RE: ACTION OF THE BOARD CONCERNING VIOLATION #9800173 OF THE WELD
COUNTY ZONING ORDINANCE AGAINST ED AND DEANNE ZYRONSKI
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Ed and Deanne Zyronski, VI #9800173, are owners of property in Weld
County, Colorado, whose legal description is Lot B of RE-2167, being part of the West Half,
Southeast Quarter of Section 32, Township 7 North, Range 64 West of the 6th P.M., Weld
County, Colorado, and
WHEREAS, the question has been presented to the Board as to whether Ed and
Deanna Zyronski are in violation of the Weld County Zoning Ordinance, insofar as an old
"bunkhouse" located on the Property is being resided in by Mr. Zyronski's mother, Velda
Goodrich, and
WHEREAS, on the 8th day of December, 1998, a public hearing was held before the
Board of County Commissioners for the purpose of hearing evidence relating to said question,
and
WHEREAS, Ed and Deanna Zyronski were present at said hearing and provided the
following:
A. Written evidence from Velda Goodrich's doctor, Dr. Clark Conant, stating that
she is in need of close monitoring by family members because of her medical
condition;
B. Testimony that because of their financial condition, neither the Zyronskis nor Ms.
Goodrich have the means for her to live and be closely monitored elsewhere;
C. Testimony that adequate water and sewage disposal facilities are available to
the "bunkhouse;"
D. Testimony promising that continued residential use of the "bunkhouse" shall be
by Ms. Goodrich only and shall cease upon either the cessation of her medical
hardship or her moving to another residence; and
E. Testimony promising that the Zyronskis shall apply for a building permit for the
furnace addition to the "bunkhouse," which permit shall reflect the temporary
residential use during Ms. Goodrich's medical hardship and shall address the
remaining electrical work necessary from the previous building permit.
WHEREAS, Section 43.2.4 of the Zoning Ordinance allows the temporary use of a
mobile home by a person under a medical hardship, if there is documentation that the persons
residing in the principal dwelling unit on the property will provide supervision and care of the
person in the mobile home during such temporary medical hardship.

NOW, THEREFORE, BE IT RESOLVED, the Board of County Commissioners finds and
determines that, given the written evidence presented by the Zyronskis and their promises
stated on the record, the residential use of the "bunkhouse" by Ms. Goodrich during her medical
hardship meets the intent of Section 43.2.4 of the Weld County Zoning Ordinance and shall be
allowed to continue, as long as the following conditions are met:
1) The continued residential use of the "bunkhouse" shall be by Velda Goodrich
only and shall cease upon either the cessation of her medical hardship or her
moving to another residence;
2) Ed and Deanna Zyronski shall provide to the Department of Planning Services
staff the annual documentation of Velda Goodrich's medical hardship, as
required by Section 43.2.4.1.1 of the Weld County Zoning Ordinance;
3) Ed and Deanna Zyronski shall apply for a building permit for the furnace addition
to the "bunkhouse," which permit shall reflect the temporary residential use
during Velda Goodrich's medical hardship and shall address the remaining
electrical work necessary from the previous building permit.
BE IT FURTHER RESOLVED by the Board that VI #9800173 be, and hereby is,
dismissed, but shall be reinstated if Ed and Deanna Zyronski fail to comply with any of the three
conditions stated above.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 8th day of December, A.D., 1998.

CASE SUMMARY
November 2, 1998 Initial compliant received from the Weld County Assessor's Office that an old
"bunkhouse" located on the property was being used a living quarters for Mr.
Zyronski's elderly mother. Property research revealed that this structure had previously
been used as living quarters for someone when Mr. Klein (previous property owner)
owned the property. A recorded exemption was processed for the property and a
condition of approval stated that the kitchen facilities would need to be removed and
the building converted to an office for personal use. Inspections were conducted to
determine that the conditions were met and Building Permit BC-9800367 was issued.
(See correspondence located in the back of the packet.)
November 2, 1998 Five day letter sent.
November 4, 1998 Telephone call between Sharyn Frazer, Code Compliance Officer and Gene Oblander,
Realtor. Mr. Oblander expressed concerns that he had sold this property to Mr.
Zyronski and informed him that the structure could be used as living quarters for his
mother.
November 4, 1998 Mr. Gene Oblander came into the Department of Planning Services and met with Scott
Ballstadt and Sharyn Frazer. Scott Ballstadt asked Mr. Oblander to write a letter
explaining the situation and he would present it at the Planning Staff meeting on
Thursday 11-5-98. Various options were discussed to bring the property into
compliance.
November 5, 1998 Thirty day violation letter was sent to Mr. Zyronski along with a letter from Scott
Ballstadt explaining the history on the property and options available to them to
achieve compliance.
November 10, 1998 Discussion between Commissioners Barbara Kirkmeyer, Monica Daniels-Mika and
Sharyn Frazer. Commissioner Kirkmeyer stated she would speak with the other
Commissioners to determine if a work session should be scheduled to address this
issue.
November 18, 1998 Commissioners work session. It was determined that a building inspector should
inspect the structure for any building code issues. It was also determined that the
Department of Planning Services should schedule Mr. Zyronski and Mr. Oblander to
appear at the violation hearings set for December 8, 1998, @ 10:00 a.m.

December 1, 1998 Letter addressed to Mr. Ed Zyronski scheduling him to appear before the Board of
County Commissioners at the violations hearings on December 8, 1998, at 10:00 a.m.
December 3, 1998 Inspection conducted by Dave Sprague, Building Official and Sharyn Frazer, Code
Compliance Officer. A perimeter site inspection revealed that everything seems to be
okay from the outside.
December 3, 1998 Telephone call between Scott Ballstadt, Lead Planner and Gene Oblander, Realtor.
Scott confirmed that Mr. Oblander was aware of the violation hearing scheduled for
December 8, 1998, at 10:00 a.m. Mr. Oblander stated that his daughter was involved
in a serious automobile accident that may prevent him from attending. He stated that
he would make every effort to attend the hearing.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

to consider the violations occurring on the property. This meeting will take place in the County Commissioners'
Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of County
Commissioners might have about the violation. It would be beneficial if you could provide justification for a
medical hardship and possibly provide a doctor's letter substantiating this. Planning staff will also be calling Mr.

SUBJECT: VI-9800173/Lot B of RE-2167/Gene Oblander Real Estate
RE-2167, located north of and adjacent to WCR 74 approximately % mile east of Galeton, was
approved by staff on March 5, 1998. During a field check on March 4, 1998, staff discovered an
unpermitted mobile home on the property, in addition to the principal stick-built house. Staff
included a condition of approval for RE-2167 that the mobile home be removed. On April 3,
1998, staff verified that the mobile home had been removed, however, it appeared that an
outbuilding was now being occupied. Staff contacted Mr. Roger Klein, applicant, who verified
that someone was living in the outbuilding. Mr. Klein also indicated that the structure was an old
bunkhouse which had historically been used as a residence. Staff contacted the Weld County
Assessor's Office to verify such. Mr. Jerry Scoby, Assessor's Office, indicated that Mr. Klein had
called him and informed him that the bunkhouse had only been used as a residence for about
1%weeks and that the bunkhouse had historically been taxed as an outbuilding. There were
also no building permits on record for the bunkhouse.
Staff informed Mr. Klein that the additional residence would need to be removed prior to
recording his plat for RE-2167. Mr. Klein asked staff what would be required if he wanted to use
the bunkhouse for an office. Staff required Mr. Klein to remove the kitchen facilities and apply
for the appropriate building permits on the bunkhouse. Mr. Klein proceeded and staff verified
that the kitchen facilities had been removed on May 4, 1998. The building permits to convert the
bunkhouse into an office were applied for on April 27, 1998.
The plat for RE-2167 was recorded on May 6, 1998 and contains a note stating that Section
31.2.1 of the Weld County Zoning Ordinance allows for one single family dwelling unit as a use
by right.
The Weld County Assessor's Office notified the Department of Planning Services that the
bunkhouse was once again being used as a residence and a contact letter was sent to Mr.
Zyronski, new owner of Lot B, RE-2167, from Sharyn Frazer, Zoning Compliance Officer, on
November 2, 1998. The letter notified the property owner of the combination zoning and building
code violation, as the building permits were never finalled. After receiving no response, a
Zoning Violation Notice was issued for VI-9800173 on November 5, 1998.
Mr. Gene Oblander, realtor, came to the Department of Planning Services on November 4, 1998
and indicated that he had sold Lot B of RE-2167 to Mr. Ed Zyronski with the intention of utilizing
the bunkhouse as living quarters for Mr. Zyronski's elderly mother. According to Mr. Oblander,
the kitchen facilities had been re-installed in the bunkhouse as a contingency in the buyers
contract. Staff informed Mr. Oblander of the different options that are allowed by the Ordinance,
however, he indicated that those were not an option due to financial constraints. Staff sent the
Zyronski's.a letter dated November 6, 1998, outlining the meeting with Mr. Oblander and
indicating the steps to bring the property into compliance.
The November 5, 1998, Violation Notice allows 30 days to correct the violation.

Dear Mr. and Mrs. Zyromski:
On November 4, 1998, Sharyn Frazer, Zoning Compliance Officer, and I met with Mr. Gene
Oblander to discuss your unfortunate situation.
Mr. Oblander indicated that he had marketed and you had purchased Lot B of Recorded
Exemption 2167 with the intent to restore and inhabit the bunkhouse on the property. However,
Section 31.2.1 of the Weld County Zoning Ordinance only allows for one single family dwelling
unit per legal lot. The Zoning Ordinance does allow for temporary accessory mobile homes and
auxiliary quarters which must be attached to the primary dwelling under certain circumstances
such as a medical hardship, houuever, permanent accessory dwellings are not allowed.
This information was also clearly conveyed to Mr. Klein, as he was required to remove the
kitchen facilities in the bunkhouse and convert it town office as a condition of approval for RE-
2167. Additionally, the plat for RE-2167, which was recorded on May 6, 1998, contains a note
which states that Section 31.2.1 allows for one single family dwelling unit as a Use by Right.
Therefore, the kitchen facilities must once again be removed and the bunkhouse must be
returned to an office use in order to comply with the Weld County Zoning Ordinance and to close
VI-9800173. If a medical hardship does exist and you wish to place a temporary accessory
mobile home on the property, please contact me and I will be more than happy to assist you with
the permitting process.

The uses on the above described property are being considered as a zoning violation of Sections 31.2, 31.2.1 and 31.2.2
of the Weld County Zoning Ordinance.
The structure that is being used as living quarters for a family member is not a use allowed by right in the A (Agricultural)
zone district. The active building permit (BC-9800367) was issued for an old bunkhouse to be converted to an office
for personal use. It was determined that the sink, stove and refrigerator be removed from the structure( inspections were
approved), and the Weld County Health Department approved the septic for office use only. This property was
previously in violation (VI-9800173), and the conversion of this structure to an office for personal use brought the
property into compliance at that time.
I have included copies of the sections of the Zoning Ordinance that apply to this issue. It is the intention of this office
to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if
you fail to correct this violation. You have 30 (thirty) days from November 5, 1998, to correct this zoning violation.
Failure to do so will result in this office scheduling the violation before the Board of County Commissioners to consider
whether to refer the violation to the County Attorney's Office for legal action.
Any information you have that may help to resolve this matter will be helpful. This office is ready to be of any assistance

Dear Mr. Klein:
Department of Planning Services staff conducted a field check on 4/3/98 to verify that the mobile
home had been removed from the prol:.erty to satisfy a condition of approval for your recorded
exemption application RE-2167. It was verified that the mobile home has been removed,
however, staff also verified that an outbuilding on the property is also being utilized as living
quarters. This was confirmed in my phone conversation with you on 4/3/98.
The uses on the above described property are being considered as a zoning violation of Section
31.2.1 of the Weld County Zoning Ordinance. Section 31.2.1 of the Weld County Zoning
Ordinance allows one single family dwelling unit per legal lot. The structure may have been
considered a nonconforming use based on the historical use of the structure, however, I spoke
with Mr. Scoby of the Weld County Assessor's office and you had indicated to him that the
structure had only been occupied for about 11/4 weeks. Additionally, Mr. Scoby indicated to me
that the structure has been historically taxed as an outbuilding.
It is the intention of this office to assist and cooperate with you without imposing undue
hardships; however, we have no discretion in this matter if you fail to correct this violation. You
have until May 8, 1998, to correct this zoning violation. Failure to do so will result in this office
referring the violation to the County Attorney's Office for legal action.

This matte:will also need to be resolved prior to submitting your RE-2167 plat for recording. In

for RE-2M 7 (dated March 5, 1998), once the matter is resolved,the f llowing note shall be
placed on the plat as well:
One single family dwelling unit per legal lot is allowed as a use by right in accordance
with Section 31.2.1 of the Weld County Zoning Ordinance.

During the commissioners° work session on November 18, 1998, Bruce Barker, County Attorney,
directed planning staff to obtain information pertaining to the medical hardship from Mr. Zyronski.
Staff attempted to obtain such information in accordance with Section 43.2.4.11 of the Weld
County Zoning Ordinance as follows:
• Staff requested a doctor's letter substantiating the medical hardship in
Sharyn Frazer's letter dated December 1, 1998.
• Sharyn Frazer and Dave Sprague made a site visit on Thursday,
December 3, to conduct an inspection of the accessory structure,
however, the Zyronski's were not home. A letter was left on the front door.
• Scott Ballstadt and Sharyn Frazer of the Department of Planning Services
also made a site visit on Friday, December 4, and contacted Mr.
Zyronski's mother-in-law and reiterated that a doctor's letter was needed.
The Department of Planning Services has not received such letter or any other information as of
this date and requests that the Board of County Commissioners make such determination.
Additionally, Section 43.2.4 of the Weld County Zoning Ordinance does not allow staff to permit
stick-built structures as temporary accessory structures for medical hardship. Staff requests that
the Board of County Commissioners also address this matter.

Frank Piacentino and John Roberts met with Ms. Goodrich, the tenant of the smaller home to the
North of the main dwelling. Both did inspections on Monday, December 7, 1998.
All corrections that were noted from previous inspections on BC-9800367 have been made, with
the exception of the matters relating to the electrical service. There does need to be an outside
electrical disconnect and a service upgrade. Some conductors surrounding the current
electrical service are exposed at this time. Ms. Goodrich told both inspectors that the intention is
to build an addition onto the kitchen. She said that when a permit is issued for the addition, the
electrical matters will be addressed.
