HomeMy WebLinkAbout962281.tiff RESOLUTION RE: APPROVE AMENDED CERTIFICATE OF DESIGNATION FOR ADDITION OF COMPOSTING AND RECYCLING FACILITIES, PERIMETER BERM, RELOCATION OF SEDIMENT BASIN, AND REVISION TO CELL C FOR AN EXISTING SOLID WASTE DISPOSAL SITE - LAIDLAW WASTE SYSTEMS (COLORADO), INC. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of December, 1996, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Laidlaw Waste Systems (Colorado), Inc., P. O. Box 320, Erie, Colorado 80516, for an Amended Certificate of Designation for the addition of composting and recycling facilities, perimeter berm, relocation of sediment basin, and revision to Cell C for an existing solid waste disposal site, on the following described real estate, to-wit: Part of Section 29, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was represented by Fred Otis, Attorney, at said hearing, and WHEREAS, said request for an Amended Certificate of Designation was submitted in conjunction with an application for a Site Specific Development Plan and Second Amended Special Review Permit for the addition of composting and recycling facilities, perimeter berm, relocation of sediment basin, and revision to Cell C for an existing solid waste disposal site, which was approved by the Board, and WHEREAS, Section 30-20-100.5, et seq., CRS, and regulations promulgated thereunder, provide standards for review of said Amended Certificate of Designation, for which the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and WHEREAS, Section 30-20-104, CRS, as amended, requires the Board to take into account certain factors to approve a Certificate of Designation and, having taken into account said factors and having been fully informed, the Board finds that this request shall be approved for the following reasons: 1. The Conditions of Approval and Development Standards in Second Amended Special Review Permit#972 will minimize the impacts on the surrounding property and the area to the greatest extent possible. The Conditions of Approval and Development Standards will also provide adequate protection of the health, safety, and welfare of the inhabitants of the area and the County. 2. The applicant has demonstrated in the submitted application materials there is a need for the proposed solid waste disposal site. 4. The applicant has demonstrated in the submitted application materials the ability to comply with the health standards and operating procedures of the Solid Waste Disposal Site and Facilities Act, Section 30-20-100.5, et seq., CRS. 5. The Colorado Department of Health and the Weld County Health Department have reviewed this request and find, subject to conditions, the proposal will comply with the Standards of the Solid Waste Disposal Sites and Facilities Act, Section 30-20-100.5, et seq., CRS. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that an Amended Certificate of Designation for Laidlaw Waste Systems (Colorado), Inc., for the addition of composting and recycling facilities, perimeter berm, relocation of sediment basin, and revision to Cell C for an existing solid waste disposal site, on the hereinabove described real property be, and hereby is, granted subject to the following condition(s): 1. The property shall be maintained in compliance with Second Amended USR#972, all submitted application materials on file with Weld County, and all requirements of the Weld County Health Department and the Colorado Department of Public Health and Environment. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 18th day of December, A.D., 1996. Location of Site: Part of Section 29, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado Name and Address of Responsible Operator: Laidlaw Waste Systems (Colorado), Inc. P. O. Box 320 Erie, Colorado 80516 This Amended Certificate of Designation may be temporarily suspended or revoked, after reasonable notice and public hearing, for cause as outlined in Section 30-20-112, CRS, as amended.
