RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST RUBEN AND RUBY ANCHONDO FOR VIOLATION OF
THE WELD COUNTY ZONING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ruben and Ruby Anchondo, VI #9800181, are allegedly in violation of the
Weld County Zoning Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of January, 1999, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Ruben and Ruby Anchondo were not present or represented at said
hearing, although all parties were notified of said hearing by Department of Planning Services
staff, and
WHEREAS, the Board deems it advisable to bring legal action against those individuals
as hereinabove named to correct said violation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to
proceed with legal action against Ruben and Ruby Anchondo to remedy the violation of the
Weld County Zoning Code Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

CASE SUMMARY
November 6, 1998 Initial compliant of miscellaneous derelict vehicles being stored on the property was
received.
November 12, 1998 Site inspection conducted. Five day letter sent.
November 20, 1998 Thirty day letter sent certified mail signed for by Sandra Enriquez.
November 25, 1998 A notice (English and Spanish) was left on the property attached to the "loader"
requesting the owner to contact Sharyn Frazer, Code Compliance Officer, as soon as
possible.
November 25, 1998 A notice (English and Spanish) was left on the front door of 204 S. 11th Avenue,
Brighton, requesting that the owner contact Sharyn Frazer, as soon as possible.
December 11, 1998 Progress inspection conducted. The number of derelict vehicles, camper trailers and
mobile homes had increased.
December 21, 1998 Letter sent to Mr. and Mrs. Anchondo scheduling them to appear before the Board of
County Commissioners at violation hearings on January 12, 1999, at 10:00 a.m.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I have scheduled
a meeting with the Board of County Commissioners on January 12, 1999,at 10:00 a.m.,to consider the violations
occurring on the property. This meeting will take.place in the County Commissioners' Hearing Room, First Floor,
Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a
representative be in attendance to answer any questions the Board of County Commissioners might have about
the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

Dear Mr. and Mrs. Anchondo:
The uses on the above described property are being considered asa zoning violation of Sections 31.2, 31.3.9 and
43 of the Weld County Zoning Ordinance.
The noncompliance issue is a noncommercial junkyard located in the A (Agricultural) zone district consisting of
two mobile homes trailers, two semi-trailers, approximately 20-25 derelict vehicles, an old school bus and an old
boat. It appears that the semi-trailers and mobile home trailers are being used as an attempt to screening the
remaining vehicles from view.
