HomeMy WebLinkAbout980420.tiff HEARING CERTIFICATION RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE A public hearing was conducted on March 10, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Carol Harding County Attorney, Bruce Barker Planning Department representative, Sharyn Frazer Planning Department representative, David Sprague Planning Department representative, Jeff Reif The following business was transacted: I hereby certify that a public hearing was conducted to consider whether to authorize the County Attorney to proceed with legal action against the individuals named for violations of the Weld County Zoning Ordinance. Cases were heard as follows: VI #9700223 - PAUL SOLIZ: Jeff Reif, Department of Planning Services, presented the case report for the record and stated the manufactured home has not had several final inspections called for or completed; therefore it is in violation of Sections 70.4.2 of the Weld County Building Code Ordinance. To bring into compliance, the skirting, water service, final plumbing, and steps and landings inspections must be completed and approved. Mr. Reif recommended referral be delayED 90 days, and stated the property owner is willing to proceed and is making progress; however, he needs extra time to arrange for the money to pay for water services. Paul. Soliz, Jr., property owner, was present and stated the water is the only problem in complying with everything, and he agreed 90 days is sufficient time to complete the inspections. Commissioner Baxter moved to refer VI #9700223 against Paul Soliz to the County Attorney for legal action, with the instruction to delay action upon such referral until June 10, 1998, to allow adequate time for all inspections to be finaled. The motion was seconded by Commissioner Webster, and it carried unanimously. VI #9700163 -JOHN AND JUDITH HILLMAN: Sharyn Frazer, Department of Planning Services, presented the case report for the record and stated the mobile home is still located on the property; therefore it is a violation of Sections 31.2, 31.2.1, and 43 of the Weld County Zoning Ordinance. Ms. Frazer explained the property owner has been trying to sell the mobile home but has been unable to do so. John Hillman, property owner, stated he has a buyer interested in purchasing the home; however, he has not completed the sale. Responding to 980420 PL0824 ec tl ) 04 HEARING CERTIFICATION - ZONING VIOLATIONS March 10, 1998 PAGE 2 Commissioner Hall, Mr. Hillman stated he has been attempting to sell the mobile home since last fall but has been unsuccessful. After discussing several options for selling the mobile home, Commissioner Hall moved to refer VI #9700163 against John and Judith Hillman to the County Attorney for legal action, with the instruction to delay action upon such referral until May 11, 1998, to allow time for the mobile home to be removed from the property. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. VI #9600266 - DENNIS AND CAROLYN SEEWALD: David Sprague, Department of Planning Services, presented the case report for the record and stated the initial permit was issued on May 5, 1995; however, the final electrical inspection has not been completed and is, therefore, a violation of the Weld County Building Code Ordinance. Further, Mr. Sprague stated a hazardous situation exists because the four-wire feeder for the manufactured home is not properly grounded and the breaker would not trip at the appropriate time and expressed his concern regarding this life and safety matter. Commissioner Webster moved to refer VI #9600275 against Dennis and Carolyn Seewald to the County Attorney for legal action. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. This Certification was approved on the 16th day of March, 1998.
