RE: APPROVAL OF RECORDED EXEMPTION #1707 - GILES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1707, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1707 was submitted by Edward Giles,
do Douglas Stolte, Colorado Land Associates, 1019 10th Avenue, Suite 1, Greeley, Colorado
80631, for property which is described as Lot B of Minor Subdivision #16, which is part of the SE
1/4 of Section 32, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado,
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
76.71 acres and 9.29 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1707 submitted by
Edward Giles be, and hereby is, approved conditional upon the following:
1. Any existing septic system(s) which is not currently permitted through the Weld
County Health Department will require an Individual Sewage Disposal System
(ISDS)evaluation prior to the issuance of the required septic permit(s). In the event
the system(s) is found to be inadequate, the system(s) must be brought into
compliance with current ISDS regulations.
2. Access shall be limited to one access per legal parcel. All other accesses shall be
abandoned.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

4. Prior to recording the plat, the applicant shall:

Subject: Recorded Exemption 1707, described as the SE4 of section 32, T5N, R64W of the 6th
P.M., Weld County, Colorado
Dear Commissioners:
This request for a recorded exemption is submitted by Edward M. Giles. The parcel of land on
which this request is made is described as Lot B of Minor Subdivision 16, which is part of the SE4
of Section 32, T5N, R65W of the 6th P.M., Weld County, Colorado. The property is located north
of and adjacent to Weld County Road 50 and west of and adjacent to Weld County Road 53. The
request is to divide a 86 acre parcel, into 76.71 acres and 9.29 acres, more or less. This request
lies within the urban growth boundary area of the Town of Kersey. The Town of Kersey has no
concerns with this request.
The applicant has stated that the reason for the recorded exemption is to sell off the existing farm
improvements and maintain the existing farm ground. The proposed recorded exemption would
split off an existing residence from the balance of the property, and create an additional buildable
lot.
Central Weld County Water Conservancy District provides water service to Lot A and is proposed
for Lot B. A septic system provides sewer service to Lot A and is proposed for Lot B. Access is
existing onto Weld County Road 50 and onto Weld County Road 53. No new accesses are
proposed at this time. The Weld County Health Department and Public Works Department have
reviewed this request and have no conflict of interest.
The Department of Planning Services' staff has concerns about this proposal based on the level
of development in the vicinity. The section where this proposal is located has 24 parcels. Six

recorded exemptions, three amended recorded exemptions and one minor subdivision have been
approved in this section. Further division of this section does not conform to efficient and orderly
development.
Staff also has concerns about the level of development that has occurred in this area and the
potential for continued divisions. The Board should consider whether it wants to allow this type of
piecemeal development to continue. Continued divisions of this type evade the intent and purpose
of the Weld County Subdivision Ordinance and the Weld County Comprehensive Plan.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Sections 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been meet.
