THAN THE MINIMUM LOT SIZE IN THE A (AGRICULTURAL) ZONE DISTRICT -
MICHAEL AND SHEILA DAVIS
A public hearing was conducted on April 22, 1998, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 2, 1998, and duly published April 8, 1998, in
the Platteville Herald, a public hearing was conducted to consider the request of Michael and Sheila
Davis for a single family dwelling and accessory structures on a parcel less than the minimum lot
size in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a
matter of record. Todd Hodges, Department of Planning Services representative, presented a brief
summary of the proposal and entered the favorable recommendation of the Planning Commission
into the record as written. Mr. Hodges stated the property was created in 1994 by court decree;
however, that did not exempt it from the Zoning Ordinance restrictions so a Special Use Permit was
created to allow for a single family dwelling and accessory buildings. He also stated the property
to the south was also created by court decree in 1996 to be consistent. Mr. Hodges explained
Condition #3 addresses concerns of the Mountain View Fire Protection District and Saint Vrain
Valley School District RE-1 J, and stated there will be a joint access from Weld County Road 5 with
the property to the south. In response to Commissioner Baxter, Mr. Hodges stated the applicant
is willing to work with the Fire Protection District and the School District.
In response to Commissioner Baxter, Michael Davis, applicant, stated he does agree to install a
sprinkling system and added he spoke with Scott Toillion, Planning Specialist for St. Vrain Valley
School District RE-1 J, and agreed to pay the $427 assessment. Once this fee is paid, Mr. Davis
will receive a receipt and letter confirming his payment. In response to Chair Harbert, Mr. Davis
stated he reviewed and agrees to the Conditions of Approval and Development Standards. No
public testimony was offered concerning this matter.

Commissioner Baxter moved to approve the request of Michael and Sheila Davis for a Site Specific
Development Plan and Special Review Permit for a single family dwelling and accessory structures
on a parcel less than the minimum lot size in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Webster, and it carried unanimously.
This Certification was approved on the 27th day of April, 1998.
