HomeMy WebLinkAbout991290.tiff Firestone A Community In Motion CLEF To11 - _ May 17, 1999 Board of Weld County Commissioners 915 10th Street Greeley, CO 80632 RE: Del Camino Junction Ladies and Gentlemen: This letter is in reference to our Interim Planning Coordinating Agreement (County Ordinance 195) and our recently adopted Intergovernmental Agreement regarding Uniform Baseline Standards (County Ordinance 201). Extensive hours of effort and significant costs have been put into the development of these documents by the Town of Firestone, Weld County, and others, with the ultimate goal being the positive control of urbanization in southwest Weld County. As you know, these Agreements have won Smart Growth Awards from the Governor's Office for the two previous years. It has come to our attention that in spite of our objections at the Weld County Planning Commission on May 5, 1999, the Board of County Commissioners voted to approve the final subdivision and development plan for "Del Camino Junction" which is located within the mutually agreed Firestone Urban Growth Boundary. Moreover, the County apparently permitted a 100-foot reduction in the minimum setback from 1-25. The reduction in setback was in direct conflict to the County's adopted Ordinance 201 and our Intergovernmental Agreement relative to minimum Baseline Development Standards. The Town of Firestone takes great objection to this action by the Board of County Commissioners and can reach no other conclusion than that the County is not interested in cooperative development agreements with the Town of Firestone for this area. If the County really cared about the goals and objectives of the two intergovernmental agreements between Firestone and the County, it would not have proceeded in a manner so clearly inconsistent with the goals and the spirit of the agreements. It is regrettable that the County did not provide the Town with notice of the date and time of the County Commissioners Hearing so that the Town 150 Buchanan P.O. Specifically, the Town of Firestone has been expending great effort to work with the County and the other area communities to ensure that the type of development that happened in Del Camino west of 1-25 does not happen in the Town of Firestone Urban Growth Area east of 1-25. We thought that the County concurred in this goal. It appears that if the County Board of Commissioners does not reconsider and correct its action of May 5th relative to the Del Camino Junction approval, the Town of Firestone has two options: • The first would be to file legal action to request that the Court overturn the May 5 decision and enforce the Town's position against the County relative to the agreements. • The second would be to provide notice to the County and the other participants in these agreements that the Town of Firestone is withdrawing from participation in both agreements. The Town of Firestone Board of Trustees does not believe it is appropriate to require the citizens of the Town to comply with agreements with Weld County when the County does not appear to be committed to similar compliance for projects it reviews. Over the next few weeks the Town Board will decide which of the above options would be in the best interest of the citizens of Firestone. In the meantime, we would request that the Commissioners reconsider their action and correct it, removing our necessity to proceed with either option. We desire to move forward in the positive spirit with the County with these IGAs, as recognized by the Governor's office, but we certainly need the specific cooperation from Weld County.
