HomeMy WebLinkAbout972450.tiff RESOLUTION RE: APPROVAL OF COMPREHENSIVE MANURE RUN-OFF AND PROCESS WASTE WATER HANDLING PLAN FOR SPECIAL REVIEW PERMIT #1091 - HIRSCH DAIRY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Comprehensive Manure Run-Off and Process Waste Water Handling Plan for a 2,000-head dairy, concerning Special Review Permit #1091 for Hirsch Dairy, which is required to meet the requirements concerning the health, safety, and welfare of the neighborhood, and WHEREAS, on December 16, 1996, the Board did approve Special Review Permit #1091, subject to the Board's final review and approval of Conditions of Approval #2.A. through #2.D. to ensure adequate protection for the health, safety and welfare of the inhabitants of the neighborhood and County, and WHEREAS, Conditions 2.A through 2.D of said Special Review Permit required the submission of a Comprehensive Manure Run-Off and Process Waste Water Handling Plan, a Dust Abatement Plan, a Fly Control Plan, and an Odor Abatement Plan for said dairy, and WHEREAS, a hearing was held before the Board on November 5, 1997, at which time the Board deemed it advisable to approve the Dust Abatement Plan, Fly Control Plan, and Odor Abatement Plan for said dairy in accordance with Condtions 2.B through 2.D, and to continue review of the Comprehensive Manure Run-Off and Process Waste Water Handling Plan to November 19, 1997, and WHEREAS, at said hearing on November 19, 1997, the applicant was represented by John Chilson, Attorney, and WHEREAS, after hearing testimony presented and based upon the recommendations of staff from the Departments of Planning and Health and the Colorado Department of Public Health and Environment, the Board deems it advisable to approve the Comprehensive Manure Run-Off and Process Waste Water Handling Plan for a 2,000-head dairy, concerning Special Review Permit #1091, and 972450 PL Q uwA PL1059 RE: USR#1091 - HIRSCH DAIRY PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Comprehensive Manure Run-Off and Process Waste Water Handling Plan for a 2,000-head dairy concerning Special Review Permit#1091 for Hirsch Dairy, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that approval of said Plan is conditional upon the following: 1. Due to the minimal separation between groundwater and the retention pond liner observed near MW-1, the applicant is required to obtain a minimum of eight consecutive quarters of"groundwater elevation" readings in each of the three monitoring wells surrounding the retention structure. Following each four quarters of data accumulation, the applicant shall submit a report to the Weld County Health Department demonstrating the date of measurement, well number, top of casing elevation, depth to water, groundwater elevation, pond bottom elevation, and separation difference. In the event these readings demonstrate the groundwater elevation exceeds that of the base of the pond liner, the facility shall develop a mitigation plan to protect groundwater quality. The mitigation plan shall be developed and implemented (pending review and approval) within 30 days of determining that the groundwater elevation exceeds that of the base of the pond liner. The plan shall be submitted to the Weld County Health Department and the Colorado Department of Public Health and Environment for review and approval. 2. The applicant shall provide to the Weld County Health Department and the Colorado Department of Public Health and Environment 45 days notice before manure is stockpiled on site for review of soil compaction information and drainage patterns. 3. The applicant shall complete construction and submit post-construction reports on the east retention pond, tailwater pond, and any associated structure by March 1, 1998. 4. The plan shall be amended to define the approved seepage rate for all ponds to be 1 X 10-6 cm/sec. BE IT FURTHER RESOLVED, by the Board that this Resolution shall constitute the final Board decision on Special Review Permit#1091, issued to Hirsch Dairy. 972450 PL1059 RE: USR#1091 - HIRSCH DAIRY PAGE 3 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 19th day of November, A.D., 1997.
