COLORADO Linda Naticchioni Bataa Oil, Inc. 2500 W. 29th Street Greeley, CO 80631 RE: Letter of January 29, 1998 Dear Ms.Naticchioni: The Board of County Commissioners of Weld County has received your letter of January 29, 1998, regarding the Dacono 1, 2, 3, and 4 wells located in Section 6,Township 1 North,Range 67 West of the 6th P.M., Weld County, Colorado. In your letter, on behalf of Bataa Oil you offer to purchase the Weld County royalty interest in the wells for the sum of$600.00. Your letter also suggests that a check in the sum of$19.20, which "covers a one month period,"was enclosed with the letter. The computer printout shows that the check was apparently number"11135," and dated January 27, 1998. Please be advised that no such check was enclosed with your letter. The Board of County Commissioners of Weld County does not have a policy or practice regarding the sale of royalty interests on active oil and/or gas wells. The Board may be interested in your proposal;however, it is my opinion that the amount of$600.00 is a low figure. That sum represents a little over two and one half years of royalty interests. The Board's file shows that these wells have been producing since the mid to late 1970's and,therefore, should be expected to continue well past the two and one half year time frame of your offer. As an additional matter, I note that your figure includes the deduction of ad valorem taxes on Weld County's royalty interest. Please be advised that Weld County is exempt from paying ad valorem taxes and such sums should not be deducted from the County's royalty interest payments.
