RE: APPROVAL OF AMENDED RECORDED EXEMPTION #1032 - BOATRIGHT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Amended Recorded Exemption#1032, does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land", and
WHEREAS, the request for Amended Recorded Exemption #1032 was submitted by
William Boatright, 33015 Weld County Road 10, Keenesburg, CO 80643, for property which is
located in part of the SW%of Section 10, Township 1 North, Range 63 West of the 6th P.M., Weld
County, Colorado, being more particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
154 acres and 5.4 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Amended Recorded Exemption #1032
submitted by William Boatright be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

AMENDED RECORDED EXEMPTION QUESTIONNAIRE
1. Explain the reason for the proposed recorded exemption and how each proposed lot will
be used.
The owners of the property acquired the original 160 +/- parcel in the mid 1980's. They
wished to provide for residences for-the parents and son in a rural setting and operate a
fanning enterprise. To that end, a prior Recorded Exemption was completed in 1987
(RE-I032) to create a 2 +/- acre parcel forplacement of the parent's home. At this time, it
is the desire of the applicants to modify the existing Lot "A" to a more practical and
applicable configuration as it relates to the creation of a separate new Lot "A" for the son's
home. The parents are retired and wish to sell off the farmland, yet retain rural homes for
the family. Theen-d result will be 2 separate rural residential parcels adjacent to one
another in a cluster type configuration, and a legal, separate farm parcel. This application
is being submitted concurrently with an application to create a new Lot "A" as shown on
the plat. Records will show a previous Mobile Home Zoning Permit for medical hardship
purposes that was properly utilized and consequently abandoned. The mobile home has
beenTemoved from the-property in accordance with appropriate regulations. The
proposed use of-he larger Lot "B" will be farming and agricultural production, as it is
good quality irrigated farm land. The proposed use-of-the smaller Lot "A" will-be as a
rural residence for the aforementioned family members (son & family). A barn, corrals,
machineshed, and other support buildings are also on-he smaller parcel.
2. Describe the location, size, and present use of the area where eachprnposed new lot will
be created
The parcel is located at the southwest corner of the intersection of Weld County Road 67
and Weld County Road 10, 1 mile southwest of the Town of Prospect Valley in-the
southeast part of Weld County. Weld Comity Road 10 is the south boundary of the
property and Weld County Road 67 is the west boundary. Access to all parcels exists off
WCR 10; no change in access is proposed. The-total acreage consists of approximately
159.4 acres ofcontiguous land, including the proposed new Lot "A". The smaller parcel
(amended Lot "A") will consist of 8.6 +/_ acres. Exact acreages will be determined-by
survey upon approval of this application.
The larger parcel is productive farmland irrigated by one large irrigation well-together with
waters derived from inclusion of the property in the Henrylyn Irrigation District. This
parcel would be considered prime agricultural land, except for the area occupied by the
dwellingand support buildings on proposed new Lot "A". Thereexists a year-to-year
crop share lease with a neighbor as the farm tenant. This proposal creates a split which
preserves the prime agricultural lands and existing improvements, resulting in no effective
loss of prime agricultural lands. The resulting 2 smaller parcels have existing dwellings,
support buildings, wells, and septics. No new wells, septics,or accesses are proposed.
The domestic water supply-for the smaller parcel (amended Lot "A") is provided by an
existing domestic well. The existing Lot "A" also has its own deep domestic well and
permitted septic system. The new proposed Lot "A" also has its own well and septic. The

larger parcel (Lot "B") has the availability to obtain a domestic well if needed in the
future. The parcel size is adequate to obtain a domestic well permit without restrictions at
this time. There is a separate, existing septic system serving each of the existing dwellings
on the smaller parcels. There is adequate acreage of a suitable nature to obtain a septic
system permit on the larger parcel should a future owner need to do so.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and
any adopted municipal plan, if applicable.
This parcel has been divided by a previous recorded exemption (RE-1032), created in
1987, well past the 5 year limitation on additional recorded exemptions as set forth in the
Comprehensive Plan. This proposed division creates a separate parcel for an existing rural
homesite and the larger parcelTemains as productive, irrigated agricultural land. The
purpose is to modify the boundaries of the existing parcel, secure legal parcels for farm
family members and allow the ability to sell off the-balance of the land, which is consistent
with the Comprehensive Plan. Both-parcels will-retain their "A" agricultural zoning. The
parcels are not located within 3 miles of an incorporated town.
4. Explain how the uses permitted will be compatible with existing uses surrounding the
proposed recorded exemption.
The uses of the nearby and surrounding properties include productive irrigated farmland
and individual rural homesites. This division will be compatible with the existing uses and
should pose-no discernible effect on the surrounding properties. No new dwellings are
proposed. This application utilizes existing housing stock, wells, and septics. To our
knowledge, the property is not located in allood plain, geologic hazard area, or overlay
district.
5. Explain how the proposal is consistent with the intent of the coning district within which
it is located
The zoning of both proposed parcels is "A" Agricultural and will remain so after-the
proposed-division. The proposed uses of rural homesite and productive farmland are
allowed under the provisions of this zoning classification. Apreviously approved Mobile
HomeZuning Permit for medical hardship purposes has been properly abandoned and is
no longer in existence.
6. Explain how the proposal is consistent with efficient and orderly development.
The smaller parcel has an existing dwelling built in 1987 on the existing amendedl.ot "A".
Lot B"B has a set of improvements which have been on the site in excess of 30 years. The
existing dwellings and support buildings are clustered in a corner of the larger parcel,
reducing the effect of"leapfrog" or-scattered housing locations. If a future owner should
decide to build a single family dwelling on-the larger parcel, it should pose little effect on
the area and surrounding parcels due to the size and location of the parcel.

7. Explain how adequate provision for protection of the health, safety, and welfare of the
inhabitants of the neighborhood and the County will be accomplished.
Each proposed parcel has either an existing septic system and domestic well, or the ability
to obtain same. With the location and limited density due to the creation of a single
additional lot and no additional proposed dwellings, there should be minimal to no effect
with regard to sheriff and/or police protection, fire protection, road maintenance, or
increased traffic. The site is located in the Southeast Weld Fire Protection District and is
served-by the Prospect Valley Volunteer Fire Department, located 1 1/2 miles away.
Since the purpose of the division is to accommodate retirement, provide legal rural
residential parcels for family members, allow for the sale of excess land, and preserve as
much prime agricultural land as possible, and since all criteria for division by Recorded
Exemption appear to be in order, we ask-that this request begranted.

Dear Planner Goranson:
We have reviewed the above referenced proposal to split a 5.4 acre lot from a 159.4 acre
parcel. The proposed water supply is to be from on lot wells. The 5.4 acre parcel is served by an
existing well, permit No. 153209, issued in 1989 for domestic_use. The permit application states
that this will be the only well on a 2 acre lot. The well is located 75 feet from the south section
line and 240 feet-from the west section line.
Submittal materials also included a statement of beneficial use for permit No.4248 received
in this office in 1986. This well appears to be at the same location as the well with permit No.
153209. If this well still exists and is no longer in service, then it should be plugged in accord with
the rules and regulations for well drillers and-pump installers, in order to prevent contamination
of ground water.
A well with permit No. 6758 is located on the larger parcel. We have no objection to the
proposal.
