters . Intervenors shall also be given the opportunity to present evidence and witnesses relating to these issues . 5 . The Company' s Motion to Substitute Exhibit B filed on November 27, 1995 will be granted. In the event any information to be presented in these dockets is claimed to be confidential-, the protective provisions set forth in Exhibit A, 4 Code of Colorado Regulations 723-10 are hereby established as the protective order herein. II. ORDER A. The Commission Orders That: 1 . Docket Nos . 92A-109T and 93A-440T are hereby reopened for the purposes stated in this Order. These dockets are hereby consolidated with Docket No. 95A-549T for the purposes stated here . 2 . Hearing in this matter shall be held at the following date, time, and place : TIME : 9 : 00 a.m. DATE: December 14 , 1995 PLACE : Commission Hearing Room A Office Level 2 (OL 2) Logan Tower 1580 Logan Street Denver, Colorado 3 U S WEST Communications, Inc. , and any intervenor shall be given the opportunity to present evidence and witnesses regarding the issues discussed above. 3 . U S WEST Communications, Inc . , shall file an updated report regarding the Rural Facilities Improvement Program II pro- gram on or before 12 : 00 p.m. , December 12 , 1995 . 4 . The Motion to Substitute Exhibit B filed on Novem- ber 27, 1995 by U S WEST Communications, Inc. , is granted. 5 . The provisions contained in Exhibit A, 4 Code of Colorado Regulations 723-10, are hereby established as the pro- tective provisions in this proceeding. 6 . This Order is effective on its Mailed Date.
