Since that submittal in October, 1997, Planned Unit Development Ordinance #197 was put into effect in January, 1998. At the change of zone, the applicant is now submitting a five-lot PUD with one agricultural out lot. As per the new PUD Ordinance #197, Section 2.1 of the Access Standards, all PUD developments will be served by an internal paved road system that meets county standards. An exception to paving for a five lot or less rural PUD located in non-urban areas may be granted by the Director of Planning Services. The applicant is indicating a 22-foot gravel access road with four foot shoulders and eight inches of aggregate base course which exceeds the minimum standard for a minor subdivision. The applicant has identified, on the plat, a proposed ten feet of additional right-of-way reserved for future expansion of WCR 1(County Line Road). This was a requirement from my previous memo of October 28, 1997. REQUIREMENTS: All the new lots will utilize an internal road system with no direct access to WCR 1 (County Line Road). One access per legal parcel will be allowed and no circle drives are recommended. The storm water drainage plan has been modified to accommodate the reconfiguration of the parcel. I have checked and verified the calculations submitted by Rocky Mountain Consultants. This drainage report was accompanied by a document that was signed by a registered professional engineer. The applicant is indicating that a 40-foot easement will provide access to the five-lot PUD. Referring to Design Standards Subdivision Ordinance 173-E, Item #10.2.1.7.1, county roads shall have a minimum right-of-way width of 60 feet for the approach road from WCR 1 and the internal road running in a northern direction through the PUD. The 60 feet of dedicated right-of-way would accommodate utilities, drainage, and future expansion, plus pedestrian and horse traffic. Cul-de-sacs: cul-de-sacs serving no more than 20 lots may be permitted and must provide a minimum 65-foot turnaround radius and the outside curb or pavement edge radius must be 50 feet or more. 9S1..527 Page two Street Names: The applicant should supply street names which should be placed on the plat. if the applicant chooses not to select a name, the county will assign an appropriate road number to the PUD to accommodate addressing and mail delivery. The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water will be provided by the Longs Peak Water District and sewer will be provided by individual sewage disposal systems. The minimum proposed lot sizes (2.5 acres) and the overall density of homes per acreage (1 home per 7.3 acres) meets current Department policy. The application materials appear to have adequately addressed all of the potential impacts described in section 6.3.1.2.1 of the PUD Ordinance. In addition, after considering the proposed use, at this time, our staff is not aware of any potential environmental impacts or risks that this proposed development may pose that may represent an increased environmental impact or risk in excess of other similar developments. This site appears to be located in largely an agricultural area. It is generally surrounded by open agricultural fields, some of which may be used as biosolids application sites. However, there are several low density developments in the vicinity of the site. Many of these homes have livestock that include but may not be limited to cows and horses. It is our opinion that any future property owner should be made aware that these agricultural uses exist and that they may be exposed to dust, flies, odors, etc. in excess of the common urban experience. As a result, we recommend that the "Right to Farm" covenant be required to be placed on any recorded plat. In the event that you find the submitted application to be complete, we recommend that the following conditions be a part of any approval: 1) The applicant shall obtain water service from the Longs Peak Water District. 2) In the event that during construction >5 acres of the site is disturbed, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. 3) In accordance with the application materials, individual sewage disposal systems are required for the proposed residential lots and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 9S152'7 Bohrer, Kermit Page 2 4) The application materials indicate plans for a multiple use trail around the perimeter of the proposed site. Any manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. Trail maintenance shall include removal of manure in a manner that will prevent nuisance conditions. Please note: The Weld County Health Department, Environmental Protection Services recommends alternative strategies regarding water conservation and waste minimization. Considerations such as xeriscaping, low flow water fixtures, backyard composting and recycling are a few options available to home owners. We also recommend that preliminary radon mitigation measures be incorporated in the construction of new homes. Radon kits are available in our office. A Geotechnical Engineering Study prepared by Rocky Mountain Consultants (May 1998)was included in the referral. The RMC report is a thoughtful presentation of the salient features of the site and how they will affect development. RMC has adopted a conservative approach with respect to foundation and floor design on potentially expansive soil and they proposed engineered septic systems based on the shallow bedrock in the area. The RMC recommendations on subsurface drainage systems to accompany subgrade construction are equally valid. Excavation costs will increase where bedrock is encountered. The plat itself shows an understanding of the physical features of the property. Lots 1, 2 and 3 are located on high ground. Lot 4 is situated in a broad swale, but this should not cause adverse drainage conditions. The southeastern wetlands area has been left as open space. The nature of the community has been preserved with the 20-acre agricultural lot. In summary, the property should be successfully developed following the excellent recommendations in the geotechnical report. The projected student impact upon the St. Vrain Valley School District of 5 new single-family lots on 36.6 acres is a total of 4 students. Any students living in this subdivision would attend Mead Elementary School, Mead Middle School, and Skyline High School under the present school boundaries. While this development does not impact the middle or high school capacity, the elementary school is already over capacity. In addition, there are other approved developments in these attendance areas which will, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in the Mead Elementary area with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. The District would typically oppose this development because it adds to the enrollment of an already overcrowded school. However, it appears from the submittal information that the developer would participate with the District in the payment of a cash-in-lieu of land dedication fee in order to mitigate the impacts. A separate fee would be assessed, per the attached chart, prior to obtaining a building permit from the County. If this were to be accomplished there would be no opposition from the School District. Division 1, W. District 5 Dear Mr. Hodges: We have reviewed the above referenced proposal to subdivide a 36.6-acre parcel into four single-family residential lots and one agricultural lot. The Water Supply Information Summary requested in the State Engineer's memorandum of August 7, 1995 was not included and no other information on projected water use was provided. The source of water supply is to be the Longs Peak Water District, and a letter of commitment for service was included. However, the District indicated that this commitment for service would expire six months from the date of their letter (October 6, 1997) should the taps not be purchased and installed by that date. There is no evidence submitted with the referral to indicate that this condition of the District's was met and that the commitment for service is still valid. In addition, pursuant to Section 30-28-136(1 )(h)(II), C.R.S.., a municipality or quasi-municipality, upon receiving the preliminary plan designating said municipality or quasi-municipality as the source of water for a proposed subdivision, shall file, with the board of county commissioners and the state engineer, a statement documenting the amount of water which can be supplied by said municipality or quasi-municipality to proposed subdivisions without causing injury to existing water rights. A report of this nature was not included in the submitted materials. (Weld County Case Number S-437), located east and adjacent to Weld County Road 1, approximately 1/2 mile north of State Highway 66. The property is within the boundaries of the Mountain View Fire Protection District and receives fire protection from the District. The Fire District does not object to the subdivision provided all applicable codes as they pertain to water supply, fire hydrant locations, street widths, designs-and fire department access are met. The Fire District has the following comments with regard to the plans as submitted: • Buildings shall be constructed in accordance with the provisions of the 1994 Edition of the Uniform Fire Code, as adopted by the Weld County Commissioners, and the 1994 Edition of the Uniform Building Code, as enforced by Weld County. • Water supply for fire protection must provided for all subdivisions. The minimum required water supply for a residential subdivision, where one- and two family dwellings do not exceed 3,600 gross square feet, is 1,000 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.). All other buildings (including larger one- and two-family dwellings) require a minimum fire flow of 1,500 gallons of water per minute, measured at a residual pressure of 20 • pounds per square inch (p.s.i.) and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. The installation of residential fire sprinkler systems will reduce requirements for fire apparatus access when two means of access are not possible, but your recent plan shows an emergency access will be provided, so again the requirement for the residential sprinkler systems will not assist you in the actual development of the subdivision. • It may be wise to record in the covenants you have provided fire protection for homes up to X square feet in size and anything over that square footage would require the installation of an automatic fire sprinkler system so that those purchasing lots know what is required should they decide to building a larger home. • Fire apparatus access roads, including emergency access roads, must be designed and maintained to support the imposed loads of fire apparatus (60,000 pounds) and must have a surface that provides all-weather driving capabilities. Fire apparatus access roads must be approved before building permits are issued. If the emergency access road is closed off to non-emergency traffic at any time, then the method of closure must be approved by the Fire District. • Street intersections must be marked with signs showing the street name and address range. If standard street signs are used, then the signs do not need to be submitted to the Fire District for approval. If non-standard street signs are used, the signs do need to be submitted to the Fire District for approval. • All buildings within the subdivision, including single-family residences, shall have a legible address that is clearly visible from the street fronting the property. • If there are existing gas/oil wells in the area, they need to be shown on future plan submittals. Streets shall not be within 75 feet of existing oillgas wells, and buildings shall be constructed within 100 feet of existing oil/gas wells. Buildings that are classified as a place of assembly, institution or school shall not be constructed within 300 feet of existing oil/gas wells. • Construction plans for the utilities, showing fire hydrant locations and water main sizes, will need to be submitted to the Fire District for review and approval. Fire hydrants shall be spaced along fire apparatus access ways so that spacing does not exceed 500 feet. Dead-end water lines serving fire hydrants must be a minimum of 8- inches in diameter.
