RE: APPROVE DEED OF DEDICATION AND ACCEPTANCE AND AUTHORIZE CHAIR TO
SIGN -GUTHRIE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Deed of Dedication and Acceptance
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Robert and Pamela Guthrie, 8 Dos Rios, Greeley,
Colorado 80634, with further terms and conditions being as stated in said deed of dedication,
for property located as described in Exhibit A, and
WHEREAS, after review, the Board deems it advisable to accept said deed of
dedication, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Deed of Dedication between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, and Robert and
Pamela Guthrie be, and hereby is, accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said acceptance.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of August, A.D., 1999.

DEED OF DEDICATION
KNOW ALL MEN BY THESE PRESENTS that Robert N. Guthrie and Pamela C. Guthrie,
whose address is 8 Dos Rios, Greeley, Colorado 80634, Grantors, being the owners of the property
in Weld County, Colorado,which is described in the attached Exhibit"A," do hereby dedicate to the
public, forever, said property as an easement for the location, placement, maintenance, repair and
replacement of utilities, including, but not limited to, water, sewer, and gas pipes, telephone, and
power lines and poles. Such easement includes the provision of reasonable access to accomplish the
same. Grantors expressly agree that they shall refrain from erecting or constructing any structures
within said easement and/or allowing such erection or construction to occur.

PROPERTY DESCRIPTION OF UTILITY EASEMENT
The north ten feet(10') of the south forty feet(40') of Parcel A, as shown on the plat recorded March 25, 1998,
in the Office of the Weld County Clerk and Recorder at Reception Number 2601845.

ACCEPTANCE
The County of Weld, a body corporate and politic of the State of Colorado, by and through
its Board of County Commissioners, by and on behalf of the public, hereby accepts the above
dedication of property as an easement for the location, placement, maintenance, repair and
replacement of utilities, including, but not limited to, water, sewer, and gas pipes, telephone, and
power lines and poles. Such easement includes the provision of reasonable access to accomplish the
same.

RE: Deed of Dedication and Acceptance for Utility
Easement
Dear Mr. and Mrs. Guthrie:
This letter and the enclosed are in response to a telephone call I received from Mr. Guthrie
approximately two weeks ago regarding the vacation of Compo Way through a Minor Resubdivision
processed by the Department of Planning Services and approved by the Board of County Commissioners
of Weld County. Enclosed is a copy of the Resolution of the Board of County Commissioners approving
the Minor Resubdivision, dated March 24, 1999. As you can see, Item 2.D states your recommendation
by the Department of Planning Services that you provide a utility easement extension. It is my
understanding that you do not have an objection to extending the utility easement, but are in a quandary
as to how to do so.
Enclosed is a Deed of Dedication and Acceptance which will accomplish the extension of the utility
easement. The Deec of Dedication must be signed by you and acknowledged by a notary public. Once
the Deed of Dedication is signed and notarized, please send it and the Acceptance to my office at: 915
Tenth Street, P.O. Box 1948, Greeley, Colorado 80632. I will then see that the Acceptance is approved
by the Board of County Commissioners and signed by the Chairman.
